Merriam-Webster’s Collegiate Dictionary defines piracy as, “an act of robbery on the high seas or an act resembling such robbery” (885). From this we can define software piracy as an act of robbery on the information superhighway. Many people do not see it as such. Even though the average person would never consider going into a convenience store and stealing a stick of gum, many have no qualms about stealing thousands of dollars worth of software. In a study done by the Canadian Alliance Against Software Theft, 43 percent of adult Canadians who were asked thought that pirating software for personal use was OK. This feeling has come about in several ways. Older computer users, with Unix backgrounds, remember many of the applications they used as freeware. Software pirating also results from users having access to freely downloadable applications, evaluation copies, and public betas. This leads users to believe that all software is free. While many downloadable applications carry expiration dates, many companies rely on “nag messages” rather then a disabling mechanism. These messages are easily ignored and allow the user to continue use of the product (Stevenson 18).
Despite these factors global software piracy rates are on the decline. However, the number of illegal applications installed continues to grow, according to the Business Software Alliance (BSA) and the Software and Information Industry Association (SIIA). In 1998, 38 percent of applications in use globally were pirated, down from 49 percent in 1994. Yet, 231 million business software applications installed were pirated, 2.5 million more than in 1997. This led to an eleven billion dollar loss in revenue by software companies (Paquet). Jason Penchoff, a BSA spokesperson, states, “Software piracy affects company productivity and jobs. For every free package or unlicensed package of software, companies are losing money. If an automaker lost 38 percent of its revenue, there would be a huge outcry” (qtd. in).
So how are users obtaining all this illegal software? Consumers now have the ability to purchase goods from their computer. Generally when we think of electronic commerce, we mostly think of business to consumer transactions. But one of the most rapidly growing developments in electronic commerce is the consumer-to-consumer market. The rapid growth of Internet auction sites has created shopping opportunities for online consumers that were never before available. According to SIIA’s Piracy on Internet Auction Sites, “consumer-to-consumer online auction revenue will climb from $4 billion in 1999 to more than $15 billion in 2004” (3).
The Golden Age of Piracy began around 1650, and ended around 1730. Piracy is an act of robbery or criminal violence at sea, but can include acts committed on land, in the air, or in other major bodies of water or on a shore. It does not normally include crimes committed against persons traveling on the same vessel as the criminal. The term has been used throughout history to refer to raids across land borders by non-state agents. A pirate is one who commits robberies at sea, usually without being allotted to do so by any particular nation. The usual crime for piracy can include being hung, or publically executed. Some of the most famous pirates who were killed either because of piracy, or because of natural causes, are Barbarossa, Stede Bonnet, Anne Bonney, Sir Francis Drake, Captain Greaves, William Kidd, Jean Laffite, Sir Henry Morgan, Mary Read, and Giovanni da Verrazano.
Modern piracy has touched nearly every corner of the globe and has increased with globalization. The tentacles of piracy now extend from South America to the South China Sea. The greatest numbers of piracy incidents occur along maritime commercial trade routes. Since China dominates the world’s container shipping industry, the South China Sea has become a hotspot for piracy (Kraska 2011). The prominence of cargo activity increases opportunity for pirates and indisputably triggered the sixty- nine incidents of piracy that were reported in 2009 in the South China Sea (Kraska 2011).
Why do people pirate software? The obvious answer is: people want to use the software, but not pay for it. However, when we change the question slightly, to: “Why do people steal source code?” A variety of interesting answers can pop up. Possibly, the thief wants to modify the code, make copies of it, and proceed to sell it as his own creation -- for a profit. Or, perhaps the perpetrator is a raging open source advocate and he simply wants to examine the stolen code to improve his programming skills. As harmless as the latter may sound, it is still a clearly defined crime in virtually every hi-tech country in the world.1
With a population of 1.357 billion (2013)3, China is the most populated country in the world. Along with the huge population comes a market that is unmatched by any other country of the world. Both domestic companies and foreign companies want to tap into this large market that just recently embraced capitalism and entered into the World Trade Organization.
A Worldwide Problem Software piracy is defined as the illegal copying of software for commercial or personal gain. Software companies have tried many methods to prevent piracy, with varying degrees of success. Several agencies like the Software Publishers Association and the Business Software Alliance have been formed to combat both worldwide and domestic piracy. Software piracy is an unresolved, worldwide problem, costing millions of dollars in lost revenue. Software companies have used many different copy protection schemes. The most annoying form of copy protection is the use of a key disk. This type of copy protection requires the user to insert the original disk every time the program is run. It can be quite difficult to keep up with disks that are years old. The most common technique of copy protection requires the user to look up a word or phrase in the program's manual. This method is less annoying than other forms of copy protection, but it can be a nuisance having to locate the manual every time. Software pirates usually have no trouble "cracking" the program, which permanently removes the copy protection. After the invention of CD-ROM, which until lately was uncopyable, most software companies stopped placing copy protection in their programs. Instead, the companies are trying new methods of disc impression. 3M recently developed a new technology of disc impression which allows companies to imprint an image on the read side of a CD-ROM. This technology would not prevent pirates from copying the CD, but it would make a "bootleg" copy differ from the original and make the copy traceable by law enforcement officials (Estes 89). Sometimes, when a person uses a pirated program, there is a "virus" attached to the program. Viruses are self-replicating programs that, when activated, can damage a computer. These viruses are most commonly found on pirated computer games, placed there by some malignant computer programmer. In his January 1993 article, Chris O' Malley points out that if piracy was wiped out viruses would eventually disappear (O' Malley 60). There are ways that a thrifty consumer can save money on software without resorting to piracy. Computer companies often offer discounts on new software if a person has previously purchased an earlier version of the software. Competition between companies also drives prices low and keeps the number of pirated copies down (Morgan 45). People eventually tire or outgrow their software and decide to sell it.
If there is one topic that will spark debate amongst PC gamers today, it is piracy and the impact its economic impact on the gaming industry. Nearly everyone has an opinion on the topic, ranging from complete acceptance and support for piracy to utter disgust and disapproval. In the past years, since the SOPA and PIPA legislation was proposed to Congress, this issue has reached its critical mass, with a different PC game developer blaming piracy as a present danger to the industry every other day. As someone who has played games for almost my entire life, I must confess I am rather upset when reading the innumerable discussions and articles on piracy.

Along with the increase of sales has brought forth an ever increasing problem of illegal media being downloaded. Programs such as Bittorent, Kazaa, and other direct-connect networking programs have allowed the transferring of such illegal media. Downloading song files from the Internet over a free peer to peer network is the moral equivalent of shoplifting music CDs from the local mall.

Although the internet is a great source for making money in legal ways, it is also used for plenty of malicious black market money scams. Music piracy is a developing problem that it affects the music industry in many different ways including being responsible for the unemployment of 750,000 workers, as well as a loss of $2,5 billion; therefore, I want to explore ‘To what extent has music piracy affected the music industry market in the United States over the last 10 years?’
Online piracy is a huge problem, one which costs the U.S. economy between $200 and $250 billion per year, and is responsible for the loss of 750,000 American jobs. These numbers seem huge: $250 billion per year loss would be almost $800 for every man, woman, and child in America. And 750,000 jobs – that’s twice the number of those employed in the entire motion picture industry in 2010 (Freakonomics). In 2010, the Government Accountability Office released a report noting that these figures “can be substantiated or traced back to an underlying data source or methodology,” which in English means these figures are legitimate and that piracy really does hurt our economy.
It's important to understand the different software piracy channels, not just to comply with the law but also to protect against bigger economic problems like lost revenue...and lost jobs.
As explained above, illegal downloading is a great problem affecting the entertainment industry and could soon be an even bigger problem for consumers. Downloading copyrighted material illegally is just as unlawful as stealing from a store or someone’s personal item. To prevent shutting down businesses and industries, internet pirates must be stopped and actively sought after. So if one is downloading material illegally take in to mind what harm it can do to and who is being hurt in the process. Free does not mean that it’s moral or fine; one must analyze and see the consequences of such actions before they continue—otherwise, it could be the end of something great because people were stealing and driving companies out of business, with no force stopping them.
