Role of an Oversight Officer
Oversight is provided by the Privacy Commission of Canada. The commissioner can investigate complaints and issue recommendations, but have no order making power. There are several advantages to oversight officers having order-making power. It eliminates long and expensive appeals to the courts, which tends to happen with the ombudsman model. It also ensures that local authorities pay closer attention to guidelines, advice, and direction from oversights officers and ensures a consistent approach when interpreting and applying the FOIP laws. A third party may also apply for a review of a decision to give access to a record that affects their interests. There is a one-year period, in which the review be requested. Oversight officers must then establish whether there is reasonable grounds to review matter and may discontinue the review if the application is deemed frivolous, vexatious or not made in good faith.
