Belanger v. Swift Transportation, Inc. is a case concerned with the qualified privilege of employers. In this case Belanger, a former employee of Swift Transportation, sued the company for libel in regard to posting the reason for his termination on a government data website accessible to other potential employers. Swift has a policy of automatic termination if a driver is in an accident, unless it can be proved that it was unpreventable. The 1920’s was a time of great social, political, and economic change. The early automobile industry was no exclusion. It appears that throughout history, the figures that stand out the most are either worshipped or despised, and there is very rarely an in-between. Henry Ford, an icon of the 1920’s and the early automobile industry is no exemption. Many people love Ford for his innovative and entrepreneurial skills, while on the other hand, Ford is disliked by many due to his association with Anti-Semitism. Regardless of how Ford is viewed, many decisions he made significantly impacted the automobile industry. These decisions included installing the moving assembly line in his plant, and introducing the Five-Dollar Day. Through the implementation of the Five-Dollar Day, Ford was able to drastically change how the Ford Motor Company company operated, and how business would operate for years to come.
Foreign markets were beginning to show promise with the vehicles that were going to put out on the market. The Ford Motor Company began to feel the pressure and felt that it needed to be in the limelight of the competition. Lee Iococca, the CEO of Ford, decided that it was time for a change and thus the Ford Pinto was introduced. However, the Pinto had numerous flaws that cost the Ford Company more than ever anticipated.
The many stakeholders in this case include George, the city of Hondo, current employees, environment and the company. George relocated his family and stands to lose his position if the company is moved to another location. He is faced with the decision of continuing to allow the emissions to soar above the EPA guidelines, at the current location by scheduling the heavy emissions work at night, therefore causing more damage to the environment. Furthermore, should he instruct the company to relocate to the new location the environment would still be affected on the U.S. side. By continuing to be above the benchmark of emissions the environment, employees and citizens are affected. “The environmental issues managers face are not simply about trees and water and birds. These issues affect all people, including the managers themselves.” (eGuide, p.2) In addition, the employees are stakeholders because they face losing their source of income. Lastly, the company is a stakeholder because they stand to face the cost of relocating or continuing to suffer from fines. The interest for each stakeholder is a loss of monies and the environment continues to be affected.
When we consider the case of the Ford Pinto, and its relative controversy, through the varied scope of ethical viewpoints, the results might surprise us. From a personal standpoint, as a consumer, the idea of selling a vehicle to the masses with such a potentially devastating flaw is completely unethical. When we consider the case from other directions and other ethical viewpoints, however, it makes it clear that often ethics are a matter of perspective and philosophy. It’s also clear that there are cases where more information will muddy the waters, rather than clear them.
The final decision would then be to have the engineers and manufacturers are at the uppermost authority in aerospace decision making with regards to ethics. They should have the primary responsibility to inform the government, at any cost and at any concern as to the safety and well being of passengers who fly. Engineers and manufacturers are the ones who create aerospace vehicles, so they should be the ones to decide on the extent of their safety, and the safety of all who use them.
