George Washington, Benjamin Franklin, James Madison, and Alexander Hamilton are the most famous and powerful people for gaining individual rights, in the world. These rights are listed in the Constitution; the most supreme law of the land, followed and enforced by every individual. These liberties are gained from the moment the individual was born, and cannot be compromised in any way. If these liberties are limited, then who’s to say that we have freedom? Someone who has freedom has the ability to do what they desire and when they want to do so. When this is taken away, the country as a whole has no incentive to keep pushing forward, since they know that their ideas don’t matter anymore. But our government has risked these liberties for security …show more content…
However, the majority of Americans truly think that these surveillance programs will not affect the ability of the United States to prevent future terrorist attacks, meaning that the government is limiting our liberties unnecessarily, according to CBS News. Ever since the 9/11 terrorist attacks on the United States, specifically New York City, the federal government has taken extraordinary measures to protect the security of the nation. Even in today’s society, preserving national security has breached individual liberties through detention, military commissions, torture, targeted killings, secrecy, and privacy and surveillance. The president of the United States has used his power to declare the entire globe a war zone and has detained civilians from any location as prisoners, holding them indefinitely without charge or trial. As a result of his power, more than 100 people remained imprisoned at Guantanamo Bay. The detainees should be prosecuted and should obtain a trial through our justice system; without this, basic criminal rights are taken away, stated in the 5th and 6th amendments of the U.S. Constitution. However, they were denied that
Typically the most basic civil liberties are found in a country’s bill of rights and then that country passes amendments as needed in order to grow the peoples’ civil liberties, or shrink them if need be. Now, in the case of the United States the people are not “granted“ civil liberties by the...
The English Bill of Rights is an Act of the Parliament of England that deals with constitutional matters and sets out certain basic civil rights. This constitution was passed on December 16, 1689.The Bill was passed to declare laws and liberties of the people. Also the people wanted separation of powers and limits the of power to the king and queen. It guarantees the rights of enhancing the democratic election and to get more freedom of speech. No armies should be raised in peacetime, no taxes can be levied, without the authority of parliament. Laws should not be dispensed with, or suspended, without the consent of parliament and no excessive fines should imposed, nor cruel and unusual punishments inflicted. King James the 2nd, had abused his
The 4th amendment provides citizens protections from unreasonable searches and seizures from law enforcement. Search and seizure cases are governed by the 4th amendment and case law. The United States Supreme Court has crafted exceptions to the 4th amendment where law enforcement would ordinarily need to get a warrant to conduct a search. One of the exceptions to the warrant requirement falls under vehicle stops. Law enforcement can search a vehicle incident to an individual’s arrest if the individual unsecured by the police and is in reaching distance of the passenger compartment. Disjunctive to the first exception a warrantless search can be conducted if there is reasonable belief
It is 1776, the United States had just declared it’s Independence from England and one of those reasons for departing was the requirement to house British soldiers at anytime. After the French and Indian War England felt the need to thousands of soldiers in the colonies and an colonial quartering act was passed in 1765.When the British required the quartering of soldiers in the colonies it had passed in England that quartering of soldiers was not required. This quartering act on the colonies along with overtaxing lead to the start of the Revolution.Once the Americans won the war and had need to draft a constitution for the newly formed country, the exclusion of this requirement had to be added to the Bills of Rights.
The United State of America, established by the Founding Father who lead the American Revolution, accomplished many hardship in order to construct what America is today. As history established America’s future, the suffering the United State encountered through history illustrate America’s ability to identify mistakes and make changes to prevent the predictable. The 2nd Amendment was written by the Founding Father who had their rights to bear arms revoked when they believe rising up to their government was appropriate. The Twentieth Century, American’s are divided on the 2nd Amendment rights, “The right to bear arms.” To understand why the Founding Father written this Amendment, investigating the histories and current measures may help the American people gain a better understanding of gun’s rights in today’s America.
According to Thomas Jefferson, all men are created equal with certain unalienable rights. Unalienable rights are rights given to the people by their Creator rather than by government. These rights are inseparable from us and can’t be altered, denied, nullified or taken away by any government, except in extremely rare circumstances in which the government can take action against a particular right as long as it is in favor of the people’s safety. The Declaration of Independence of the United States of America mentions three examples of unalienable rights: “Life, Liberty and the pursuit of Happiness”. I believe these rights, since they are acquired by every human being from the day they are conceived, should always be respected, but being realistic, most of the time, the government intervenes and either diminishes or
1. In the First Amendment, the clause that states “Congress shall make no law respecting the establishment of religion” is based on the Establishment Clauses that is incorporated in the amendment. This clauses prohibits the government to establish a state religion and then enforce it on its citizens to believe it. Without this clause, the government can force participation in this chosen religion, and then punish anyone who does not obey to the faith chosen. This clause was in issue in a court case mentioned in Gaustad’s reading “Proclaim Liberty Throughout All the Land”. March v. Chambers was a court case that involved the establishment clause. Chambers was a member of the Nebraska state legislature who began each session with prayer by a chaplain who was being paid the state. The case stated that this violated the Establishment Clause of the First Amendment. However, the court stated that the establishment clause was not breached by the prayer, but was violated because of the fact that the chaplain was being paid from public funds.
The Constitution of the United States of America protects people’s rights because it limits the power of government against its people. Those rights guaranteed in the Constitution are better known as the Bill of Rights. Within these rights, the Fourth Amendment protects “the right of the people to be secure in their persons, houses, papers, and effects against unreasonable search and seizures […]” (Knetzger & Muraski, 2008). According to the Fourth Amendment, a search warrant must be issued before a search and seizure takes place. However, consent for lawful search is one of the most common exceptions to the search warrant requirement.
The first amendment ensures us the freedom of speech. The people of this country use that to voice their opinion on issues in our society. What the average citizen doesn’t know is that their first amendment can be revoked in terms of time, place, and the manner they are exercising it. Recently there have been many protests following homicides of black males by the hands of law enforcement. We’ve seen across the country where an officer involved shooting results in violence among the community. There are rioting, violent protests, putting other citizens at risk of either property loss or being injured, and fires that are set. We know that every agency across the US is just one-officer-involved shooting away from staring down the barrel of that
I am a 37-year-old Army Veteran who served 2 tours in Afghanistan. I enlisted in the Army on September 27th, 2001, when i was 23 years old. I was living in New York City at the time of the attacks and I witnessed the evils of Al Qaeda. We are all aware that after the attacks on September 11th, 2001, our government implemented a new surveillance policy. Over these past few years, there has been much scrutiny over this policy. Some claim it is illegal, or that it violates Americans’ rights. I am here to tell you these accusations are all false. A lot of the criticisms started over President Bush. Many claim that he extended his powers to expand this surveillance program. Bush, however, was entirely within his rights as the Commander-in-Chief. The Constitution clearly states that one of his most important jobs s to protect this country (Hayden). This program’s exclusive goal was to make the country safer. Also, if this program really were illegal, it would have been ruled so during the multiple hearings on surveillance. Not just once, but many times, the government 's surveillance program was ruled to be compliant with the limits of the Constitution
“The Fourth Amendment wasn't written for people with nothing to hide any more than the First Amendment was written for people with nothing to say.” (Dave Krueger). The Fourth Amendment protects the people's values, including the right of privacy. The Fourth Amendment includes, “The right of the people to be secure in their persons, houses, paper, effects, against unreasonable searches and seizure, shall not be violated.” When the founding fathers created the Constitution they ensured the people fundamental laws that would be used to any issue portrayed in the Supreme Court. That gave the people a relief that no one is ever above the law that is created. The privacy of the people was a very big value enforced by warrants. In the case of the
Everyday we have the chance to make her own opinions and give reason to our own voice. We have the chance to live in a country that encourages freedom in society, which separate ourselves from any restrictions imposed upon by authority, actions or any political views. liberty is the power we possess to act as we please through freedom and independence. But what happens when we choose to give away our basic liberties for temporary safety? Benjamin Franklin once stated, “They who give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety.” Those who decide to give away their personal freedoms for something that is temporary do not see the value in the long-lasting gift called freedom. In
The First Amendment is what we chose because it covers good areas (topics) that are occurring in the world on a daily basis. Many people like the items that The First Amendment covers, and some people don't like them. Either way there are many other amendments that have been ratified by the two-thirds of the House and Senate. There are ten amendments in the constitution, but there are 17 other amendments that aren't in the constitution. Therefore, in total there are 27 amendments.
Benjamin Franklin, one of the founding fathers of the United States, once said “Those who would give up essential liberty to purchase a little temporary safety, deserve neither liberty nor safety.” In America’s society today, some are willing to sacrifice their civil liberties in order to gain protection and security over some potential threat. Especially after the events of September 11th and several attempted bombings in U.S. cities. This sacrifice of individual freedoms such as the freedom of speech, expression, the right to information, to new technologies, and so forth, for additional protection is more of a loss than a gain. Citizens of the United States deserve equal liberty and safety overall, as someone should not have to give up one value in order to gain another. This concept of individual right goes beyond the simple idea of “individual comfort.” Personal liberties cannot be surrendered and are not to be compromised since these liberties are intangible. Individuals should not have their personal liberties exchanged for national security because individuals are guaranteed protection to these rights.
Freedom is having the right to own, act, think, and speak without any restrictions from the outside. Ever since the New World was discovered, people have been fighting for their independence till this day. People of other colors and race have been forced to do labor without their consent. Today, those same people have been blamed or accused of crimes that were not committed by them despite of being free. Freedom has different meanings and those meanings change overtime; however sometimes the significance of freedom does not change.
