In this episode of Law & Order: Special Victims Unit a man with the last name Lewis has escaped from prison and is after Sargent Oliva Benson. To protect her and the integrity of the precinct Lieutenant Murphy is brought in to take over Bensons post meanwhile Benson is put under 24/7 surveillance for her protection. After escaping Lewis visits the prison doctors house after killing her and raping her daughter whom he leaves a message with for Benson he leaves. Benson goes to see the girl in the hospital to see what Murphy told her and along with the details of the girls rape she tell Benson that he took her little sister and that if they want to see the girl alive Benson has to tell the truth. and she tells him that when she testified against Lewis she said that he had escaped her handcuffs and had lunged at her she admits to Murphy that it was a lie and that Lewis was handcuffed and incapacitated when she took him down. After hearing this Murphy tells Benson that she should of killed Lewis when she had the chance. Benson admits what she did on the news in hopes that Lewis will release the girl however he does not release her and instead tells Benson to meet him alone. Benson escapes her detail and meets Lewis who handcuffs her and takes her to the girl. After Benson refuses to participate by fighting or doing anything when Lewis goes to rape her he forces her to play Russian roulette. In the end Lewis says to Benson that if he dies no one will believe he shot himself or believe her innocence because of her confession he then shoots himself. There were many ethical dilemmas in this episode for everyone involved. The security profession has its own strict code of ethics and Olivia Benson faced many ethical dilemmas and she did not resolve them and act ethically. The Art of Investigative Interviewing by Inge Sebyan Black mentions theses ethics the first ethical code for the security professional can be found on page 12 and it states: 1. Act in the interests of the security of society and their client. A security professional shall: a. Act honorably, responsibly, diligently, and lawfully and uphold the reputation, standing, and dignity of the Security Profession within society. b. Not act recklessly, maliciously, or in a manner that will negatively impact the reputation of other individuals or organizations. c. Act in the interests of the security of society and their client. d. Act honorably, responsibly, diligently, and lawfully and uphold the reputation, standing, and dignity of the company, employer, or client to which the security professional has a professional or legal association. Olivia Benson broke this code she did not act lawfully when she originally arrested Lewis nor did she act lawfully when she testified against Lewis and perjured herself.
She did not act in a way that would uphold the reputation or dignity of the security profession. Her actions go against what the security profession stands for. Many would understand why she acted the way she did and some might think highly of her for doing what she did because it got a serial rapist off the streets however, she did break the law and that is a serious offense no matter why she did it. Avoid deceptive acts by actively taking steps to prevent corrupt practices or professional misconduct. Olivia Benson most defiantly did abuse her power and in this episode she even admitted that she abused her power on live news.
She broke the law when she attacked an incapacitated man and again when she perjured herself. However, she is not the only one who broke this code of ethics when Olivia told detective Murphy about perjuring herself he did nothing. Letter c of this code of ethics says take steps to stop unethical practices or professional wrongdoings and when Olivia told him what she did he should have arrested her and turned her in. By keeping her secret Murphy broke not only the code of ethics but the law. This was not last code of ethics broken on this episode of Special Victims Unit. The final code of ethics that will be mentioned being broken on this episode is also found on page 14 of The Art of Investigative Interviewing by Inge Sebyan Black this security professional principal states that a security professional will: 7. Not knowingly undertake any action that brings the profession into disrepute. A Security Professional shall: a. Be objective and truthful in any statement made in their professional capacity. b. Act honorably, responsibly, diligently, and lawfully and uphold the reputation, standing, and dignity of the profession. c. Not engage in acts of collusion, corruption, or breaches of the law. d. Be a positive role model for others in the
profession. Lieutenant Murphy did not act responsibly or diligently by allowing Oliva to be so involved in tracking Lewis down she should have been kept away from the investigation and only allowed to be there when absolutely necessary. He did not act honorably when he kept Olivias secret and said she should have killed Lewis that is not honorable or objective he let his personal feelings cloud his actions. Olivia Benson also let her emotional feelings cloud her actions when she attacked Lewis and again was not objective when testifying she was also not truthful when she testified or even when she told the truth on the news. She said on the news that she was saying this all not expecting anything in return and that she expected no quid-pro-quo from Lewis that was a lie she was expecting him to release the little girl in exchange for her telling the truth. Olivia is running the Special Victims Unit and she was corrupt and broke the law she did not act in a way that a role model would or in a way that shows she deserves her position. There are several ways I would have done something different than both Sargent Benson and Detective Murphy. I would not have acted as Benson did after arresting Lewis beating a man who is incapacitated is unacceptable no matter what he did I would have remained my objectivity which means I would have had no reason to perjure myself. If I had beat Lewis, I would not have perjured myself and said he broke for and lunged for me admitting you let your feeling get the best of you may hurt your career but it also means you can get help. If someone had seen that Benson had lost control of her feelings, then maybe should could have got help because in a job like working in the special victims unit you cannot let your emotions get the best of you. Her actions could mean that Lewis would have walked free she could have severely hurt the case and if he had not acted as he did after escaping and she had come clean he might have walked free. Her actions as it is makes that precinct look bad if there Sargent has committed police brutality how can they trust those detectives to be any different. If I was Lieutenant Murphy, I would have arrested Benson right when she admitted what she had done. She broke the law and now due to her actions a rapist is taking revenge and if he hadn’t done what he did after escaping her actions could have led to his freedom because of her. Lieutenant Murphy was wrong to keep her secret if I was him I would have arrested her and kept her as far from the investigation as possible.
