Former Judge LaDoris Cordell, of Superior Courts of Santa Clara and State Trial Judge since 1982 agreed that some juveniles need to be place in the adult division due to sociopath tendencies. She states “I have seen many juveniles come through my courtroom not understanding or grasping the concept of eternal social branding. You feel a sense of sympathy because you want so much more for them. But then you have the ones that are too far removed emotionally from the deeds in which they have displayed, and realize that the best thing for their safety and society’s safety is incarceration in an adult facility.”
There is no doubt that juvenile delinquents should not be let off easy, but is charging them as adults an effective remedy? Trying juveniles as adults has not proven to deter crime, instead it undermines them and builds obstacles for their future. So why would a judge opt to send a juvenile to an adult facility?
Recent studies have shown a shift from juveniles committing misdemeanors to now being charged with more serious crimes. The 2002 World Health Organization Statistics analysis indicates the United States ranks third in murders committed by youths and fourteenth in murders per capita committed by juveniles ( Haerens, Juvenile Crime ,p 25).
