Julian Manuel Cruz Case Study

INTRODUCTION:
This case involves the arrest of Julian Manuel Garcia for an open container of alcohol in violation of PMC 9.24.040- Possession of an Open Container of Alcohol in public.

INVESTIGATION:
On 12-01-15 at 1524 hours, I was working uniformed patrol with Officer Cass #2067. We were traveling north on McGrew Alley approaching Orange Grove Bl. I observed a male Hispanic, later identified as Suspect Garcia leaning forward against a brick wall in McGrew Alley.
We contacted Garcia and I observed a Budweiser beer can on top of an appliance that was covered with a blue tarp on the west side of the brick wall. Garcia admitted the beer can belonged to him and that he was drinking out of it. I picked up the beer can which was half full and

cool to the touch. I took a digital photograph of the beer can (see attached photograph.)
I conducted a records check on Garcia through dispatch and verified his identity. Based on the above information, I issued Garcia a citation for PMC 9.24.040-Possession of an Open Container of Alcohol in public (Citation #C252222). Garcia was released in the field and is scheduled to appear at the Pasadena Court on 01-05-16 at 0830 hours.
DISPOSITION:
Case to City Prosecutor.
