No further information was given and the questionnaire was not filled out. LAA’s doctors (Defendant), Dr. Preau and Dr. Dennis, submitted referral letters for on his behalf. The letter from Dr. Dennis and Dr. Preau stated that both of them had worked with Dr. Berry and they highly recommend Dr. Berry as an anaestheologist. Based on the letter and recommendations, Kadlec hired him. Approximately a year later, Berry again started using Demerol. On work at Kadlec, he committed gross negligence resulting in severe brain damage to patient. Due to this incidence Kadlec learned that Dr. Berry had been fired from Lakeview. Kadlec first settled Dr. Berry’s malpractice case and then filed suit against Lakeview, its shareholders, and LMC for intentional negligence and strict responsibility misrepresentation based on LMC’s omission of material facts in the letter to Kadlec. The district court supported Plaintiff’s theory. LMC’s moved for summary
They reasoned that since Barnett didn’t either argue against the dismissal of negligence claim at the time of its dismissal or include the claim in subsequent revisions, she had no support for her claim that the court had erred in dismissing her claim of negligence. The court also ruled that the language of section 3-108(b) of the Tort Immunity Act meant that complete, unconditional immunity was to be offered if supervision was present. As a result of this interpretation, the issue of if the lifeguards had committed willful and wanton misconduct was rendered irrelevant. Since the issues of material fact raised by the appellant weren’t actually issues of material fact, the Supreme Court affirmed the District and Appellate Court’s motion and subsequent affirmation of summary

Illinois. Mercherle didn’t think it was fair that families and other farmers that lived in rural communities paid the same auto insurance rates as those that lived in Chicago. He wanted to establish an “honest insurance company that provided rates related to the risk” (State Farm, About Us). In 1922, after the company opened their doors, a new claim was made which established State Farm’s promise “to be there when the unexpected happens” (State Farm, About Us).
Case name: Peter K. Dementas v The Estate of Jack Tallas, 764 P.2d 628 (1988)
In the pleadings, a complaint needs to be filed by the plaintiff with the court and the defendants. In this case, the complaint was filed for wrongful death and injunctions. The complaint was given to both companies on May 14, 1982. Then, the defendants must answer within twenty-four hours of receiving the complaint to the summon or risk losing the case by default of the court. W.R. Grace denied the allegations against them. Also, their other defenses was that the complaint didn’t state any cause of action, in the complaint the company named was misnamed, the company followed the due of care at all times and acted in “good faith,” and the claims against them are barred. The next step is the methods of discovery.
Meyer v. State of Nebraska. 262 U.S. 390, 399, 43 Sct. 625, 626, 67 L.Ed. 1042. (1923)
Jennifer Lopez was born in the Bronx, New York on July 24, 1970. She was born in the United States to Puerto Rican Parents, Jennifer considers herself to be a Puerto Rican and she is very proud of her Hispanic heritage and culture. Her father is David Lopez, a computer specialist, and her mother Guadalupe Lopez, a Kindergarten teacher. Her parents recognized Jennifer’s talent and enthusiasm for performing and at the age of five the enrolled her in dance classes. Her mother said “Jennifer always loved to sing, but she was also a great actress and knew that she would have a bright future ahead of her.” With the support of her parents Jennifer grew up to be a very sensible girl, who is still very close to her family. When Jennifer earned her million-dollar paycheck for playing the role in the movie Selena, she bought her mom a Cadillac. Even though they saw Jennifer’s talent at the age of five, their relationship was not always understandable. Jennifer made a major decision and that was not to go to College. That decision was very disappointing to her parents who wanted her to go to law school. Her parents supported her pursuit of a career in show business, they did not wanted to be in the expense of her education. When Jennifer told her parents that she was not going to College and law school, they thought it was really stupid to go off and try to be a movie star.
When she was admitted into our insured’s home on January 20, 2015, she was four feet nine inches tall and weighed 137 pounds, and had a prior diagnosis of Alzheimer’s related dementia. Prior to moving into the insured’s CILA at 3 Lynnwood AVENUE, Fairview Heights, Illinois, she lived with the plaintiff, who is her sister and guardian. Her father, formerly a minister, took care of her previously until he needed to move into assisted living
“She was from Pasadena, this six-foot-two marvel of a woman. It was not so much because she was an extraordinary cook- and she would pointedly remind us that she was a cook, not a chef” (Kehoe 1). Julia Child was an extraordinary woman who had a passion for cooking that she didn’t even know could change the way people cook. Julia Child most definitely influenced cooking for generations to come with her passion for cooking and love for food.
One of the most egregious examples of insures finding loopholes is in Melissa Morelli’s story. According to the New York Times, a 13 year old girl named Melissa Morelli was “taken to the hospital, she was suicidal and cutting herself”, her mother says (Abelson). She was transferred to a psychiatric hospital and stayed there for more than a week. Her doctors told her mother that it was not safe for her to return home but the problem was is that her insurance company, Anthem Blue Cross, wouldn’t continue to pay for her to stay in the hospital. Her mother, Cathy Morelli, kept on trying to get them to agree to pay for her daughter’s treatment, but they wouldn’t agree. “It was revolving doors”, Ms. Morelli said (Ibid). She has been constantly going to her insurance company for over 5 months just to hear them reject to pay for the care...
Is government regulation something that benefits us, or something that deprives us of our freedom? Katherine Mangu-Ward, a Libertarian Journalist who has written for the Washington Post, the Wall Street Journal, and the Weekly Standard, would introduce government regulations as an endangerment to our constitutional freedom. Mangu-Ward is a Yale Graduate that has a concept that negative liberty is at war with the people. She believes that there should be minimal interference from the government or anyone else, and that people have become complacent with government interference. I disagree with Mangu-Ward’s theory, and believe that people aren’t fighting against negative liberty, its concept is just dying out while people are embracing positive liberty because it’s the better concept. I also disagree with her belief that the government shouldn’t regulate our lives, government regulation is something that keeps us and the world healthy.
In the end, DOWL was only responsible for the $50,000 it had included into the limitation of liability clause in the initial contract with Zirkelbach. Zirkelbach, because of failure to navigate a contract, ended up paying the rest of the $1,218,197 to finish the project that it had contracted through SunCap Billings. The court made the correct decision on the case, as they based their decision on previous cases that were similar in the aspects of this case. After I researched Zirkelbach, I took the time to find reviews on the company that may deter the accidental situation that the company had gotten into. According to Glassdoor, a former employee from Palmetto Florida wrote “the firm is in dire financial situation, not paying subcontractors
There are a lot of reasons for the problems that happen between teenagers and parents. Each of them usually has no merit to the parents whatsoever, who likely feel as though the children are simply egocentric and are unnecessarily acting up. The children, however, believe that their parents are trying their hardest to make their lives miserable. In the passage from the novel “Confetti Girl” Diana López, the narrator is expressing her hatred for her father’s penchant for English. This makes her wonder if he really has any love or affection for her too. In the passage from “Tortilla Sun” by Jennifer Cervantes, Izzy is told by her mother that they will have to part ways for two months. In this time period, Izzy must stay at her Nana’s village.
Personal hygiene is something that every person - in every culture - of every age must attend to. While different cultures have different standards of cleanliness, it is something that everyone needs to consider according to Julia Twigg’s The Body and Bathing: Help with Personal Care at Home. Young children, youth, adults, and the elderly must all conform to these standards in one way or another. Due to age some people are incapable of keeping themselves adequate for the society’s sanitation customs. This requires them to acquire help of some sort, specifically when it comes to bathing. Young children and people of old age may need someone to help them bathe, although the approach to both body types is different. While they do share known similarities, the process of bathing people of different age changes the aspect of bathing itself through the eyes of the bather and the bathee.
