Introduction:
Government passes law to the society to prevent the risk factor that is of significant harm to their health or life. Some of those activities that cause risk are drinking and driving, use of dangerous weapons. We notice that these activities pose a risk to others who are not engaged in these activities. But there are activities that pose a danger to the participant who engage in them. For example, drinking, smoking, rock climbing. Since all states follow freedom, the state cannot pass laws that forbid consenting adults from participating in such activities just because they cause harm to them. A person engaging in an activity with full knowledge of the risks involved is morally justified. It is morally wrong to get into a person’s freedom just to prevent him from harming himself.
Argument:
1. State has no business passing laws that forbid knowledgeable and consenting adults from engaging in activities that pose risk of harm to them.
2. Smoking in private places is considered to be an activity that does not pose risk of harm to others.
3. Therefore, State cannot pass law to prevent smoking in private.
Defense of Premises of the argument:
To restrict a person’s freedom by preventing him from harming himself is morally not permissible. Law can only restrict people who cannot engage in harmful activities with full knowledge. For example, a child does not know the consequences of smoking. In that case state has the responsibility in preventing such activities, thus government has a law to prevent young age smokers. It is illegal for person under age of 18 to buy tobacco products or to get tobacco products from people above age of 18. Every person has a responsibility of their own life...

Nicotine makes it almost impossible for cigarette smokers to quit smoking because of its addictive nature, and with the cigarette manufacturers putting just enough nicotine in the so they cant be outlawed. The benefits of outlawing cigarettes greatly outnumber the disadvantages, for example, many scientists believe a link between smoking and a shortened life span exists between the two, a ban on cigarettes could increase life spans. Many studies suggest that billions of dollars now spent on smoking related. Smoking related illnesses could be reduced by outlawing cigarettes, families could save money by not purchasing cigarettes, and accidental fires costing millions of dollars caused by cigarettes would stop. Although a complete ban on cigarettes currently remains almost impossible, several organizations recently helped create a bill that could control cigarettes much in the same way the government now controls drugs. One such organization, the Food and Drug Administration, headed by David Kesslar drafted a major part, which would require manufacturers to disclose the 700 chemical additives in cigarettes, reduce the level of harmful chemicals, require cigarette companies to warn of the addictive nicotine, restrict tobacco advertising and promotion, and control the level of nicotine cigarettes contain.

Smoking ban is one of the controversial ways for reducing smoking and recognizing non-smokers’ right to health protection. The health risks of smoking are clear. Passive smoking does carry risks. Many leading medical and scientific organizations recognize second hand smoke as a cause of a range of life-threatening conditions. The health situation could be drastically improved if one of the risk factors - tobacco - was eliminated. People have a right to protect themselves from smoke inhalation. People shouldn’t have to inhale the ill-effects of other people’s smoking. The creation of smoke-free public places also improves air quality.

Although people are aware of the bad effects of smoking, they still smoke for one reason or another. When the current situation is considered, it is clear that smoking which has been spreading all over the world is not only the problem of a country or a territory but the problem of mankind because smoking brings many disadvantages for humans like diseases. I personally believe that it is important to help children remain lifelong non-smokers because they are our hope for a non-smoking future.
