Crime and the Criminal Internet Laws
Cyber Space Law Right now there is a very interesting war being waged in the court rooms across America. It is a battle for the rights of citizens on the Internet. The Internet is a fairly new medium gaining wide popularity in 1994. Because of its incredible growth in popularity in a very short amount of time it has been hard to regulate. The first act to come out regarding the Internet and Freedom of Speech was PL 99-508 the Electronic Communications and Privacy Act of 1986 . This act consisted of two parts, title I and title II. Title I - Interception of Communications and Related Matters. Basically takes the existing laws and updates them to include computers. Where before it was illegal to intercept private telephone calls, it now says it is illegal to intercept private computer transmissions. It also includes a provision to make it legal to intercept public radio transmissions like it is with public radio programs. It also allows Internet Service Providers to keep a log of who called and their activity on-line to protect themselves. Title II - Stored Wire and Electronic Communications and Transactional Records Access. This provision adds sections to Title 18 of the United States Code (USC). In section 2701 - Unlawful Access to Stored Communications; it makes it a federal offense to hack into a computer system. Actually what it says is that it is not illegal to gain access but once you do gain access, by mistake or intention, it is illegal to continue to access the computer system. This crime is punishable by $5000 or up to six months in jail. Section 2703 of USC Title 18 is the section that instructs Internet Service Providers to keep a back-up record of your activities on-line with a court order from a government entity. Then after the government notifies the individual in question, the material is either used by the agency or is destroyed. Probably the biggest battle yet over the first amendment rights so far has been the Communications Decency Act or CDA. In March 1995 Senator Jim Exon introduces legislation to criminalize online publication of any material deemed "obscene, lascivious, filthy or indecent." This legislation was attached to a larger and popular Telecommunications Reform Bill. The Senate and the House voted to approve the Telecommunications Reform Bill in February 1996.
Giants and Angels roam the pages of Gabriel Garcia Marquez’s stories, “A Very Old Man With Enormous Wings”, and “The Handsomest Drowned Man In The World”, creating the perfect scene for magical realism. Many of the elements within these stories coincide with each other; this has everything to do with the overall component of magical realism, which binds together similarities and sets apart differences. The theme of each story can be found within the other and can stand by itself to represent the story it belongs to, the settings are similar in location and the ability to change but different in their downsides and the writing style is so similar it is complicated to find any differences. Marquez is a master story-teller whose works of art can only be compared with each other.
In the short story “A Very Old Man with Enormous Wings” by Gabriel García Márquez, it tells the story of a man named Pelayo and a woman named Elisenda. The couple discovers an old man in the courtyard; however, he’s not like any ordinary old man. This man has enormous wings. The couple asked their neighbor what she thought the man was and she identifies the old man as an angel. The couple then placed him in the chicken coop until Father Gonzaga arrived. Father Gonzaga questioned the old man and established that the man was not an angel. Pelayo and Elisenda decide to keep him caged up and they used him for profit and displayed him to the public like a sideshow attraction. As time passed the old winged man starts to show signs of becoming ill;

“A Very Old man with Enormous Wings” is a short story written by Gabriel García Márquez in the third person objective point of view that utilizes magic realism to highlight some of its literary themes and elements. The title of the story alludes to an angel that Peyalo and his family find after he has fallen into their yard. The story utilizes magic realism all throughout primarily through the angel to make elements pertaining to human nature shine through. Márquez shows these various aspects of human nature in the story mainly by highlighting three main natures, caring, curiosity, and the opportunism of humans through his use of magic realism.

Gabriel Garcia Marquez, the author of “Avery Old Man with Enormous Wings” is a well-known Colombian author “that has been considered one of the best writers of the 20th century”(Macondo). He published his first collection of short stories in 1955, which included the fictional short story written for children, called the “A Very Old Man with Enormous Wings.” In his work, he expresses that it is possible that he may have experienced similar cruelty within his life and the life of others. ‘We've entered a cultural realm in our own collective history where it has become necessary to question what's real.”(Sellman) It is Marquez's purpose to make individuals aware of the harm that is inflicted on others. He demonstrates how awful people can act around those who are different from what society considers as normal.
Majority of the time dreaming can cause people to find themselves in strange places they have never been before. For example, this could be cause by sleeping walking or just simply moving around in their sleep. The author Joyce Carol Oates wrote a line stating, “The kitchen looked like a place she had never seen before, some room, she had run inside, but which wasn’t good enough wasn’t going to help her,” (202). With this being said, this is more of an indication that Connie was dreaming. It is shown in the story “Where Are You Going, Where Have You Been?”, Connie is not able to make out her own home and cannot tell where she is at. At the end of the story the author, Joyce Carol Oates, states, “So much land that Connie had never seen before and did not recognize except to know that she was going to it” even though the reader knows she is outside her house (210). Internet privacy and security has become the concern of many individuals throughout recent years. There are a very limited amount of laws that have been enacted to combat computer or cyber related crimes. This has become an issue because as the internet grows increasingly popular so does the criminal and immoral behavior that abounds on it. With these crimes gaining in impact, effectiveness, and frequency, there needs to be more repercussions for these crimes. The United States government needs to increase restrictions on the amount and type of data on individuals from the internet, to prevent the government from invading privacy of citizens and to prevent companies from storing browser histories of individuals, to then sell that information to ad agencies and other companies.

Cybercrime is a global issue plaguing the world. The dictionary defines cybercrime as “crime conducted via the Internet or some other computer network”(Merriam-Webster). The definition remains very broad because the word “cyber” is defined as “relating to the culture of computers, information technology, and virtual reality.” Due to the growing number of people gaining access to the internet, rapid development of technology, and the globalization of the world, more of the world population is becoming susceptible to involvement in cybercrime – whether it be as a victim or a criminal. Cybercrime involves different levels of the world on both the victim and criminal side from an individual citizen, to small groups, businesses, and the government, to the countries of the world. There are different groups from law enforcement agencies to the U.S. Secret Service, that are attempting to combat the problem through cooperation and preemptive efforts. If these groups combined with the public to protect themselves and the country from criminals that commit cybercrime, the nation’s network and technology servers would be much safer for technology users. Clearly, cybercrime is a problem because it puts internet users at risk of being taken advantage of or harmed.
