Institutional racism is when social institutions give negative treatment to people of a certain ethnicity, which in effect leads to inequalities. The UN (2015) states that only 15% of New Zealand’s population are Māori, and yet Māori make up over 50% of the prison population. The racism in the justice system means that people are being prosecuted based on the colour of their skin. With criminal behaviour connected with Māori, this leads to marginalisation, alienation and racism in other forms of society. I will discuss the state of Māori in New Zealand prisons, followed by what effect this has on the Māori community and also the implications this has on wider society.

The system in place is completely unsuitable and unhelpful for Native people and it shows just how indifferent Canada is to First Nations peoples’ well-being. Zimmerman explains in his article “Outcomes” that it is a well-known fact that Aboriginal people are overrepresented in the prison system (1992). There are so many reasons why this is so, and the majority of those reasons are because of the terrible way that Canada has interacted with them. They are isolated in their reserves, they are haunted by their residential school experiences, leading to alcoholism, domestic violence and neglect, and they face discrimination and a lack of social support from the government. Once an Aboriginal person finds themselves in the clutches of the prison system, the indifference begins. Canada’s criminal justice system is indifferent to an Aboriginal person’s cultural, spiritual, and individual needs that separate them from the average convicted person (Zimmerman, 1992). The criminal justice system ignores the unique idea of justice and restoration that First Nations peoples have, making it extremely irrelevant and unhelpful for them. First Nations peoples have linguistic and cultural barriers and a lack of counsel and understanding of the criminal processes and, therefore, have misguided rulings and inaccurate proceedings. The over-representation of black people in the UK prison population became an issue which needs to be addressed. The prison statistics shows that black people are over-represented and by analysing their population in the UK and a prison statistics it can be noticed that their number increases massively comparing to white and Asian people. The statistics focuses on adult male population, but by considering women and young black people, the evidences show that across all levels black people are over-represented. However, black people are not over-represented only in prison statistics, police practices shows that they are a main target for their actions such as stop and search under section 60 or when fighting in “war on drugs” even that their drug usage is lower than white people. Matthews (2009) and Sampson (1987) provide evidences that one of the reasons for over-representation is institutional racism within Criminal Justice system, police service as well as areas such as Council, education and housing. Newburn (2013) presents that there are specific crimes for which black people are more likely to commit as well as black people are less likely to plead guilty, including that often they leave in inner city cause that judges in those locations are more likely to give “heavier” sentences (Newburn 2013). The purpose of this paper is to examine why the justice system fails for First Nations persons and alternative rehabilitation methods used by Aboriginal people, comprised of Aboriginal people, for Aboriginal people, in hopes to rehabilitate offenders and prevent criminal behavior in the Aboriginal community from precontact to today. The gross over representation of indigenous people in the Australian criminal justice system (CJS) is so disturbingly evident that it is never the source of debate. Rather it is the starting point of discussions centring on the source and solutions to this prominent social, cultural and political issue. Discourse surrounds not only the economic and social disadvantage of indigenous communities, but also the systemic racism and continuing intergenerational trauma resulting for the unjust colonisation of a nation which has profited whites at the detriment to indigenous people throughout history. This essay intends to address the role that state agencies, both within the Criminal Justice System (CJS) and more broadly the institutions of education, employment and health, play in supporting and implementing diversionary programs for offenders with mental health problems. Mental health is clearly one of the most critical issues facing the Australian and New South Wales (NSW) CJS with research indicating that offenders with mental health problems constitute the majority of those within the prison system. The current strategies for diversion will be critically evaluated in order to determine their effectiveness with regard to the delivery and production of justice, cultural sensitivity for Indigenous Australians will also be considered. The social construction of mental illness and the associated process of stigmatisation of this particular group will be explored in conjunction to explain why society still fails to prevent the mass entry of people with mental health issues into the traditional CJS.

In the wake of President Obama’s election, the United States seems to be progressing towards a post-racial society. However, the rates of mass incarceration of black males in America deem this to be otherwise. Understanding mass incarceration as a modern racial caste system will reveal the role of the criminal justice system in creating and perpetuating racial hierarchy America. The history of social control in the United States dates back to the first racial caste systems: slavery and the Jim Crow Laws. Although these caste systems were outlawed by the 13th amendment and Civil Rights Act respectively, they are given new life and tailored to the needs of the time.In other words, racial caste in America has not ended but has merely been redesigned in the shape of mass incarceration. Once again, the fact that more than half of the young black men in many large American cities are under the control of the criminal justice system show evidence of a new racial caste system at work. The Criminal Justice System, a framework the British government set up to manage the treatment of culprits, has three principle objectives to accomplish social request, these are, (1) implementing criminal law, (2) keeping up peace in the general public, and (3) helping casualties. This may appear to be a well-considered framework, yet like some other association, there are blemishes, and one of the real imperfections is separation, and the predisposition that originates from segregation.
