INTRODUCTION:
The suspect used an unknown hand to hit the victim in the nose, which caused injury in violation of PC 243(a)-Battery.
LOCATION DESCRIPTION:
The incident occurred at the Pasadena Ice Skating Center located at 300 E. Green Avenue.
EVIDENCE:
• Photos taken of the victim by Officer Acosta #0044, which was later uploaded to VeriPic.
• Audio recording of the suspect’s statement, which was later uploaded to VeriPic.

Upon my arrival, I met with Victim Ouida Robins, who told us the following information in summary: History: On 07-17-15 during the morning, Robins was told by other employees at the Pasadena Ice Skating Center of an incident that occurred between Suspect Lyn Lofthouse and Elyce Lin-Gracey (8 year old female).
Lofthouse and Lin are members at the ice skating center. Lofthouse was reportedly upset that Gracey cut her off while ice skating. Lofthouse began yelling and using profanity at Gracey, NFD.
The Manager, Randy Winship was advised of the above incident. Robins is unaware of the investigation’s outcome.
On 04-20-16 at approximately 0907 hours, Robins was working at the skating center. Robins saw Lofthouse standing outside of the manager’s office. Robins looked inside of the manager’s office. Lofthouse reportedly told Robins the manager was not inside the office.
Robins then walked to the “Coaches Office” door. Robins used the keypad and entered the code to gain entry into the office. Robins walked into the office and noticed that Lofthouse was directly behind her. Lofthouse walked into the office behind Robins and closed the door behind her. Robins saw Witness Russell Sessions and Witness Vitoria Boa were inside the office. do.” Lofthouse told Robins she wanted to speak with her about an incident that occurred on 07-17-15 involving Elyce Lin-Gracey. Robins told Lofthouse she would speak with her about the incident outside of the coaches’ office. Lofthouse told Robins that she (Robins) was not going anywhere and would have to stay and listen. Robins sat down and began recording the incident with her IPhone. Robins held the phone with both hands just below her chin as she recorded the incident. Lofthouse began arguing with Robins about the incident that occurred on 07-17-15. Lofthouse accused Robins of not listening to both sides of the story. Lofthouse stated Elyce skated into her several times. Lofthouse then lunged toward Robins and attempted to slap the cellular telephone from Robins’ hands. Lofthouse began yelling that she did not want to be video tape and continued to blame Elyce of skating into her. Robins told Lofthouse she did not want to speak with her unless the Manager Randy Winship was present. Lofthouse attempted to take the cellular telephone once our of Robins hands. Lofthouse also tried slapping the phone from Robins’ hands. Robins then felt Lofthouse hit her once in the face with an unknown hand. Lofthouse was reportedly in the office for approximately five to ten minutes prior to leaving. Robins later noticed she sustained an approximate one inch cut across the right side of her nose. Robins immediately reported the incident to Manager Winship. Robins also showed Winship the video recordings of the incident. Winship spoke with Margie Christ about the incident (Director of Human Resources, 626-844-1429 and 626-793-2122). Robins was later advised by Winship if any other incidents occur between her (Robins) and Lofthouse both would “Be out of here”. Robins came into the police station to report the incident. Robins gave me Suspect Lofthouse, Witness Sessions and Witness Boa’s telephone numbers for their statements. Robins also showed me the video recording of the incident. I obtained a copy of the video recordings from Robins, which was later uploaded into VeriPic. Robins stated she is non-desirous of prosecution against Lofthouse at this time. Robins wanted the incident documented in a report. I later telephoned and spoke with Witness Russell Sessions who told me the following information in summary: Sessions was in the coach’s office with Witness Boa. Sessions saw Robins enter the office with Lofthouse directly behind her. Lofthouse stood in front of the door and began arguing with Robins about an incident that occurred last year which involved Elyce Lin-Gracey. Sessions heard Robins tell Lofthouse she would speak with her about the incident outside of the office. Lofthouse told Robins that she (Robins) was not going anywhere and would have to stay and listen. Sessions saw Robins sit down and began recording the incident with her IPhone. Sessions was not looking in the direction where the incident had occurred and therefore did not see whether Lofthouse had assaulted Robins. Sessions then saw Lofthouse leave the office without further incident.
Sessions said skaters on the ice usually bumped and cut off each another. Sessions said that Robins remained calm and professional during the entire incident with Lofthouse.
I telephoned and spoke with Witness Victoria Boa who told me the following information in summary: Boa was in the coach’s office with Witness Sessions. Boa saw Robins enter the office with Lofthouse directly behind her. Lofthouse stood in front of the door and began arguing with Robins about an incident that occurred last year which involved Elyce
Lin-Gracey. Boa heard Robins tell Lofthouse she would speak with her about the incident outside of the coaches’ office. Lofthouse told Robins that she (Robins) was not going anywhere and would have to stay and listen. Boa saw Robins sit down and began recording the incident with her IPhone. Robins held the phone with both hands just below her chin as she recorded the incident. Boa heard Lofthouse arguing with Robins about the incident which occurred in July of 2015. Robins used several students to cut her off during skating sessions as a form of the harassment. On 04-20-16 during a morning session, Robins once again used her student to cut off Lofthouse four times. Lofthouse attempted to report the incident to Manager Winship, but he was not in the office. Lofthouse decided to confront Robins about the incident. Lofthouse saw Robins walking into the Coaches Office and decided to speak with her. Lofthouse knocked on the door and Robins opened it. Robins reportedly invited Lofthouse inside of the office. Lofthouse turned to Sessions and Boa and told them, “Sorry about this.” Lofthouse told Robins she wanted to speak with her about an incident which occurred in July or August of 2015. The incident involved Elyce. Lofthouse believed Robins did not hear her side of the story. Lofthouse believed Elyce cut her off several times in July or August of 2015. Lofthouse had reported the incident to Manager Winship. Lofthouse believes Winship did not take the complaint seriously and was not properly resolved. Lofthouse saw Robins had begun to videotape the above conversation with her cellular telephone. Lofthouse told Robins to stop recording her. Lofthouse then walked toward Robins and attempted to push the cellular telephone down. Robins reportedly tucked the phone against the left side of her body which prevented Lofthouse from hitting it. Lofthouse said she did not touch Robins throughout the incident. Lofthouse left the office without further incident. Lofthouse did not give any further relevant information regarding the above incident. I audio recorded Lofthouse’s statement which was later uploaded into VeriPic. On 04-23-16 at approximately 1508 hours, I received an email from Robins. Robins stated she now wanted to press battery charges against Lofthouse in regards to the above incident. DISPOSITION: Case to Detectives.
On the above listed date and time, deputies arrived at Hampton County Medical Center, and made contact with the complainant regarding the above listed incident type. Deputies gathered the pertinent information needed to complete this report. The complainant and his mother wrote a voluntary statement. Photos were taken while at the Emergency Room. The complainant was issued a Victim’s Right’s Form along with a case number attached. Deputies attempted to make contact with the subject, no contact was made. Deputies cleared the call and resumed normal patrol duties.
This case involves the suspect being arrested for driving under the influence of alcoholic beverages in violation of CVC 23153(a)-DUI.
Victim Avina told me approximately five years, prior to getting married, Suspect Avina threw his dress shoe at her. The shoe hit Vicitm Avina is the stomach which did not cause any injuries. About two months ago, Suspect Avina attempted to push Victim Avina’s right shoulder. Victim Avina lend back and avoided the push but hit her right upper thigh against the living rooms coffee table. The impact later left a quarter size bruise. Victim Avina took a photograph of the bruise (see attached photo).
McOskar Enterprises, Inc. owns and manages a health and fitness center identified as “Curves for Women”. Tammey J. Anderson, the complainant, joined Curves on April 2, 2003. As part of the joining process Anderson signed a release of liability agreement. This agreement released Curves from any liabilities related to injuries that might be sustained by contributing in any activities or through the use of equipment. The agreement also stated that participants agreed to all risks of death or injury that could occur, Anderson read and signed the agreement of terms with Curves. After completing the liability agreement, Anderson began working out under the observation of a Curves’ trainer using the machines within the facility. During the workout Anderson notified the trainer that she began to feel pain in her neck, shoulder and arm, but finished her workout. She continued to feel the pain when she got home and pursued medical attention. As part of her prescribed medical treatment she was sent for a course a physical therapy. In June 2003 Anderson underwent a cervical discectomy, a procedure used to treat nerve or spinal cord compression. After her procedure Anderson sued Curves, claiming negligent acts during her workout. Anderson v. McOskar Enterprises, Inc., 712 NW 2d 796 (Minn. 2006).

Lisa stated this morning at the listed location; she set up a yard sale table, along with several other neighbors. During the set-up process, the accused, Marion Wagner, approached her advising her she was not able to set up the table. Lisa advised she was able to be here since it’s on the sidewalk and that she wouldn't be any more than a few hours here. Lisa stated that Marion approached her, got up in her face, and then struck her in with a closed fist. Lisa then fell to the ground and started to bleed from her nose. On 11/18/2016 at approximately 2231 hours, I was notified by Corporal L. Rivera #143648 of a traffic crash with injuries on Sligh Avenue East, east of 56th Street North, involving a Hillsborough County Sheriff's Office unmarked Dodge Charger patrol vehicle and a Honda Accord. Upon arrival, I observed the vehicles at final rest in the roadway with the Honda on its roof and the Dodge facing to the east in painted center median. The driver and passenger of the Honda were transported to Tampa General Hospital at the request of the driver for precautionary reasons. The driver and passenger of the Dodge were on scene and had no injuries. I observed the Honda at final rest in the westbound lane, facing in the east direction.
