The case of Wendy Maldonado is about her killing her own husband because he was abusive to her. In the video, of every fucking day of my life, Wendy talks about her relationship with her husband, Aaron. In the relationship, Aaron would yell at her, beat her, etc. She had four sons that grew up in this hostile environment. One night she decided to murder him with a hammer because she’s decided that she had enough. Her eldest son did not want her to do this alone and decided to help her. After they both murder him, they were sent to jail. In this case of Wendy Maldanado, there were many legal and ethical questions. Wendy had face many years of abuse from her husband. It was not just her that faced abuse like hitting and yelling but her four sons. In the case, Wendy was charged and sent to jail her many years because of her son murdering the husband. There are questions about the case such as was it right for her to murder her husband? Should Wendy be in jail longer? Should her son be in jail longer or shorter than her jail time? Wendy did face jail time but did not really receive justice for her abusive husband. Instead, she took matters into her own …show more content…
hands and killed him without getting proper justice. I think that Wendy Maldonado can face justice for her actions by going to jail for a short period of time.
After she's been in jail. she could take care of her four sons. It is a terrible result of what happened to the husband. I don’t think it was necessary for Wendy to kill her husband but I think it would have been better if he was put into jail for what he has put Wendy and her sons throughout their lives. I think that each person deserves to pay for their actions and get consequences like jail time. I think for Wendy that the jail time could be shorter because she did have sons to take care of and I think that her husband should of pay for his actions. I disagree that Wendy should have been put in jail for so long nor her son for so many years. I understand that they manslaughter but Wendy came up with the
idea. There are a lot of women that face domestic violence relationships and there are no consequences for the abuser. I understand there are programs for the victims and a place for them to be able to get help and move forward from this situation. For the victims that have been in a domestic violent relationship, there should be more study in the cases. I think there should be proof of what the victim has faced in the abusive relationship. For this case, Wendy was sent to court for hearing but the judge still sentenced her to jail for murder. However, I wonder why Wendy Maldonado decided to kill her own husband. Even though, she does state in the video that she does not know why too she killed her husband that certain night and after a certain time. I wonder if it was a psychological issue that played in this situation. I think that someone that is severely abused for so many years that their psychological state would be worn down. I think Wendy should have been tested to check if she was affected psychologically. There are people who have been very mentally abused and it affects them psychologically. I think there should be a law provided by the government that separates murder and murdering in domestic violence situation. There are some other cases like Wendy that the victim had to pay the consequences for their actions. On the other hand, shouldn’t there be how law for the people abuse their partner in the relationship? I don’t agree that it is right for anyone to abuse someone that they are in a relationship. It is unfair to those people, who have been in a domestic violent relationship not getting justice for it.
For the purpose of the paper, I will summarize the facts and leading events of the case of Elenita L and Romer N. Fajota. As reading through this trial I discovered that judges don’t always make the right decision for families or individuals. Likely in this case it is presentably true. Elenita and Romer got married in June 2005 and have three minor children together. As their marriage progressed, in the beginning of the year 2006, Romero became physically violent against Elenita. Romer committed various acts of violence against her and stated in court that it continued “even while pregnant with their second child”. But however, from 2006 to 2008 the violence continued against Elenita and her children. As the domestic violence continued, Elenita filed a
A horrific murder happened in tiny Skidmore on December of 2004. Lisa Montgomery and Bobbi Jo Stinnett met and found out that they had much in common and became good friends (Nunes 85-86). Surprisingly, Bobbi and Lisa met in an internet chat room. Bobbi was into puppy breeding and she occasionally served as a judge. Lisa lived in Kansas where her close friends were shocked about what she was talking about. Of course, Lisa shrugged it off and she sent an email to Bobbi saying that she wanted to see the puppies (Nunes 85-86). When Lisa met Bobbi Jo she had a fake name which was Darlene Fisher because she didn’t want Bobbi to know her real identity. When Lisa sent Bobbi the email she had a criminal intent on her mind. She was planning to choke Bobbi into unconsciousness and then cut open her womb and steal Bobbi’s unborn baby. When Lisa arrived at the house she threw a rope around Bobbi’s neck and choked her until she was unconscious. That is when Lisa took a knife and started to cut open Bobbi’s stomach. Lisa had to cut through skin, fat, and muscle to get to Bobbi’s uterus. Bobbi’s baby was in eight-month gestation; Lisa cut and tied the baby’s cord. Lisa stole the baby and fled to her house in Kansas. Unfort...
In July of 2008, one of the biggest crime cases devastated the United States nation-wide. The death of Caylee Anthony, a two year old baby, became the most popular topic in a brief amount of time. Caylee’s mother, Casey Anthony, became the main suspect after the child supposedly was kidnapped and went missing. To this day, the Casey Anthony case shocks me because justice, in my opinion, wasn’t served. I feel as if the criminal conviction system became somewhat corrupted in this case. The entire nation, including the court system, knew that Casey Anthony was behind this criminal act, but yet she escaped all charges. I chose this case not only because it’s debatable, but also to help state the obvious, this case was handled the wrong way. Clearly the legal system was biased, which worked in Casey Anthony’s favor, freeing a murderer.
Carlos Deluna was an American man who was convicted of first degree murder. Carlos was executed by the state of Texas for the killing of a 24 year old woman at the Shamrock gas station. The victim Wanda Lopez was stabbed multiple times apparently from a buck knife. Wanda Lopez was the attendant of the gas station and the police was senseless and oblivious to the tape at the gas station and only saw when she was giving the murderer the money yelling “You want it? I’ll give it to you. I’m not going to do nothing to you. Please!!!” There were only four eyewitnesses that was nearby when Wanda Lopez was murdered.
The Andrea Yates murder trial was one of the most highly publicized cases of 2001. Perplexing and complicated, it appealed to the public audience for various reasons. A mother methodically, drowns her five children in the family bathtub after her husband leaves for work. Was this an act of a cold calculating killer, or was this the act of a woman who lost touch with reality. Is this a case of medical neglect, and psychological dysfunctions, or is this a battle of ethics and deviant behavior exploiting medical and legal loop holes?
The mother of the child is portrayed as a normal woman with no mental health problem. This would lead the viewer to believe that the child’s tendency to murder developed in her short life span by her sense of entitlement and lack of punishment. She had no sense of consequences and we are led to believe she is like this due to her environment (which is partly the case).
The article is predominantly a court dialogue of the Bradley’s and any witnesses about the alleged abuse from Mr. Bradley against Mrs. Bradley. Providing pictures of strangulation marks, blackened eyes, and witnessed whom Mr. Bradley threatened and or harassed, Mr. Bradley found a rebuttal for each of the claims. The answers that Mrs. Bradley provided Judge for his questions showed how hard it was for her to leave her husband, how scared she and her family were. This article also provides information about voicemails Mr. Bradley left her parents threatening to kill their daughter if they didn’t send her back to his home. The article discusses in detail their treacherous relationship and Mrs. Bradley’s death. The article is from a periodical and was not peer reviewed, however the article is a dialogue from court with no personal opinion from the author. I believe this to be my strongest
The mother-son case illustrates that there are more factors in play than just the two that Thomson presents in her thesis. Thomson’s conditions by themselves cannot explain every situation. The relationship between the people involved can also affect whether a decision is morally permissible or not. If that relationship entails that one person is emotionally bound and ethically responsible for the security and well-being of the other, the first cannot knowingly contribute to the death of the second. Thomson’s thesis must be modified to include this condition as well.
On August 20th, 1989 Lyle and Erik Menendez killed their parents inside their Beverly Hills home with fifteen shot gun blasts after years of alleged “sexual, psychological, and corporal abuse” (Berns 25). According to the author of “Murder as Therapy”, “The defense has done a marvelous job of assisting the brothers in playing up their victim roles” (Goldman 1). Because there was so much evidence piled up against the brothers, the defense team was forced to play to the jurors’ emotions if they wanted a chance at an acquittal. Prosecutor Pamela Bozanich was forced to concede that “Jose and Kitty obviously had terrific flaws-most people do in the course of reminding jurors that the case was about murder, not child abuse” (Adler 103). Bozanich “cast the details of abuse as cool, calculated lies” (Smolowe 48)...
The eighth law that can cause a crime to be viewed as a capital crime is “the person murders an individual under six years of age.” (Pilgrim 06) Prolonged media attention reflecting cases on capital crimes committed by women, causes cases to have extreme bias, and causes the judge or jury to neglect the actual case. This is mirrored by the circumstances of the case involving the 2008 disappearance and murder of Caylee Anthony the suspected killer which was the child’s own mother, Casey Marie Anthony. Casey Anthony, the mother of then three-year old daughter Caylee Anthony, was believed to have murdered her daughter in order to avoid parental responsibilities. Although an overwhelming amount of evidence backing up claims and beliefs that Casey Anthony was in fact the perpetrator of the murder, including forensic data connecting decomposition remains of the child to Anthony’s car during the time of the child’s disappearance, and FBI attained data comprising of Google search terms including methods involved in the murder of Caylee from a comp...
This was, however, not the only factor to be looked after. What options they had does not dictate the morality of an act, it is only one part of a larger whole. Law is, in itself, morality, by nature of the fact that to defy law results in chaos. Originally the law was created to serve as a means of carrying out Justice, but the sheer nature of the fact that it has since, as in this case, acted in some way other than to uphold such a concept proves that it is a separate entity unto itself. Rather than considering the morality of a decision in the administering of Justice, it is now reasonable and required to consider the law as a factor in determining the morality of a decision. When the virtue of the decision is determined, then can Justice, and thus punishment, be considered. It is important to understand this concept: law is no longer a means of carry...
As German philosopher Friedrich Nietzsche quoted “It is impossible to suffer without making someone pay for it; every complaint already contains revenge.” The defendant Mary Barnett has been charged with the crime of second degree murder of the death of her six-month-old baby. In some sense, a mother who killed her own child ,out of personal relationships, is obviously guilty. However, based on current evidence, the verdict could be arguable. Barnett qualified some criteria of a second degree murderer such as intentionally leaving Alison alone to die in their apartment. Due to her mental state, Barnett was not aware she was leaving her children instead thought the child will taken care of whey she was at California. It comes to the reason that Mary
...t I do not think that the evidence presented is enough for a conviction to sentence any man or woman to death.
This crime took place at different time era, where domestic violence, wasn’t brought to the attention of the courts and the public. In article written by Find law, “Domestic violence became an increasingly popular issue in the 1970s and 1980s. As awareness for violence between intimate partners grew, so did criticism on the manner in which police were responding to the issue. Many believe that police don 't take domestic violence calls seriously because police intervention would be inappropriate in what some may deem a family matter
"In 1991, a young mother was rendered helpless and made to watch as her baby was executed. The mother was then mutilated and killed. The killer should not lie in some prison with three meals a day, clean sheets, cable TV, family visits and endless appeals. For justice to prevail, some killers just need to die." (Macy). This poor mother watched her child get killed in front of her eyes only to get murdered afterwards and never received the proper justice she deserved. The murderer who committed this heinous felony only got time in prison. Is it not fair that this man should have received the death penalty after committing such a brutal murder? He murdered this poor mother and child and received an unfair punishment. If he were to have received the death penalty if would have done some just to the family. There is absolutely no way for the mother and child to receive full proper justice, but if the convict had gotten the death penalty it would be a step in the right direction. If someone such as a family member or a person who you are close with was to be murdered, would it not be fair for the crook who murdered them to receive the death penalty? It is only moral for that delinquent to suffer the same fate as
