Henry David Thoreau’s Civil Disobedience took the original idea of transcendentalism and put it into action. His civil acts of defiance were revolutionary as he endorsed a form of protest that did not incorporate violence or fear. Thoreau’s initial actions involving the protest of many governmental issues, including slavery, landed him in jail as he refused to pay taxes or to run away. Ironically, more than one hundred years later, the same issue of equal rights was tearing the United States apart. Yet African Americans, like Martin Luther King Jr., followed in Thoreau’s footsteps by partaking in acts of civil disobedience. Sit-ins and peaceful rallies drew attention to the issue while keeping it from escalating into a much more violent problem. Thoreau’s ideas were becoming prevalent as they were used by Civil Rights Activists and the Supreme Court, in such cases as Brown v. Board of Education. The ideology that was created by Thoreau aided the activists and the government in their quest for equality and a more just system of law.
The main goal of the Civil Rights Movement was to instate equality under the law. King was a figurehead for the Civil Rights Movement. King’s ability to organize factions into a force that was unaffected by violence greatly contributed to the success of the Civil Rights Movement. In a letter he wrote from a Birmingham jail, King describes the four steps to non-violent protest. The first step is “collection of the facts to determine whether an injustice exists.”i This relates to Thoreau’s critique of an unjust government. Thoreau believed that every machine had friction, yet “when the friction comes to have its machine…let us not have such a machine any longer.”ii In the case of civil rights, the government has the friction of racial inequalities. That friction had several machines which enables whites to prevail over African Americans. King’s second step was negation. Thoreau lived during a time when negotiation was non-existent. He met the government “once a year--no more--in the person of its tax-gatherer; this is the only mode in which a man situated as I am necessarily meets it.”iii In the case of Thoreau and King, their struggle could not be resolved by simple negotiation. The third step, as King calls it, was self purification.
The idea of challenging an unreasonable law is central to both King, Jr.'s and Thoreau's plights, though each have very distinct characteristics unique to themselves. In King, Jr.'s case, he saw segregation and racial discrimination as mistakes on the part of the government and he set out to make substantial changes to the status quo. In doing so, he acted upon Thoreau's concept that every person retains the right to judge civil laws for decency and credibility. "One has not only a legal but a moral responsibility to obey just laws. Conversely, one has a moral responsibility to disobey unjust laws," (Birmingham Jail 82). Should one find the law to be in the best interest of each individual as well as society as a whole, he should abide by it and make every effort to live by its standard. But reversely, should the law be found guilty of evil intentions and causing more harm than good, it is the duty of every person under that law to disregard it and make an attempt "to wash his hands of it, and, if he gives it no thought longer, not to give it practically his support," (Disobedience 6).
Henry David Thoreau was a poet, social philosopher, and educator in the early to mid- 1800s (Hampton). He graduated from Harvard University in 1837 and, upon his return to his hometown of Concord, Massachusetts, befriended Ralph Waldo Emerson, also a philosopher and poet (Hampton, “Ralph Waldo Emerson”). Emerson was also the leader of the Transcendentalist movement which was based on the idea that people should lead by example -- social reform begins with the individual, not the government -- and that the movement should be peaceful (Woodlief, Ruehl). Thoreau agreed with this approach until the United States invaded Mexico in May, 1846 (Brown, Witherell). Opposed to slavery, Thoreau saw the invasion of Mexico as an attempt by the government to extend slavery westward. In his essay “On the Duty of Civil Disobedience,” published in 1849 with the original title, “Resistance to Civil Government,” Thoreau protests against the government and states that is a man’s duty to rise up against the government when the government commits a wrong (Thoreau). In his writings, Thoreau uses the three rhetorical approaches of Pathos, Ethos, and Logos in his attempts to persuade his readers to his point of view (Heinrichs).
King and Thoreau?s approach to civil disobedience is a more civilized way to protest than those at the WTO. King in his letter of response to the Birmingham clergy, ?Letter from Birmingham Jail? he list four basics steps to a non-violent campaign: collection of the facts to determine if injustice exist; negotiation; self-purification; and direct action (174). In his letter he points out that the individuals involved in the campaign attended a series of workshops on nonviolence. During the workshops individuals were to ask themselves if they were able to accept blows without retaliating and if they could endure the ordeal of jail (174). Thoreau?s approach is slightly different at an individual level but yet was nonviolent. He refused to pay his poll tax, which he felt was unjust. The result was he was arrested and jailed. He applied a type of civil disobedience without eliciting violence.

Most importantly, Thoreau and King argue in favor of civil disobedience not only to inspire a fight for freedom from the government, but also to ensure that the people’s God given rights and rights to individuality are preserved for generations.
In 1848, David Thoreau addressed and lectured civil disobedience to the Concord Lyceum in response to his jail time related to his protest of slavery and the Mexican War. In his lecture, Thoreau expresses in the beginning “That government is best which governs least,” which sets the topic for the rest of the lecture, and is arguably the overall theme of his speech. He chastises American institutions and policies, attempting to expand his views to others. In addition, he advances his views to his audience by way of urgency, analyzing the misdeeds of the government while stressing the time-critical importance of civil disobedience. Thoreau addresses civil disobedience to apprise the people of the need for a civil protest to the unjust laws created against the slaves and the Mexican-American war.
Thoreau wrote "Civil Disobedience" in 1849 after spending a night in the Walden town jail for refusing to pay a poll tax that supported the Mexican War. He recommended passive resistance as a form of tension that could lead to reform of unjust laws practiced by the government. He voiced civil disobedience as "An expression of the individual's liberty to create change" (Thoreau 530). Thoreau felt that the government had established order that resisted reform and change. "Action from principle, the perception and the performance of right, changes things and relations; it is essentially revolutionary" (Thoreau 531).
The author, Dr. Martian Luther King Jr., makes a statement “Nonviolent direct action seeks to create such a crisis and foster such a tension that a community which has constantly refused to negotiate is forced to confront the issue.” He uses this concept to convey the point of the Negros hard work to negotiate the issue has failed, but now they must confront it. The March on Good Friday, 1963, 53 blacks, led by Reverend Martian Luther King, Jr., was his first physical protest to segregation laws that had taken place after several efforts to simply negotiate. The author uses several phrases that describe his nonviolent efforts and his devotion to the issue of segregation that makes the reader believe his how seriously King takes this issue. “Conversely, one has the moral responsibility to disobey unjust laws.” Dr. Martian Luther King, Jr. explains with this that an “unjust law is no law at all.” King does not feel like he has broken any laws in his protest against segregation. In his eyes, laws are made to protect the people, not degrade and punish. “The Negro has many pent up resentments and latent frustrations, and he must release them. Justice is often misconceived as injustice, and thus some essential matters that require more legal attentions than the others are neglected; ergo, some individuals aim to change that. The principles of civil disobedience, which are advocated in both “Civil Disobedience” by Henry David Thoreau and “Letter from Birmingham Jail” by Martin Luther King Jr. to the society, is present up to this time in the U.S. for that purpose.
The ideas of King are very similar to the ideas of Thoreau. Moreover, the “Letter from Birmingham Jail” shows that King, read the writings of many famous people. From these two reasons, King had probably read “Civil Disobedience” as an important document regarding justice and injustice. Therefore, the positions of the two writers are very close, and they cite conscience as a guide to obeying just laws.

He believed in individual conscience and nonviolent acts of political resistance to protest unfair laws. Moreover, he valued the importance of observing nature, being individual, and living in a simple life by his own values. His writings later influenced the thoughts of Mahatma Gandhi and Martin Luther King, Jr. In “Civil Disobedience” and Walden, he advocated individual nonviolent resistance to the unjust state and reflected his simple living in the nature.

While Emerson and Thoreau certainly have difference of opinions, they recognize the need for public discussion and discourse. Emerson declares “a foolish consistency” to be “the hobgoblin of little minds” (Emerson 367). This is shown in their essays “Self-Reliance” and “Civil Disobedience” in which they support individuality and personal expression. Despite their contrasting views of society and government, the two most prominent transcendentalists in literary history share a passionate belief in the necessity that every American must exercise their constitutional rights and make known their views even and especially if it challenges the status quo.
Comparing the Civil Disobedience of Martin Luther King Jr., Henry David Thoreau, and Mohandas Gandhi
Henry David Thoreau (1817-1862) was a philosopher and writer who is well known for his criticism of the American government during the time. During Thoreau’s life, there were two major issues being debated in the United States: slavery and the Mexican-American War. Both issues greatly influenced his essay, as he actually practiced civil disobedience in his own life by refusing to pay taxes in protest of the Mexican War. He states that the government should be based on conscience and that citizens should refuse to follow the law and have the duty not to participate and stay as a member of an unjust institution like the government. I argue that the notion of individualism and skepticism toward government is essential to the basis of many important reform movements in the modern society.
