Battery is harmful contact, or the imminent threat of harmful or offensive contact, of one person against another, and the direct or indirect results of the affected person from this harmful or offensive contact. The defendant, Grem, arrived at Logan’s around 12:30am. Grem was intoxicated while at Logan’s. The plaintiff, Agnes, arrived at Logan’s around 12:15am to 12:30am and awaited the arrival of his girlfriend, Scelza, who arrived at 1:00am. Upon her arrival, Grem made a profane and defamatory statement about Scelza, followed with laughter at her. Agnes asked Grem to apologize to Scelza but Grem did not apologize. Shortly after, Agnes decided to leave Logan’s with Scelza to avoid a confrontation with Grem, because he felt that Grem was highly
In her respective judgement, McLachlin J states in the case report that ‘The traditional rule, as noted, is that the plaintiff in an action for trespass to the person (which includes battery) succeeds if she can prove direct interference with her person.’
suddenly jumps in front of her and drags her into an alley. The attacker strikes (A) and rips her clothes. Fortunately, (A) hits the attacker with a rock and runs to safety. The man’s actions do not amount to assault, they amount to a battery as he dragged the woman to an alley, stroke her, and ripped her clothes off with the intent of causing her harm. The acts of the woman are a measure of self-defense, and she cannot be held accountable for the infliction she may have induced to the man. If the man just followed her without having any physical contact with her, his actions would have constituted to assault, as he would inflict fear into the
Pursuant to trespass torts, battery is the intentional and direct physical contact or interference with another person without their consent. In this case, the onus lies on Ann to prove on the balance of probabilities that Nancy’s direct act caused physical contact. Nancy’s action of grabbing Ann’s arm and pulling her to her feet satisfies the elements of battery. It is evident that
From the readings assigned this past week. The main point that can be taken from them is the history of how colleges and universities have tried to censor hate speech. The court’s ruling most of these policies unconstitutional. The courts for the most part said that most of the policies were vague. My question is what is too vague for a policy dealing with hate speech? The authors try to explain it in the book, but I feel they did not give a complete answer or completely avoided to give a solid answer.
for it to be construed as offensive. I would hope that a person in this
The article "The Pros And Cons of Political Correctness" found in The Onion is found to be incredibly satirical. With its use of both trivializing and exaggerating the concept of being "politically correct". The term political correctness they use is usually defined by the layman of avoiding words that are deemed "offensive" and regressive. This obviously develops a strong sense of controversy between those with the progressive mindset and that of the conservative or liberal.
Godwin’s Law is “The theory that as an online discussion progresses, it becomes inevitable that someone or something will eventually be compared to Adolf Hitler or the Nazis, regardless of the original topic.” (Oxford Dictionaries) This law has seem too have held true in regards to the ever going online debate over PC gaming verses console gaming. An online video game critic in 2011 made fun of PC gaming elitist by referring to them as “the glorious PC gaming master race” (Escapist. THE WITCHER (Zero Punctuation).) However, many PC gamers have taken the insult as a badge of honor. Tyler Wilde has written "Let’s Stop Calling Ourselves the “PC Master Race” in 2015, published on the PC GAMER magazine
In a society where people of color make racial slurs and hurt each other mentally and physically, do you actually think that we can live together as “One Human Race”? Many people have different thoughts and have their own opinions on Religion, Political Beliefs, and if races should come together as one. Not saying that the nation coming together is impossible but many people were born and taught to view color in a certain way. Some people are just taught or told to discriminate against people and be rude saying racial slurs that may be offensive towards that individual. You never know what someone is going through so you should never talk about them in a way you wouldn't want to be talked to. Younger children watch and hear the tv shows, even
In recent history, the concept of being politically correct, in other words, trying to use non-offensive terminology or not discuss sensitive subjects, has become a heavily contested issue. Although attempting to use non-offensive, or non-triggering language started off with small modifications to our speech, some now feel that it has become a hindrance to everyday conversation. Furthermore, even some politicians, such as Donald Trump, have began to ditch the concept of being politically correct and instead, attempted to showcase how it has become a disruption to concise and honest banter. Thus, although attempting to use language that could not be thought of as offensive or triggering can be helpful and righteous, it has become so pervasive
The issue of political correctness has always been a source of controversy, but it has came to the forefront in the past few years because of the increase of liberalism, people wanting ultimate equality especially in the words we speak. Political correctness is a highly debated argument because the two sides arguing have such different views. The ones against political correctness say it is a violation of their right to free speech, while the ones for it say it is absolutely necessary to regulate some of your language in order to not offend someone. Both sides of the argument do make very valid points and that is why this topic is so heavily argued. It is a grey area the matter is not black and white neither side is really right or wrong. But
I am not saying that I agree with Donald Trump in any way. However, I do feel as though he is causing a real uproar in the political world. I think his boldness is a step in the direction that we need. People are so worried about being politically correct today that it is causing issues within the military, government, and even society. Author Theodore Schleifer quoted presideintial candidate Ted Cruz as saying "We have had enough with political correctness -- especially in the military," Cruz said to loud applause in the town building. "Political correctness is dangerous, and the idea that we would draft our daughters, to forcibly bring them into the military and put them in close contact -- I think is wrong, it is immoral, and if I am president,
Profane language describes a vulgar behavior that is intensely offensive because it shows lack of respect. Profanity mainly arises in tv shows, movies, and books. It is a shocking that even books use profanity because books are usually suppose to be educational that teaches good behavior. However, a majority of people believe the use of profanity in books is acceptable. When these type of books are exposed to high school students, many parents complain about it their children learning profane language through books. Parents complain about these books teaching their child amateurish words because they do not want their children to learn these words and get influenced by these devastating words. These words promote negativity within students
In this “English as a Second Language” class, students will be learning how to communicate and understand conversations for interactions in normal life in the English language. To be able to understand informal conversations students will need to know some of the slurs and swear words in the English language. Students will also need to understand the context which they are used in, whether a word is being used in a joking manner, an insult, or as a word to add emotion to what is being said. This is why we will be taking two class periods to talk about swearing in English. We will not be teaching how to swear in English, but informing students about swearing in the English language, because there is a big difference.
I deserve an A in American Literature because of my improved command of facts, better speaking and listening skills, and because of my works consistent improval throughout the semester.
“What is freedom of expression? Without the freedom to offend, it ceases to exist” Salman Rushdie. The quote perfectly sums up the never-ending debate about freedom of speech and hate speech. It is a well-known fact that freedom of speech and expression belongs to the group of fundamental human rights of every person on this planet. can tolerate and respect each other’s opinions, then there is no need to restrict freedom of speech. As humans, naturally, we always have different perceptions and opinions that instigate the choices we make in life. The only sane way we can uphold freedom of speech is by being tolerant and respectful of each other’s opinions and views.
