SYNOPSIS: On 06/18/2018, at approximately 1919 hours, Inmate Green, Courtne BN 18130181 was assaulted in House 4B, Cell 218 at the George Bailey Detention Facility (GBDF). Green sustained scratches to the left side forehead, a small laceration to the back of his head, Scratches to left ear area, scratches to right ear area, and scratches to the chest. Green refused medical care and signed a Medical Refusal Form. Green gave vague statements and stated that he was afraid because he has already been stabbed out in the streets for cooperating with a prior investigation at San Diego Central Jail (CJ). Green refused to further cooperate. A Suspect/Witness check was conducted, which did not yield any suspects. CTTV video footage was inconclusive …show more content…

Green informed me that he needed to "roll out" of the module. I noticed scratches to Green's forehead and head area. BACKGROUND: 5/14/2018 Green was arrested by the San Diego Police Department for 273.6(A) VIO ORD PREVENT DOMESTIC VIOLENCE.
148.9(A) PC FALSE ID to PO'S. 166(C)(1) PC CONTEMP VIOL PROTECT ORD. Green is currently scheduled to be released on 7/28/2018. INVESTIGATION: At approximately 2211 hours, Corporal Myers #3204 and I escorted Green out of House 4B and interviewed him in the House 4 Recreation. STATEMENT OF VICTIM (Green): Green stated that he needed to leave the module because was assaulted inside cell 218 around 1900 hours. Green stated that he did not know who assaulted him. Green stated that he went inside cell 218 because he was asked to go there by unknown inmates. Green stated that he used to be a Crip gang member, but that he is no longer an active member. Corporal Myers asked Green if he knew who had assaulted him and Green stated that he had nothing to say. Green stated that he simply wanted to do his time and go home next month. Green stated that he was stabbed on the streets due to him previously cooperating with Deputies while at CJ. Green kept saying that a Corporal Sims from CJ knew about the incident. CONTINUE I asked Green if he needed any medical treatment and Green stated that he did not need any medical care. Green signed a Medical Refusal Form. At approximately 2240 hours, a Suspect/witness check was conducted by several Deputies, which did not yield any suspects. Inmate Jones, Lavale BN 18128845 and Inmate Hunter, Gregory 18111119 were assigned to Cell 218. Inmate Jones and Inmate Hunter were escorted the GBDF Processing for further questioning. On 6/19/2018, at approximately 0115 hours, I reviewed CCTV video evidence from House 4B. I was not able to see any conclusive evidence due to the quality and location of the CCTV cameras during the time of the assault. On 6/19/2018, at approximately 0130 hours, Inmate Jones was interviewed inside a GBDF Processing cell. I asked Jones if he knew about what had happened inside his cell and he said he did not anything. Jones stated that he was simply eating a snack when he was pulled out of his cell. Jones stated that he did not know anything about the alleged assault. At approximately 0135 hours, Inmate Hunter was interviewed inside a GBDF Processing cell. I asked Hunter if he knew anything about somebody getting assaulted. Hunter stated that he is too old to be getting into trouble and that he was the peacekeeper in the module. Hunter stated that he didn't know anything else. Hunter stated that he knew nothing about the alleged assault. Jones and Hunter were returned to House 4B, Cell 218.
On 6/19/2018, at approximately 0200 hours, I informed Green that I was going to transfer him to a different Housing Unit. Green stated that he did not feel safe anywhere in GBDF and stated that he wanted ADSEG (Administrative Segregated) housing. I informed Green that he only had two documented Keep Separate (K/S) indicators on his record and that I was not going to house him with those inmates. Green stated that there were several inmates at GBDF that were trying to assault him and that he was going to refuse housing anywhere in GBDF. ON 6/19/2018, at approximately 0330 hours, Sergeant Lizarraga #8400 interviewed Green inside the House 4 Medical Holding area. Green informed Sergeant Lizarraga that he was not going to house anywhere. Sergeant Lizarraga asked Green for names of the inmates who he has issues with and Green refused to cooperate. A K/S Information Status Report was written to keep Green separated from Jones and Hunter. On 6/19/2018, at approximately 0400 hours, Green was moved to GBDF House 6A, Cell 111, which is a Lockdown cell for refusing to
house. Nine digital photographs, CCTV video footage, and a copy of the Medical Refusal Form were transferred to a compact disc, sealed in a Kapak bag, labeled with my initials, arjis, date and secured in GBDF evidence locker #_ under control #_________. Gary Dougherty was paroled from Northeast Correctional Complex on 11/15/2017. Mr. Dougherty has a Tennessee Sentence of Attempted First Degree Murder and is currently under minimum supervision level. Mr. Dougherty was paroled to Steps Halfway House. On 04/16/18, Case Manager Ron Stephens advised me that Mr. Dougherty was discharged from Steps for several rule violations. Mr. Stephens advised that since Mr. Dougherty had been at Steps he has failed three drug screens, offered drugs to another resident, ask residents for clean urine, brought a prostitute in the house, and threatened a resident.
I asked Inmate Dennis if anything happened in the hallway on the way to intake and he stated, “No. They just kept pulling me. I was walking but they kept trying to make me look cracked out and that I was fighting. I don’t know why they were doing that. And then they threw me in the cell.” I asked Inmate Dennis if he said anything to the detention officers as they were walking down the hall and he said, “The only thing I asked was ‘why the fuck you grab me for?’”

Harold Whitley, a corrections officer at the Oregon State Penitentiary, shot and wounded inmate Gerald Albers in the knee during a disturbance in 1983. This brought into question several factors, including whether there was a need for force, the relationship between the need and amount of force used, the extent of injury inflicted, threat of safety to other inmates, and effort to avoid a violent response. The Supreme Court ruled in favor of the prison, concluding that guards reacting to a prison disturbance must act maliciously and sadistically with intent to cause harm to qualify as cruel and unusual punishment.

Charles is a 21 year-old Caucasian single male currently residing with his mother and stepfather whom also is Charles’s uncle. Charles graduated high school and due to his illness he receives social security benefits. During a two year period Charles had nine visits to the emergency room resulting in admission to the psychiatric unit. On two admissions Charles left against medical advice, five admissions required a higher level of care resulting in admission to the state psychiatric hospital and two Charles was transferred to the adult crisis unit. Charles also has a misdemeanor history mainly public nuisance due to substance abuse mainly marijuana and cocaine. Charles was evicted after a psychotic episode and destroying his apartment.

Roger has a past history of involving involuntary commitment on mental health issues. He told the jail staff that he commits crime to get sent to jail for a warm place to sleep, for a meal, and to get his meds. He is homeless and has no medical insurance or regular health care provider. Roger occasionally gets into fights with other jail inmates, has threatened suicide, and yells at the custody staff. On January 18, 2017 a brutal attack took place in Rikers Island between an inmate and several others. Ernesto Jones, the 34-year-old victim was attacked while he sat in the library with other seven inmates. A man who appeared to be across from Jones instantly attacks him slashing him in the face while another
