As an American we are all born in this country with many rights, including the right to be free spoken. Although, within these rights there are choices being made that cause the limitation for some of these rights. Who gets to choose whether they should be taken away or not? The Freedom of Speech clause falls under the First Amendment and is one of the most cherished rights us Americans can uphold. It has also caused many limitations because of the choices people make under this right. These limitations; or some may even call them restrictions, should not be valid. Although, the legal definition states that speech can be expressed with no unwarranted government restriction.1 Meaning no matter what circumstance anyone should be able to …show more content…
Many great ideas are formed from the collaboration of spoken opinion. Just as there is good, there is always bad. Although, freedom of speech has caused collaborations of injustice thoughts and ideas, the act of freedom of speech and opinion can be the determining factor of right and wrong. For example, the KKK; this organization has caused a lot of harm to our society, although in gatherings that involve a speaker to express their opinions for their organization, this is legal because it falls under political choice. 2 With the opinion of right and wrong, restrictions are being made to determine what can and cant be said. These restrictions are creating a platform of dictation and taking away your freedom of choice. When you take away someone's right of freedom of speech who is "bad", you must take away the same right from all. Our society is built off of unity, not unfair and unlawful justice. So what about the people who have thoughts of greatness to improve our society? They should be given the right to speak their opinion and not be limited because someone thinks its wrong. As a person who falls under this right, you should be able to choose what you want to say, when you want to say it , and how you want to voice your opinion with no …show more content…
We cannot prevent or stop others who obtain there right of free speech. However we can make the choice on how we handle and approach these certain circumstances. Words that cause immediate danger are different than forming and speaking on an opinion. An opinion that is negative or positive is protected under the First Amendment and should stay this way when it comes to Freedom of Speech. This comes with the help of keeping the government accountable. Being open and mindful of other's spoken opinions can help create a greater foundation for Freedom of Speech, instead of striiping people of their rights as
Freedom of speech has been a controversial issue throughout the world. Our ability to say whatever we want is very important to us as individuals and communities. Although freedom of speech and expression may sometimes be offensive to other people, it is still everyone’s right to express his/her opinion under the American constitution which states that “congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or the press”. Although this amendment gave people the right express thier opinions, it still rests in one’s own hands as how far they will go to exercise that right of freedom of speech.
1. The measure of a great society is the ability of its citizens to tolerate the viewpoints of those with whom they disagree. As Voltaire once said, “I may disagree with what you have to say, but I will defend to the death your right to say it” (Columbia). This right to express one's opinion can be characterized as “freedom of speech.” The concept of “freedom of speech” is a Constitutional right in the United States, guaranteed under the First Amendment to the Constitution:
If limitations are placed on some things, but not others, then it will lead to a great deal of conflict. Freedom of expression is a great thing, however it does come along with a few negative side effects. This including, hateful, ignorant, and rude individuals who do not care what they say. Some want to be able to control these hateful people and restrict what they are permitted to do or say. But, where is the gray line?
Being expression one of the most important rights of the people to maintain a connected society right to speech should be accepted to do so. The first amendment is one of the most fundamental rights that individuals have. It is fundamental to the existence of democracy and the respect of human dignity. This amendment describes the principal rights of the citizens of the United States. If the citizens were unable to criticize the government, it would be impossible to regulate order. By looking freedom of speech there is also freedom of assembly and freedom of press that are crucial for the United States democracy.
Imagine a time when one could be fined, imprisoned and even killed for simply speaking one’s mind. Speech is the basic vehicle for communication of beliefs, thoughts and ideas. Without the right to speak one’s mind freely one would be forced to agree with everything society stated. With freedom of speech one’s own ideas can be expressed freely and the follower’s belief will be stronger. The words sound so simple, but without them the world would be a very different place.
Freedom of speech is the right of civilians to openly express their opinions without constant interference by the government. For the last few years, the limitations and regulations on freedom of speech have constantly increased. This right is limited by use of expression to provoke violence or illegal activities, libel and slander, obscene material, and proper setting. These limitations may appear to be justified, however who decides what is obscene and inappropriate or when it is the wrong time or place? To have so many limits and regulations on freedom of speech is somewhat unnecessary. It is understood that some things are not meant to be said in public due to terrorist attacks and other violent acts against our government, but everything should not be seen as a threat. Some people prefer to express themselves angrily or profanely, and as long as it causes no har...
Since this country was founded, we have had a set of unalienable rights that our constitution guarantees us to as Americans. One of the most important rights that is mentioned in our constitution is the right to free speech. “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the
When the individual gets attacked verbally because of their controversial statements, they claim that they had the right to speak their mind no matter how disturbing their words were. They use the First Amendment as a cover for their wrong-doings, and that is never okay. They need to be educated on what they can and cannot say. Just because the First Amendment guarantees a person the freedom of speech, does not mean that they are entitled to say whatever they please. The article “Freedom of Speech” explains if an individual were to use “fighting words” then they are automatically not covered under their First Amendment. The Supreme Court decided in the case Chaplinsky v. New Hampshire that “fighting words” were not constitutional, so they would not be protected under the First Amendment (2). Many people misunderstand that much of their opinions that they speak consists of words that are unclear. More than half of the time the words they use in their statements are considered to be fighting words, for they are rude and ignorant. There is no need for the obscene words that they use to be protected under the First Amendment. They must become aware of their lack of knowledge for what “fighting words” are; furthermore, they
Based on the First Amendment, the government may not exercise any activities that interference freedom of speech of an individual. For Americans, freedom of speech is clearly become the most basic freedom. Everyone has always thinks freedom of speech is a basic right that everyone automatically has when they were born; on the other hand, freedom of speech is experiencing serious growing pains.
In the United States, free speech is protected by the First Amendment in which it states, “Congress shall make no laws respecting an establishment of religion … or abridging the freedom of speech.” Now, nearly 250 years into the future, the exact thing that the Founding Fathers were afraid of is starting to happen. Today, our freedom of speech is being threatened through different forces, such as the tyranny of the majority, the protection of the minority, and the stability of the society. Now, colleges and universities in the United States today are also trying to institute a code upon its students that would bar them from exercising their right to speak freely in the name of protecting minorities from getting bullied. This brings us into
The 1st amendment was put into play of the Bills of Rights in December 1791. It was placed to protect the freedoms of religion, speech, petition, and press. The freedom of speech is one of the protection clauses that people really enjoy the most. Although there are some certain limitations to the freedom of speech so some things do not carried away. The 1st amendment protects speech in so many ways that allow the people to speak up and voice their opinions or thoughts in ways that many would have thought was illegal or against the law. It allowed people to voice their opinions by in some circumstances by not speaking at all, use offensive words and phrases in political messages, and overall allow individuals to express themselves without the
Some people do not go by the First Amendment though. They think there should be limitations to what others say because words can hurt someone, be insulting, and misunderstood. I understand that people should not say words that can be disrespectful to others, but with the first amendment they have the right to speak freely. I understand that there should be a limit to what can be said over the internet and what people say in general but they cannot stop the thoughts of other people. People should be respectful and considerate about what they are saying and respect others and what they too have to say otherwise we would have no freedom of speech. In my opinion one of our most important rights.
The Bill of Rights has gained existence since December 15, 1791. Being supported mainly by anti-federalists, the Bill of Rights upheld what was needed to protect individual liberty. From the ratification we have our first ten amendments. The most important and used today is the first amendment. The amendment states “Congress shall make no law respecting… petition the government for a redress of grievances.” This amendment is very powerful but cannot be overly abused. Over time the freedom of speech has been constricted. There are many court cases that display the limitation of free speech. Environmental factors and certain materials are not covered in free speech. To understand our rights and know how and when our rights are limited, we must
Freedom of speech has many positive things, one of which is the help it gives on decision-making. Thanks to freedom of speech it is possible to express personal ideas without fear or restraints; therefore, all the perspectives and options will be on the table, giving people more opportunities to choose from. Nevertheless, everything in life has a limit, and the limit of freedom of speech depends directly on the consideration of the rights of others. People is free of believing what they want, thinking what they want, and even saying what they want, everything as long as they do not intrude or violate anyone else's rights. Under certain circumstances freedom of speech should be limited, and this is more than just a political action, this acts represent the urge for tolerance and the need for respect.
Freedom of speech has been the core principle we have fought long and hard for centuries to achieve. It is the fundamental reason why the founders seperated from England and started their own colonies on the idea of becoming free. In recent times the idea of freedom of speech has been put into question as there has been incidents for years of racism, religious differences and discriminatory abuse. What comes into question is what exactly is your freedom of speech rights and what should be and should not be said in the public eye. The problems that we see arising in today’s society is discrimination and abuse against one another for opposing views and what exactly should your freedom of speech rights entail to as many hate crimes have occurred
