First degree murder is intentional and premeditated. It means that the crime was committed after planning or lying in wait for the victim. It is also considered first degree murder if a person dies due to a violent felony. The punishment for first degree murder is death. Although there are other crimes, first degree murder is the most common offense that will get someone on death row. The death penalty has been a source of controversy for many years. Clearly, the death penalty is cruel, costly, and inhumane. Murderers could be on death row for a long period of time, never knowing when their life will come to an end. A death should not be answered with another death. Bryan Stevenson (2014) says, “each of us is more than the worst thing we’ve ever done.” Some people argue that for people who commit the most heinous crimes, death is the only punishment suitable. They believe that this punishment causes people to think twice before committing murder; therefore, these crimes happen less. Taking the death penalty away would give criminals more courage because they would know that they will not be put to death for their actions. They also believe, that although a number of innocent lives have been taken because of this, that number is very minimal compared to the amount of guilty people who have been executed. …show more content…
This money could ultimately go toward education or creating jobs. All of these costs could help better peoples lives by giving them a better education or job. If people were to have more stable lives they could be less inclined to commit a crime. With more to lose, people might think twice about committing a crime. The death penalty does nothing to deter other criminals from committing murder, so the extra money could be better used to help prevent crimes. “The FBI has found the states with the death penalty have the highest murder rates” (“The Case Against the Death
Many people are led to believe that the death penalty doesn’t occur very often and that very few people are actually killed, but in reality, it’s quite the opposite. According to the Bureau of Justice Statistics, 1,359 people have been executed as a result of being on death row since 1977 to 2013. Even though this form of punishment is extremely controversial, due to the fact that someone’s life is at stake, it somehow still stands to this very day as our ultimate form of punishment. Although capital punishment puts murderers to death, it should be abolished because killing someone who murdered another, does not and will not make the situation any better in addition to costing tax payers millions of dollars.
1st degree murder is murder with malice aforethought. Malice aforethought is a murder that was planned out. 1st degree is also murder with the intent to kill and it is
The death penalty has always been a subject of controversy. Some say that it is a barbaric practice that should be done away with while others claim it to be necessary to ensure the safety of modern society. Either way, capital punishment has always remained a grey area in the
Murder, a common occurrence in American society, is thought of as a horrible, reprehensible atrocity. Why then, is it thought of differently when the state government arranges and executes a human being, the very definition of premeditated murder? Capital punishment has been reviewed and studied for many years, exposing several inequities and weaknesses, showing the need for the death penalty to be abolished.
Once the murderer gets caught, there are only three options for them. The three possibilities include incarceration, being institutionalized, or the death penalty. Being institutionalized means that the perpetrator claimed to be insane and would be put in rehab. Eventually they would get out and have the opportunity to kill again. If the killer was incarcerated, there would be a chance of them getting out on parole, which could have the same result as institutionalization. The best way to punish a killer is
When someone is being sentenced for first-degree murder are always punished by at least "life in prison," often "life without the possibility of parole," and in some jurisdictions by death by electric chair or lethal injection.
To be found guilty of first degree murder, it must be proven that killed someone with malice aforethought, meaning it was planned, premeditated. First degree murder is to kill malevolence, to kill either intentionally and deliberately or recklessly with the utmost disregard for human life. Premeditation may be fashioned immediately and does not require a lengthy period of contemplation. The death penalty is recognized in Thirty-eight states. Capital first-degree murder or aggravated first-degree murder is categorized in killings viewed as deserving of capital punishment. Life imprisonment or death penalty is the punishment resulted in a conviction. States who do not recognized the death penalty, aggravated murder carries life imprisonment. When aggravated or capital murder is committed in a heinous or monstrous fashion, it is considered homicide (Lippman, 2006).
The death penalty, ever since it was established, has created a huge controversy all throughout the world. Ever since the death penalty was created, there have been people who supported the death penalty and those who wanted to destroy it. When the death penalty was first created the methods that were used were gruesome and painful, it goes against the Eighth Amendment that was put in place many years later. The methods they used were focused on torturing the people and putting them through as much pain as possible. In today’s society the death penalty is quick and painless, it follows the Eighth Amendment. Still there are many people who are against capital punishment. The line of whether to kill a man or women for murder or to let him or her spend the rest one’s life in prison forever will never be drawn in a staight.
...ding, deterring crime, and saving tax dollars. The death penalty also ensures equal justice in America and ensures justice to those deceased in homicides. In the future, such issues can be resolved by keeping the death penalty: overcrowding in prisons will be less likely to happen, more criminals would be apprehended because of the plea bargain and crime rates will go down. This changed America by locking up more criminals in prison in these past two millenniums alone then altogether in America before while deterring crime due to convicts facing the chance of execution and being placed on death row. The death penalty also ensures the innocent who have suffered as a victim in a homicide have received their justice. With this being said, the death penalty works as a solution to the overcrowded prisons and overwhelming crime rates in the United States.
According to Death Penalty Facts and Statistics, in 2012, 63% of people were in favor of the death penalty, 32% were not in favor, and 6% do not have a preference. I find this statistic to be very surprising because I did not know that many people still believed in giving out the death penalty sentence. On estimate, 16,000 murders take place each year in the United States, 13,000 arrests, 8,000 convictions and fewer than 120 get death sentences (Guernsey). A positive about death penalty is that it will for sure end the crime recurrence risk since the offender is not alive anymore (Death Penalty Facts). This quite horrible to think of it that way, but it is the truth, if they are given the death penalty then they will never be able to re-offend. As of 2012, thirty-two states in the United States still use the death penalty (Death Penalty Facts). If an inmate believes that they are innocent then they are legally allowed to appeal the courts decision allowing a higher court to review the case. Not all cases get overturned, but some do which helps from executing innocent people.
On the other side of the debate, there are those that believe that the death penalty is a deterrent. For most criminals, they are aware of the fact that if they get caught, they will be sent to prison. However, other than being sent to prison, there are not really any other repercussions for committing a crime. They argue that if a person were to be presented with the possibility of the death penalty, they would more than likely think twice about their actions and realize that there are more risks than just im...
The death penalty has been an issue of debate for several years. Whether or not we should murder murderer’s and basically commit the same crime that they are being killed for committing. People against the death penalty say that we should not use it for that very reason. They also make claims that innocent people who were wrongly convicted could be killed. Other claims include it not working as a deterrent, it being morally wrong, and that it discriminates.
Allowing the criminal to spend their lives and personal give them the chance to ask the family of the victim, and even their God for forgiveness. Humans are humans, no matter what violent crime they committed, and they deserve a chance to be Reconciled. Capital punishment will only lead to more death and suffering. Statistics have shown that allowing the death penalty it may actually increased violence. Ten out of the twelve states that have abolish capital punishment have crime rates below the national average.
"Common sense, lately bolstered by statistics, tells us that the death penalty will deter murder... People fear nothing more than death. Therefore, nothing will deter a criminal more than the fear of death... life in prison is less feared. Murderers clearly prefer it to execution -- otherwise, they would not try to be sentenced to life in prison instead of death... Therefore, a life sent...
Have you ever thought about if the person next to you is a killer or a rapist? If he is, what would you want from the government if he had killed someone you know? He should receive the death penalty! Murderers and rapists should be punished for the crimes they have committed and should pay the price for their wrongdoing. Having the death penalty in our society is humane; it helps the overcrowding problem and gives relief to the families of the victims, who had to go through an event such as murder. Without the death penalty, criminals would be more inclined to commit additional violent crimes. Fear of death discourages people from committing crimes. If capital punishment were carried out more it would prove to be the crime preventative it was partly intended to be. Most criminals would think twice before committing murder if they knew their own lives were at stake. Use of the death penalty as intended by law could actually reduce the number of violent murders by eliminating some of the repeat offenders. The death penalty has always been and continues to be a very controversial issue. People on both sides of the issue argue endlessly to gain further support for their movements. While opponents of capital punishment are quick to point out that the United States remains one of the few Western countries that continue to support the death penalty. The deterrent effect of any punishment depends on how quickly the punishment is applied.
