The First Amendment and Cyberbullying

School for students should be a safe place to learn, grow, and develop into impeccable human beings. Bullying has been a major problem for years. As times have changed, and technology has taken over. Bullying has become harsher, and dangerous. Students have more ways to when it comes to bullying, with endless options. Cyberbullying in Michigan has become more of an issue over the years, leading to serious crime offenses. Since technology isn’t going anywhere, this offense will only advance. After careful review of Lamphere School District policy’s, student handbooks and Michigan state laws and policies have a great affect with the First Amendment on cyberbullying.
State District Policies on Cyberbullying

Lamphere schools’ students are taught self-respect and self-value. Lamphere School District intent is to protect all students of all bullying including cyberbullying. Cyberbullying is any harm being done by an individual which is intent to harm one or more student’s electronic communication When reviewing Lamphere School District student handbook. The district does not tolerate any false allegation with bullying or cyberbullying. Any person who reports the act of bullying remains unknown. Cyberbullying could mess with the students’ academics, personal image and or mental health. Students are held accountable for their actions. Parents, guardians, and school board are always contacted. State policies are implemented when it comes to cyberbullying in the school systems.
Michigan has cracked down on cyberbullying with laws and regulations put into place. Cyberbullying is now considered a criminal offense. In 2015, cyber bullying bill was passed protecting students from anti-bullying (Feldscher, K). According to stopbullying.org pupils are protected and bullying is just as equal regardless. Depending if the schools receive federal funding are too address any discrimination which include cyberbullying. Schools are to handle the situation accordingly, if not situation are turned over to the Department of Education of Justice’s Civil Rights Division. Which is intended to help not harm the situation. Now that we have looked at Lamphere School District parent and student handbook along with state statue and districts polices. We can now look at the First Amendment and charges with cyberbullying.

States are required for some form of action when it comes to cyber bullying. In Oakland County Michigan, a case of cyberbullying from a group of more than 30 students could face serious felony charges. Students rights and privacy was violated. The group of students shared pictures of not only themselves but other minors as well. Sharing provocative pictures that were released to other students in school and on social media. Cyberbullying leads to serious manners, the school district is to protect their students’ privacy and rights due to the First

The school is to protect the students from any wrong doing towards them. Such act, parents, school official and other authorities will be contacted. The case in Oakland County MI, opens many eyes for students and parents. The school board has responsibility to report such harm. This is not taken lightly, serious offense. Students could face years in prison, or face felonies.

Cyberbullying has become more of a problem over the past years. With technology being in such high demand and there being endless options. Students can use and abuse technology in a negative light. Since technology isn’t going anywhere cyberbullying will only worsen. The First Amendment rights along with the school’s handbook, student handbook and states policies and procedure are meant to protect students from such harm.
