Executive Order 12333 Analysis

Did the Central Intelligence Agency (CIA) violate the spirit or the intent of Executive Order (EO) 12333 by working with the New York Police Department (NYPD) in secret for years?
This topic is one that is of great interest and close to heart for me as an Intelligence Analyst for the Army as well as being a Muslim American. I feel that on some occasions Intelligence professionals are at a disadvantage due to some of the rules and regulations which have to be followed in the execution of our duties.
After reading both Executive Order 12333 and the Huffington Post article titled "NYPD CIA Anti-Terror Operations Conducted in Secret for Years" in conjunction with EO 12333.
I personally feel that the CIA in some of the events described in the

article did violate the intent of the EO. The CIA did not violate the EO totally as they seemed to operate within the boundaries of 1.7(a)(2) by not conducting any of the clandestine activities themselves, Instead they trained the NYPD and had them conduct operations that the CIA could not legally conduct such as conducting Surveillance on U.S. Citizens in the United States or abroad. I do feel the CIA covertly worked around the EO by assisting the NYPD to infiltrate the Muslim community in New York City.
The following quote below gives credence to the fact that the NYPD was aware that some of the activities being conducted could be legal violations as I assess most of the information was collected without Probable cause.
“Some in the department, including lawyers, have privately expressed concerns about the raking program and how police use the information, current and former officials said. Part of the concern was that it might appear that police were building dossiers on innocent people, officials said. Another concern was that, if a case went to court, the department could be forced to reveal details about the program, putting the entire operation in jeopardy. That's why, former officials said, police regularly shredded documents discussing rakers.” (Apuzzo, et al. 2011)
In my personal opinion I think that CIA did not have malicious intent with their partnership with the NYPD but I do feel that the CIA personnel who trained and operated with the NYPD should have been aware of the restrictions of EO 12333. I feel that the human mapping and the Demographic unit that was stood up and some of the tactics used could be a violation of U.S. citizen’s rights and civil liberties.
