People deal with different life situation’s every day and counseling is a great way to cope with situations that are hard to cope by oneself. Counselors are faced with these situations and it is extremely important to be prepared and have the proper training to be able to handle a client’s situation to the best of their ability. There are rules and regulations to help keep counselors on a professional level to help guide with situations such as confidentiality, supervisor and trainee relationships, and diversity and clinical experience. In the case study presented the first ethical issue is diversity and clinical experience. James wants to use his father to help boost up his clients because he works for a newspaper. He was anxious to have his first client that he didn’t prepare for that he just took on his first client Lisa whom he was running late and he didn’t even go over the intake documents with her. He just had her sign them without reading them so she really had no idea what it was. James noticed that Lisa was experiencing signs of depression such as loss of appetite, decreased motivation, and overall dissatisfaction. James was supposed to report this to his supervisor but forgot to mention it. In the first place James should have been supervised because he does not have the proper training to handle Lisa’s case because of his lack of diversity. Through training this would have been noted one of his weakness to work on expanding his diversity. Training is just that training and is supposed to be supervised so the trainee knows what their strengths and weaknesses are to help them be successful in counseling. (APA, 2012, standard 2.01) states that psychologists should only provide their service only within the boundaries of their competence (American psychological Association, (2012). ACA 2005 states by working with the diverse than knowledge will be gained (American Counselor’s Association 2005). To avoid the situation James needs to be supervised so he can learn what he needs to work on from the feedback. James needs to be on a case that he is familiar with at first to give him some practice and then later on move to a case like Lisa’s. James needs to make sure that he goes over every document that needs to be signed so the client can understand what they are signing.
Chemical dependency counseling involves direct interactions with the clients and as such standards need to be set which will promote safe and accountable counseling. Chemical dependency counseling has a set code of ethics, guidelines and regulations that seek to safeguard the interests of everybody involved. Laws and ethics ensure that everyone acts in a way that does not cause harm to others. Laws and ethics also help to give the profession its credibility. The Licensed Professional Counselors Association of Georgia (2014) gives provisions on the conduct of counselors as stipulated by the law. Chapter 135-7-01 provides the various responsibilities of counselors to their clients. Every counselor has a responsibility to their clients. It is their primary duty to promote the welfare of their clients and meet the client’s best interests.
The topic of this paper focuses on the battles school counselors face as the law and ethical standards collide. School counselors face a number of legal and ethical issues and recognizing a clear decision isn’t always easy. School counselors have to work with a large number of students, parents, and administrators while conforming to ethical codes, state laws, and school board guidelines. This topic is of great relevance to me as I will be going into the school counseling profession. It is also a meaningful topic to me because life-changing decisions are made every day in reference to legal and ethical issues. Researching this topic has shed some light on the difficulty for school counselors to fulfill both legal and ethical requirements. In the mental health profession of counseling, therapy, psychology, psychiatric and social services ethical dilemmas are faced primarily on a daily basis. Being that mental health professionals are working with clients who are often fragile and vulnerable, they must develop an intense awareness of ethical issues. On the other hand, mental health professionals would never intentionally harm their clients, students or colleagues and others whom they work with. Unfortunately, good intentions are not enough to ensure that wrong doings will not occur and mental health professionals have no choice but to make ethically determined decisions. Ethics is important for both group and individual counseling, especially group counseling. Both are beneficial; however, group counseling allows a counselor to work with a small-to-medium size group of people who share similar struggles. Members have the ability to learn from one another. Ethics in group counseling is crucial because the counselor or group leader is not only responsible for one person’s personal struggles, but the struggles of multiple people within the group. Ethical issues in a counseling practice lay the foundation of a therapist in practice. Ethics are at the center of how the counseling process functions and operates in a successful manner for the clients who seek help in such a setting. In order for the counseling profession to be ethical and hold professional recognition, there are many facets that need to be examined and outlined to make sure all counselors and practitioners are functioning at the highest level and withholding their duties required by the counseling profession. The first introduction so to speak of the area of ethics also happens to be one of the first steps in counseling, which is the informed consent. The informed consent provides the basis of what happens or will be happening in a counseling setting and serves to inform the client to their rights, responsibilities, and what to expect. Most importantly, the informed consent is in place for the client’s benefit. It also is important to understand that culture and environment play a role in the treatment of a client and how theories can positively or negatively impact this treatment. Therapists need to understand how to work within the context of a theory while being able to understand the individual in their own environment. In this case, the psychologist is presented with several ethical issues which could cause harm to the client. The first ethical issue that arose in this case is the potential for a role conflict. The psychologist and Mr. Hartwig had contact prior to the development of a therapeutic relationship when the psychologist bought a car from Mr. Hartwig. It may not be enough that the brief, informal relationship ended. The psychologist must assess the dimensions of the previous relationship from the viewpoint of the client as well as his/her own personal feelings (Koocher & Keith-Spiegel, 2008). For example, the client could feel that he gave the psychologist a good deal and that the psychologist was indebted to him. This could leave the psychologist vulnerable to being manipulated by the client. Or, what if the car broke down? This could leave the psychologist feeling cheated and resulted in hostile feelings toward the client. The psychologist has an ethical responsibility to examine both relationships for role incompatibility prior to forming a therapeutic relationship.
