The internal and external forces that impact nursing leaders’ decision making
refer to the nursing care stakeholders who include any institution, individual, or group who are either affected or affect the delivery of nursing services. These forces are identified by the nature of their relationships with the medical facility, and how that relationship has been shaped and managed over time. This is based on the understanding that the relationship is critical in ensuring that there is collaboration to facilitate the development and support of relevant and definite nursing goals, principled leadership, excellence standards, recognition, and support, unified commitment, results orientation, and competence. It is essential for a nursing system to know its stakeholders (internal and external forces) and understanding the nature of their relationship, as well as how to manage the relationship and shape it over time so as to ensure that the positive benefits are maximized while the adverse effects are minimized. This is because engaging the forces in a persuasive way can leverage the nurses’ capacity to gain support for their activities, thereby greatly enhancing the ability to report success in nursing programs (Loyd, Mitchelson & Burridge, 2012; Weiss, 2014).
Today, there are so many legal dilemmas dominating trial for the courts to make a sound legal decision on whose right in a complicated situation. Despite the outcome of the case, the disagreement usually has a profound effect on the healthcare organization, and the industry as a whole. Many cases are arguments centered around if the issue is a legal or moral principle. Regardless what the situation maybe, the final decision is left to the courts to differentiate between the legality issues at hand opposed to justifying a case based on moral rules. According to Pozgar (2012), an ethical dilemma arises in situations where a choice must be made between unpleasant alternative. It can occur whenever a choice involves giving up something good and suffering something bad, no matter what course of action is taken (p. 367). In this paper, I will discuss cases that arose in the healthcare industry that have been tried and brought to justice by the United States court system.
“Ethics is a systematic study of principles of right and wrong conduct” (Taylor, Lillis, Lynn, & LeMone, 2015, p. 96). The American Nurses Association Code of Ethics has nine provisions to it. All nine are important to the nursing field in their own way. There are two provisions that I find most important in helping my career as a nurse. Provision one, The nurse, in all professional relationships, practices with compassion and respect of the inherent dignity, worth, and uniqueness of every individual, unrestricted by considerations of social or economic status, personal, attributes, or the nature of health problems. Secondly provision two, the nurse’s primary commitment is to the patient whether an individual, family, group, or community.
A law is a rule of conduct or action, required (governments endorse laws) to maintain order and public safety in case of a breakdown of law. The criminal & civil law is applied to health-care practitioners or providers, if criminal wrongdoing or negligence occurred in patient’s care. Ethics or moral values serve as the basis for ethical conduct. Our societal values, Family, and cultural values help form an individual’s moral value (Pozgar, 2014, p. 217). The Pozgar further suggests that the healthcare executives needs to understanding the development of law, sources of law, the meaning of different terms to effectively handle change in environment due to frequent policy implementations.
The four major ethical principles in health care are: Autonomy – to honor the patient’s right to make their own decision (the opposite is paternalism - the health care provider knows best for the patient), Beneficence – to help the patient advance his/her own good, Nonmaleficence – to do no harm (many bioethical controversies involves this principle), and Justice – to be fair and treat like cases alike. All 4 principles are considered to be in effect at all times. In theory, each is of equal weight or importance. Ethical responsibilities in a given situation depend in part on the nature of the decision and in part on the roles everyone involved play.
Nurses everywhere face problems and challenges in practice. Most of the challenges occur due to a struggle with the use of ethical principles in patient care. Ethical principles are “basic and obvious moral truths that guide deliberation and action,” (Burkhardt, Nathaniel, 2014). Ethical principles that are used in nursing practice include autonomy, beneficence, non-maleficence, veracity, confidentiality, justice, and fidelity. These challenges not only affect them, but the quality of care they provide as well. According to the article, some of the most frequently occurring and most stressful ethical issues were protecting patient rights, autonomy and informed consent to treatment, staffing problems, advanced care planning, and surrogate decision making (Ulrich et. al, 2013). The ethical issue of inadequate staffing conflicts with the principle of non-maleficence.
In my future role as a healthcare administrator, ethical decision making will be required to address a conflict or uncertainty regarding competing values , such as personal, professional, organizational, and societal values (Thompson, 2011). Administrators involved in this decision-making process must consider the ethical principles of justice, autonomy, beneficence, and nonmaleficence. The word ethics is derived from the Greek word ‘ethos’ meaning character or conduct. It is typically used interchangeably with word moral which is derived from the Latin word ‘moves’ which means customs or habits. The ethical situation in question is a culmination of intolerance, ignorance, cultural insensitivity, and failure to follow hospital protocols and procedures. The location of the facility in which the ethical dilemma took place is a small, rural hospital in the Midwest of the United States of America. A new male patient has been admitted and he is currently a practicing Muslim. The facility does not have a large Muslim population and does not have any cultural protocols in place to accommodate the Muslim religion.

Nurses should study and be as informed as they can with ethics and legality within their field in order to ensure no mistakes occur.
