From elementary to high school and even college students are compelled to attend school all around the world. In schools students not only learn general education but learn a lot about themselves. It is said that in the first twenty years of an individual’s life are the years that the individual finds out who they really are. An individual’s moral beliefs are one of the most personal and complex pieces of that individual. There are several great moral theories that could be taught in school, but to only choose one is very difficult. Some of the most known moral theories are Utilitarianism, Virtue Ethics, Kantianism and even Social Contract Theory. Hobbes states that “morality should be understood as the solution to a practical problem that arises for self-interested human beings” (EMP pg.82). Hobbes believes that everyone wants to live as well as possible, but to flourish; we all need a cooperative social order. Without rules it is not possible go live well. Social Contract Theory has two purposes to complete its theory and they are morality and government. Morality is important in this theory because it makes social living possible and the purpose of government is to enforce the moral rules. The Social Contract Theory can easily be summed up as “morality consists in the set of rules, governing behavior that rational people will accept, on the condition that others accept as well.”(EMP pg. …show more content…
When Hobbes refers to this that is what he is talking about. The state of nature would be awful, due to the four basic needs that every human being needs. “There is equality of need” (EMP pg. 83). Everyone needs the same basic things to survive and those are food, shelter, clothing, and so on. “There is scarcity” (EMP pg. 83). People have to work hard to produce things, even when there is a small supply. Things are not just given to people. “There is equality of human power” (EMP pg. 83). This simple means that even if people are smarter or tougher then someone else it doesn’t mean that they cannot be brought down. The last one is “there is limited altruism” (EMP pg 84). No one can trust anyone besides themselves because others care more about themselves. With every human being having the same basic needs there is not enough to go around. The world would be total chaos; everyone would be fighting over everything. In a world like this no one would win. Without the Social Contract Theory there would be no rules or order and the world would be at war with each other. In order to fully grasp Hobbes' theory of Social Contract, one must first become familiar with his basic premises of "The State of Nature." In this state each individual is inherently in a perpetual state of war, due to several given reasons. Hobbes assumes that "Nature hath made men…equall." (Hobbes 183) Also, that in this state of war all men exemplify purely egoistic behavior, striving to do whatever possible to maximize their own utility, even if it requires murdering another. In addition to these conditions, in the state of nature, there exists a state of natural scarcity, in which, a finite amount of goods, possessions, property, "cattell," "wives," whatever, exist to satisfy man's infinite wants. "And therefore if any two men desire the same thing…they become enemies and…endeavour to destroy or subdue one an other." (Hobbes 184) Hence, creating a constant state of war.
Hobbes views human nature as the war of each man against each man. For Hobbes, the essence of human nature can be found when we consider how man acts apart from any government or order. Hobbes describes the world as “a time of war, where every man is enemy to every man.” (Hobbes mp. 186) In such a world, there are “no arts; no letters; no society; and which is worst of all, continual fear, and danger of violent death; and the life of man, solitary, poor, nasty, brutish, and short.” (Hobbes mp. 186) Hobbes believes that laws are what regulate us from acting in the same way now. He evidences that our nature is this way by citing that we continue to lock our doors for fear of theft or harm. Thomas Hobbes derived his theories by concluding that man in and of itself was evil. In addition, he felt that if left without a government authority, life would be "nasty, brutish, and short". In a direct result of the evilness of man comes the theory that self-preservation is the most imperative component of life. At all costs, one must uphold this right and do whatever is necessary to preserve it. Because every man in a state of nature can be based on one theory, it creates a state of equal mentality. If one man basis life around self-preservation, so will the next. With a society being in this perpetual condition, it creates a state of war. One man against all others—all equal in ability regardless of size or intelligence due to circumstances and willpower that can always level the playing field.
According to him, “the weakest has strength enough to kill the strongest” (Hobbes, 1991: 87). In other words, Hobbes introduces the concept of natural equality, which entails that each man is a mortal threat to others because one is strong enough to kill another. Moreover, he also believes that people are naturally free because they have a right to do anything, since in the state of nature there are no laws to constrain humankind. Hobbes and Rousseau created a revolutionary idea of the state of nature. They did not believe government should be organized through the church, therefore abandoning the idea of the divine right theory, where power of the king came directly from God. Starting from a clean slate, with no organized church, Hobbes and Rousseau needed a construct on what to build society on. The foundation of society began with the original state of nature. Hobbes’ perception of the original state of nature is what would exist if there were no common power to execute and enforce the laws to restrain individuals. In this case, the laws of the jungle would prevail: only the fittest survive. Man’s desires are insatiable. Since resources are scarce, humankind is naturally competitive, inevitably creating jealousy and hatred, which eventually leads to war.
Hobbes believes that all men are equal insofar as that the weakest man has the power to kill the strongest man. Thus given that every man is vulnerable to any other man, all men have a very strong desire to escape the state where killing each other is acceptable, escape the state of nature. This can be done, simply put by endeavoring peace which coupled with not making war except to defend oneself, is the first law of nature (Leviathan 1, 14).
In Leviathan, Hobbes states that a state of war will ensue that will put every man against himself. Eventually the state of war will lead the people towards peace and the only way to achieve the peace is through social contract. Hobbes continues further saying, social peace and civil unity are best achieved through the establishment of a commonwealth through a social contract. This social contract insists that a sovereign power be granted absolute power to protect the commonwealth. This sovereign power will be able to control the powers of human nature because its whole function is to protect the common man.
Through Hobbes’s writing we can determine his views on humans are rather pessimistic; humans according to him are naturally evil. Hobbes states that humans in their essence seek their own self-interest; as well as that humans are not guided by reason but by passion. In a state of nature, humans are licensed to do and take as they yearn or need, depending on each individual self-interest; thus natural law, which is regarded as a constant state of conflict and war. Humans in a state of nature are inclined to see each other as potential inflictor of pain—each is seen as a potential murderer, in extreme cases. That been the case, each individual seeks more power, this is their self-interest, out of fear of each other; this then leads to the surrounding individuals to seek more power themselves, again, concerning their self-interest, for their own salvation. The mightiest of the passion’s embraced by humans are the fear of death and the desire for power. The basic law of a contract is an agreement between two parties or more, to deliver a service or a product. And reach a consensus about the terms and conditions that is enforced by law and a contract can be only valid if it is lawful other than that there can’t be a contract. For a contract to exist the parties must have serious intentions, agreement, contractual capacity meaning a party must be able to carry a responsibility, lawful, possibility of performance and formalities. Any duress, false statements, undue influence or unconscionable dealings could make a contract unlawful and voidable.
Thomas Hobbes creates a clear idea of the social contract theory in which the social contract is a collective agreement where everyone in the state of nature comes together and sacrifices all their liberty in return to security. “In return, the State promises to exercise its absolute power to maintain a state of peace (by punishing deviants, etc.)” So are the power and the ability of the state making people obey to the laws or is there a wider context to this? I am going to look at the different factors to this argument including a wide range of critiques about Hobbes’ theory to see whether or not his theory is convincing reason for constantly obeying the law.

Thomas Hobbes? idea of a perfect government was one of small proportions. All of the citizens of a country had a ?covenant?, or promise with the ruler. This covenant with the ruler stated that the citizen would give up the right to govern his or herself, and give that right to the ruler. Hobbes? idea of society arises from an innate competition between every man. Everyone seeks their advantage, and is always at war with everyone else for that advantage. These factions negotiate, according to Hobbes, complying with whatever principles will ensure survival for its members. So according to Hobbes, war is the natural state of man. Peace is only had by our natural tendencies to compromise, and survive.
