In life, one comes across their fair share of closed, and locked doors. Sometimes the door slams shut just as you begin to cross its threshold. Sometimes you spend hours, days, weeks, months, and even years, hoping that by some miracle of chance the door will open. Yes, it's true some merely rot away waiting for doors that have closed, stuck in their same simple mindset that solves nothing. If only they would try thinking in new ways, because maybe then they’d be able to open it. But no, It’s the same dreadful cycle of old thoughts, old ideas, and expired hope. These doors are the creators of misery, and the creators of innovation. All this talk of locked doors seems to neglect those who are locked in by doors, not out. Now, this, of course, got me into some tight spots (pun intended). At the mere age of 4, I had managed to convince myself that I was ready to lock the bathroom door. Now, this isn’t as simple as it seems, it was that kind of lock that was tiny, slippery and whatnot, but of course, midnight was the perfect time to try a new thing. I was so full of my self-inflated sense of maturity and bravery I got myself stuck. Stuck like someone who is in quicksand and doesn’t know how to escape, stuck like someone behind bars. Stuck, stuck, stuck. Alone locked in, I was a prisoner and my jailer was my own stupidity. I grappled with the lock for minutes upon minutes, not wanting my foolishness to be known to my parents, because then I wouldn’t be the grown girl I had thought I was when I initially locked that door. Unfortunately, the lock just wouldn’t unlock. So like any rational four year old would, I screamed at the top of my lungs as tears flowed down my face, as I saw my life flash before my eyes, forever stuck in a bathroom. My parents, doing what rational parents do when they hear their four-year-old screech at the top of their lungs, ran to me. I wish I could say they got me out, but they couldn’t. A million things they must have tried. They attempted to talk me through unlocking the door, they tried to take out the lock, take down the door, anything and everything. Government officials are continually searching for ways to increase the safety of its citizens. Research has shown that one such way to accomplish this task is through the maintaining of public areas. Since the early 1980s, this idea has been known as the Broken Windows Theory. Applying this theory in the urban setting can increase the quality of living for the area citizens, help prevent future crimes, and promote a positive relationship between the police force and the citizens.
The living room was dark and the only thing you could see was the brightness of the TV. Also, I could still hear many people talking from down stairs, fire truck siren going off, and the city lights that were still shining bright. At the age of seven, on a cold Friday night in Brooklyn; my mom, cousin, and I started watching some scary movies since it was around Halloween. There was this movie called “Child’s Play” and as a child, I didn’t like the movie at all due to the fact that there was an ugly doll that was moving and killing people. During, that weekend it was showing marathons all weekend long since it was the Halloween weekend. The bed was pulled out with all the warm blankets and snacks besides us waiting for the move to start.
The overall goal of correctional facilities can be broken down into three main functions which are retribution, deterrence, and rehabilitation of the inmates. Today, there is much debate on rather private or public prison admiration is best to suit those goals. In a private prison the inmates are contracted out to a third party from either local, state, or federal government agencies (Smith 2012). Public prisons are where the government themselves house and supply the inmate’s basic needs with no third party involved. However, a large portion of the argument of private verses public prisons is over, which is best in achieving those goals more efficiently.
In the past, according to the online Wikipedia encyclopedia, the common law definition of burglary, was breaking and entering of the dwelling of another at night with an intent to commit a felony therein. In the present, according to criminal.findlaw.com, the modern common law definition of burglary, is typically defined as the unlawful entry into almost any structure (not just a home or business) with the intent to commit any crime inside (not just theft/larceny). No physical breaking and entering is required; the offender may simply trespass through an open door. The Criminal law hand book written by Paul Bergman and Sara Berman states that the law has changed because burglary laws were more rigid, and they required the government to prove that a defendant at night forced open a door, a window, or some other part of a building to gain entry before it was called burglary. Unlike the present, going into a building any time of the day without consent through an open window or an unlocked door constitutes a break and entry for purposes of almost all burglary statutes. Even a partial entry can constitute a burglary.
The First Amendment of the constitution allows us the freedom to practice the religion of our choosing, the right to speak freely in public and in press, as well as the right to assemble and peacefully protest issues of which we feel strongly. However, the rights we have as free citizens differ considerably in comparison to that of prisoners. Prisoners are allowed these rights, but only to an extent to which it does not affect the safety of themselves or other inmates, nor cause an overwhelming burden on prison administrators. There are many cases won and lost by prisoners regarding the First Amendment, and within the following paragraphs I will discuss these cases in depth.
Solitary confinement is a method of punishment which isolates the prisoner from any human interaction. Its purpose is to deter the prisoner from acting out. Giving oneself time to think and correct their actions. However, this cruel and inequitable sanction does more harm than good towards the prisoner, if any. When a prisoner is placed in solitary confinement they are challenged physically and mentally. They are caged in 24 hours a day with only limited interaction from the prison guards. The prisoner is left alone, detached from the world. This can cause a negative effect on the prisoner's mental state. People look at you like you’re the one to blame. They see your tattered sneakers and tangled, greasy hair, and they think they know you. But how could they? You amble down the sidewalk, keep your head down, your eyes averted. You don’t want any trouble. People are quick to assume that's what you're looking for. Your lips are chapped and your face is dirty. You cannot remember the last time you brushed your teeth, let alone took a shower. The thought makes you laugh almost as much as the thought of your old bedroom walls, the shadows cast by the ceiling fan as you stared up from your bed. You had to leave home. It was taken from you. The adults in your life shifted as you grew older, or perhaps you just grew aware. They took pills or tipped glasses or screamed at you for no particular reason. They kicked you out when you got pregnant, when you got mouthy, when you weren't all they wanted you to be. They got sadistic. They crossed unspeakable lines. You had to leave home. You are barely more than a child. At least, you were before. Now, you are homeless.
The purpose for the Fourth Amendment is to protect people from intrusion of the government in areas where they have a reasonable expectation of privacy. It prohibits searches and seizures unless they are conducted with probable cause and under reasonable circumstances. “The Fourth Amendment only protects against searches and seizures conducted by the government or pursuant to governmental direction. Surveillance and investigatory actions taken by strictly private persons, such as private investigators, suspicious spouses, or nosey neighbors, are not governed by the Fourth Amendment” (Criminal.Findlaw.com, 2013).
Within the profession of policing, there are many ideas that have been brought forth with the goal of reducing crime. Crime is a blight on society that impacts many in different ways. Whether it is violent crime or a property crime, many usually feel the impact. The victim of each crime is obvious; they feel the loss involved directly. If you are the victim of a violent crime, you feel your loss by pain felt, doctor bills accrued, time needed to recover, and the trouble of putting your life back together, etc. Additional to the victim, others feel these crimes as well. Family and friends of the victim feel sorrow and tax payers take on the financial burden if the victim does not have self paid medical insurance, to name but two issues.
The idea behind the Broken Windows Theory is simple, small things can turn into big problems. When a window gets broken, or litter covers the sidewalk and streets or graffiti covers a wall in an alley it is not a big deal as long as it is cleaned up and attended to promptly by the neighborhood. The problems begin when the broken windows, litter and or graffiti is left alone and more follows it. Once a neighborhood becomes neglected, only more neglect follows it.
