Erroneus Assumptions in The Trial and Death of Socrates
In Plato's Crito, Socrates explains to his old friend Crito his reasons for refusing an offer to help him escape execution. One of the tools Socrates uses to convince Crito of the righteousness of his decision is a hypothetical argument concerning the state and laws of Athens. Central to this argument is the congeniality that Socrates had always found in Athens, reflected by the fact that Socrates chose to remain in Athens for most of his life. Such a choice, the laws insist, implies a tacit agreement between Socrates and the state of Athens, stipulating that Socrates either obey the laws or, when he deems the laws unjust, persuade the city to act in a more suitable fashion. It is this "just agreement" that prohibits Socrates from fleeing Athens to avoid execution. Socrates proves to Crito's satisfaction that to break this agreement would be to do wrong to the city of Athens, and as such it cannot be seriously considered.
As he discusses his situation with Crito, Socrates refutes some of Crito's basic assumptions. Curiously, however, Socrates does not examine his own assumptions; he never once asks if his agreement with Athens is "just." He correctly assumes that Athens' congeniality to him obligates him to follow the tenets of the agreement, but he does not ask if Athens feels similarly obligated. This question is central, for if Athens fails to uphold its part of the agreement the agreement cannot be just and Socrates is freed from any duty to it. I will argue that Socrates' own reasoning, particularly that used in Crito and Euthyphro, will prove that it is not only not wrong to break the agreement, but also that it is wrong to abide by an unjust agreement, such as...

...nywhere in the text of the Crito or the Euthyphro, unlike most of the other claims, which were derived from actual arguments in one of these Socratic dialogues. Whether or not the agreement is rendered unjust by Athens actions is clearly a debatable point, which affects the rest of the argument. There does not seem to be a way to prove undoubtedly that the agreement itself is made unjust if one of the parties unjustly refuses to acknowledge its obligations. Theoretically, the agreement is still sound, but this argument rests on the idea that, in practice, the agreement can never be more than what the parties make it. Although far from incontrovertible, the claim that the agreement is unjust can at least be reasonably defended against criticism. And if the above argument is correct, Socrates died for the sake of the unjust action of adhering to an impious agreement.
"Do we say that one must never in any way do wrong willingly, or must one do wrong in one way and not in another?"3 Socrates tries to help people understand that mistakes are human nature, however to do wrongful things on purpose should not be tolerated. Crito agrees with Socrates statement, "So one must never do wrong."4 Crito believes in what Socrates is expressing, yet he wants Socrates to perform an unreasonable action and escape from prison. A big thing for Socrates is trust and being loyal to his family and city. "When one has come to an agreement that is just with someone, should one fulfill it or cheat on it?" Crito believes one should fulfill it. Which Socrates then states "If we leave here without the city's permission, are we harming people whom we should least do harm to? Are we sticking to a just agreement, or not?" Socrates thinks that if you commit to something you need to be a man of your word and follow through. If you make an agreement with someone, you should keep your word to the fullest extent. Socrates thinks he needs to adhere to the agreement of being in prison. He believes he shouldn’t leave unless someone tells him otherwise and to the just thing by upholding the decision. Socrates refuses to disobey the law. He believes in the correctness of the cities laws. He believes it is never right to act unjustly. He thinks that if you do not agree with the laws of the area that you are living at, then to leave and go somewhere else. He argues that the government could be seen as “his parents, also those who brought him up,” (Crito, 51e), since he has lived there his entire life and when you live somewhere for so long you should “persuade us or to do what we say,” (Crito, 52a) or leave. For these two articles that we read in Crito and Apology by Plato, we could know Socrates is an enduring person with imagination, because he presents us with a mass of contradictions: Most eloquent men, yet he never wrote a word; ugliest yet most profoundly attractive; ignorant yet wise; wrongfully convicted, yet unwilling to avoid his unjust execution. Behind these conundrums is a contradiction less often explored: Socrates is at once the most Athenian, most local, citizenly, and patriotic of philosophers; and yet the most self-regarding of Athenians. Exploring that contradiction, between Socrates the loyal Athenian citizen and Socrates the philosophical critic of Athenian society, will help to position Plato's Socrates in an Athenian legal and historical context; it allows us to reunite Socrates the literary character and Athens the democratic city that tried and executed him. Socrates reaches a conclusion that defies a common-sense understanding of justice. Nothing about his death sentence “seems” just, but after further consideration, we find that his escape would be as fruitless as his death, and that in some sense, Socrates owes his obedience to whatever orders Athens gives him since he has benefited from his citizenship.

Socrates, in his conviction from the Athenian jury, was both innocent and guilty as charged. In Plato’s Five Dialogues, accounts of events ranging from just prior to Socrates’ entry into the courthouse up until his mouthful of hemlock, both points are represented. Socrates’ in dealing with moral law was not guilty of the crimes he was accused of by Meletus. Socrates was only guilty as charged because his peers had concluded him as such. The laws didn’t find Socrates guilty; Socrates was guilty because his jurors enforced the laws. The law couldn’t enforce itself. Socrates was accused of corrupting Athens’ youth, not believing in the gods of the city and creating his own gods. In the Euthyphro, Socrates defends himself against the blasphemous charges outside the courthouse to a priest Euthyphro. Socrates looks to the priest to tell him what exactly is pious so that he may educate himself as to why he would be perceived as impious. Found in the Apology, another of Plato’s Five Dialogues, Socrates aims to defend his principles to the five hundred and one person jury. Finally, the Crito, an account of Socrates’ final discussion with his good friend Crito, Socrates is offered an opportunity to escape the prison and his death sentence. As is known, Socrates rejected the suggestion. It is in the Euthyphro and the Apology that it can be deduced that Socrates is not guilty as charged, he had done nothing wrong and he properly defended himself. However, in the Crito, it is shown that Socrates is guilty only in the interpretation and enforcement of Athens’ laws through the court system and its jurors. Socrates’ accusations of being blasphemous are also seen as being treasonous.
In Plato’s “Crito”, Socrates, who is convicted of spreading false beliefs to the youth in Athens is in an argument with his friend, Crito. Crito tries to convince Socrates of the reality of his sentence and that it would only make sense for him to escape. He gives many reasons of why escaping is necessary and moral. Crito states,
The acceptance that the court system often treats female offenders differently than male offenders is an accurate statement; however, it comes with many caveats. Generally, the public views women as nurturers, motherly and incapable of harming a child. Research indicates that female sex offenders capable of committing such acts have serious psychiatric and psychological problems. In comparison, research indicates male sex offenders are more callous, more antisocial, and promiscuous, involved in the criminal justice system, and have more victims (Miccio-Fenseca, 2012, slide 7). The consensus is that men commit their acts for sexual pleasure while women commit their acts due to psychiatric and psychological problems. Law enforcement, juries, and judges tend to empathize more when there are additional mitigating factors such as emotional or psychological problems. Due to these mitigating factors, it appears treatment of female sex offenders is more lenient than male if their crimes are similar in nature. (Apology, Plato, Philosophic Classics page 21) Socrates is also accused of denying the existence of the gods, and corrupting the youth. Socrates goes about trying to prove his innocence. The jury that Socrates was tried by was made up of 501 Athenian citizens of all classes of society. While he fails to convince the Athenian jury of his innocence, he does a wonderful job in this effort. I personally believe that Socrates is innocent, and that the Athenian jury made the wrong decision.

In 399 BC, Socrates, the great philosopher in ancient Greece, was put to death under the hands of his Athenian fellow-citizens to whom he had a strong attachment, after a final vote with over two-thirds of jurymen against him. We cannot experience the situation where Socrates gave his final argument in the court of law. From Plato’s Apology, we admire Socrates’ brilliant rhetoric and rigorous logic, while at the same time feel pity for him and indignant with those ruthless jurymen. However, the question of what exactly caused his death and why was Socrates, such a remarkable thinker sentenced to death in the very society that valued democracy the most is not easy and straightforward to answer. There are multiple elements involved that finally caused this tragedy in which “a person of high moral principle is confronted step by step with a situation from which there is no escape” (38). First of all, the moral principle and belief in divinity held by Socrates are inconsistent with those of the Athenian society, implying the very crimes charged upon Socrates were not completely groundless. Secondly, the imperfect juridical system of Athens played a role in causing this tragedy. What’s more, Socrates himself, could have offered better defense in the court, also had a hand in his own death by his stubbornness regarding to his own interpretation of wisdom and piety. His rebuttal, though brilliant and insightful, was not persuasive enough to move the fellow-citizens for his wrong approach and sophistry in his cross-examination on Meletus.
Socrates questions Thrasymachus on why he adds the detail of the stronger to his definition of justice. Socrates than asks, if it is just for everyone to follow the laws that the ruler has made, if the ruler has made unjust laws. His argument is that people, even rulers make mistakes. This meaning that if a ruler makes mistakes on the law does that still make it just. It is a very conflicting argument to think about, if the rules are not just then why should they be followed but the rules were also put in place by someone who is supposed to know the difference between just and unjust and choose correctly. This then leads to much embarrassment and shame, having their picture televised every year (Worley, R. M., & Worley, V. B., 2013). Today, anyone with Internet access can view and search the sex offender registries and this leads to the direct violation of privacy of these sex offenders. Not only are they tormented but their family members are as well. In order to fulfill the agreement he has made with Athenian law, Socrates must accept the punishment he is given, though he feels that his being punished is Athens wronging him. It would be wrong, by his view, to escape from prison, though he would not be pursued, because he would be breaking his agreement to obey Athenian law. Since he and Crito previously agreed that one must never do wrong, he simply must stay in jail until his death. This is merely one example of the way in which Socrates uses a method of logical dialogue in order to make his point. He appears to be unmatched in his skills of deduction and consistently demonstrates his love of knowledge and truth. Socrates exemplifies all that is philosophy, both as a student and a teacher, because of his constant, active pursuit of wisdom.
