Engineers are expected to constitute their professional decisions through the engineering code of ethics. But what is the right decision when their judgment is overruled by securing their employer’s profit under circumstances that endanger their customer’s property? This was Shane’s dilemma when 1 out of 150 chips were found defective in his chip production line. Discarding the defective chips was generating an $8,671.00 loss to the company; thus Rob, his manager, proposed to release all chips to the market without previous quality control. As an engineer, Shane must protect his employer’s reputation, his customer’s welfare, and ultimately, the safety and public health. He must not follow Rob’s recommendation of ceasing quality control in his production line because this would threaten the three entities that the engineering code of ethics requires him to protect.

Accordingly, Shane shall convey on a meeting with Rob and present to him his conflict of interest by showing him the statistics and side effects that the lack of previous testing on the chips would generate declining the reputation of their own company, damaging the customers’ property, and risking the public safety. Today, there are so many legal dilemmas dominating trial for the courts to make a sound legal decision on whose right in a complicated situation. Despite the outcome of the case, the disagreement usually has a profound effect on the healthcare organization, and the industry as a whole. Many cases are arguments centered around if the issue is a legal or moral principle. Regardless what the situation maybe, the final decision is left to the courts to differentiate between the legality issues at hand opposed to justifying a case based on moral rules. According to Pozgar (2012), an ethical dilemma arises in situations where a choice must be made between unpleasant alternative. It can occur whenever a choice involves giving up something good and suffering something bad, no matter what course of action is taken (p. 367). In this paper, I will discuss cases that arose in the healthcare industry that have been tried and brought to justice by the United States court system.
The engineer breached the duty of care through failing his/her duty to warn by providing insufficient warning on the limitation of the application. His/her software application caused the structural firm to designed a defective bridge and was the direct cause of many deaths. The junior engineer should be held liable for his/her product due to the principle known as product liability. This is evident in the case study because deaths and injuries due to defective product as a result of the software were foreseeable. Looking at the 1971 case of Lambert v. Lastoplex Chemicals Co. Limited et al., the manufacturers must not only instruct the user how to properly use the products but also warn the user the consequences of misuse []. This precedent case proves that the engineer failed to warn the structural firm of the limitation of the application as well as failed to warn the consequences of using the application beyond its capabilities. However, the information technology firm may be held vicariously liable for the mistake of the junior engineer as he/she developed the software application during his/her employment. The company is also faced with a 20% reject rate that is absolutely unacceptable. A lot of the produced boards go to waste, and a lot of resources are compromised. Moreover, it contributes to the manufacturing strain, as the production team must start with at least 20% more than the required output just to give allowances to the defects. CBF, Inc. should implement a more rigid supervising/monitoring program with the manufacturing processes in order to pinpoint and arrest the cause of these defects.
The aerospace industry is fairly new in our day in age. It has been recorded in history that the first flight ever by man took place in Kitty Hawk, NC roughly 100 years ago. This, as you might expect, leaves two possibilities, the atmosphere or our earth, and outer space. Such basic examples of aerospace vehicles are Cessna planes, Black Hawk helicopters, Goodyear blimps and the Columbia Space Shuttle.
