In this scenario, I have decided to report the incident to the district attorney. This decision required a lot of information to be thought through carefully. This situation is an ethical dilemma and the decision to go to the district attorney is most rationale option. Every decision that is made requires balancing concerns such as prosecuting the guilty, respecting the rights of the accused, protecting victims all while creating and maintaining a safe community. Though, decision making isn’t the easiest, we can always make the best choice when we think things through and understand the different ways to approach the situation(s).
So, let’s look over what transpired. As of right now the victim of assault and rape is in a coma, around the area of where the crime took place there was a gang of young men who were seen assaulting and threating the people around there. Two members of the gang, age 14, were picked up by two responding officers, both of these minors have pre-existing records for robbery and assault.

Not to mention that without evidence to support that they might be the perpetrators the case would be thrown out due to lack of evidence, which would definitely make the police and district attorney look bad, in terms of handling the case. I believe that my partner used an unethical technique against the 14-year-old boys in order to get a confession. This would violate their rights and the ethics of duty (deontology), which is “the normative ethical position that judges the morality of an action based on the actions adherence to a rule or rules. It is sometimes described as duty or obligation or rule -based ethics, because rules bind you to your duty” (). In other words, deontological approach begins with the presumption that any action is inherently right or wrong; an action is right if it respects the rules and wrong if it
This incident involved Victim Athena Marie Herbert being a victim of an attempt rape at Suspect Gayk Chuldzhyan’s residence.
A woman was raped at Central Park and was found unconscious. She recovered quickly after the incident but could not recall what happened on that day. On the same day that woman was raped all five teenagers were there but were at the opposite direction of where the rape incident happened. They were brought in by the police to be questioned and were asked about the incident. The police were interrogating the teenagers and yelled at their faces because they were getting frustrated that they were not getting the answers that they wanted to hear from them. The teenagers were getting tired from being questioned for about two days on something they knew nothing about and wanted to just get out of the place. The police told them to say certain things and told them things that they wanted to hear, which led to the teenagers believing that if they said what the police told them to say then they could leave. They ended up confessing to raping the woman on video and paper and that led to their arrest. Though there were no actual evidence proving they were there at the scene, it did not matter because the police just wanted the confessions, which was their goal from the
The duty of prosecutorial disclosure is one that is safely entrenched in our understanding of the legal system. The prosecution must disclose evidence that relates to the case and is favorable to the defendant. While not explicitly stated in that duty, it also means that the histories of the witnesses are available to the defense. And when police officers are called to testify at cases, their disciplinary histories come into play as a factor in their credibility. Taking all this prior information into account when addressing the dilemma of the police officer with a good record who used the department computers to look at pornography using his login information, and then lied about it only to confess when the internal investigation proved
At approximately 1724 hours on February 1, 2016, I, Cpl. Lessane, along with Deputy Eubanks, responded to 701 Boles Road, in the Cummings area of Hampton County, to meet with Florena Johnson, regarding an incident that occurred on a School bus with her daughter. During the disturbance on the School bus, a juvenile was threatened and felt fearful for her safety by three other subjects. Juvenile was told by the subjects, they were on the way to her residence; threatening to cause bodily injuries. The juvenile mother notified Law Enforcement and filed a Police report. No suspect (s) were on scene or in the area upon the arrival of deputies. The complainant was advised to call 911 if the subject (s) arrive at the residence at a later

My homicide case began when the Shreveport Police Department (SPD) received a call from a male caller via 911 reporting he found a body of a black male found in a park near a cul-de-sac in a residential area. I was dispatched and responded to the scene. Upon arrival, I began steps documenting the crime scene. I initiated a rough sketch of the scene and initiated my field notes. A cordon was initiated as I began identifying possible evidence and identifying witnesses and suspects. I canvassed the area and found four 9mm shell casings near the body.
took us down in the bottom of the police station to a cell. And they had us handcuffed — they started beating us. They was beating us to our body, you know? They didn 't beat us to the face, where nobody could see it; they just punched us all in the stomach, and back and legs. We was hollering and screaming. We thought they was gonna kill us" (NPR.org) The boys were held in cells for six days until they were able to see their parents at the hearing held for their case. The Judge found the boys guilty of molestation and sentenced to a reform school for African Americans with the possibility of being released by age 21 if they
Ethics is a big part of investigating homicides and burglaries. Homicide is a horrible crime and should be treated as such. If an investigator is investigating a homicide that was committed by a homosexual lover and the investigator had a hatred for homosexuals he must still investigate this crime with compassion and professionalism. A homicide detective must be aware of the ethical issues that can be involved...
Three rapes were reported in the 1983 in the state of Massachusetts. The first rape was reported on August 17, 1983 a women by the name of Marilyn Goss. She was raped by an intruder while she spent the night at the Casa Manor Motel in Ayer, Massachusetts (Stearns, 2006). On November 16, 1983 a woman was attacked while she was walking home in the city Lowell, MA. A man she did not know approached her, tried to converse with her, and then forced her into a nearby yard, where the man sexually assaulted her (Know the Cases: Dennis Maher). On November 17, 1983, about twenty four hours after the other attack in Lowell, MA, a different woman was harshly shoved to the ground by a man who produced a knife. The woman was luckily enough to escape the man after a struggle...
Therefore, under these ethical standards, prosecutors cannot file charges if there is not enough evidence to support a conviction, they also do not file if it is not in the public interest to do so. This is what makes the possibilities limitless; however, three key factors also play a part in determining which cases to prosecute. If prosecutors follow these three factors in determining cases then the contradiction of limitless discretion and high ethical standards should be remedied for others. These are factors that should be followed are as followed: the seriousness and nature of the offense, the offender’s culpability, and the likelihood of being able to obtain a conviction at a trial. “Ethical conduct, then, must be the core of the prosecutor’s role in the criminal justice system” (Hemmens, Brody, & Spohn, 2013). Therefore, even though prosecutors have almost limitless discretion in their decisions, they still must
According to rain.org 44 percent of rape victims are under the age of 18 and 80 percent are under the age of 30 years old. Every 2 minutes an American is a victim of rape and about 240,000 of them are reported each year. Only 60 percent of assaults are not reported to the police renders that 97 percent of the perpetrators never spend a day in jail. The less the people report the crime the less they are likely to catch the perpetrator. Sadly 23 of the victims know the person whole is assaulting them. Almost 40 percent of the rapist know their victim. This is a very uns...
waist. Her underwear was on the ground; her hair disheveled and covered with pine needles” (CITE). Two males witnessed Turner thrusting his hips on top of her while he was using his phone with flash. It is clear his motivation was power rape. After being denied by her sister, Turner went to assault the victim while she was alone and under the influence. He was rejected and that frustrated him, wanting complete power and control over her sexuality and body. The mishandling of campus sexual assaults is present in this case when the attackers sentence was minimized to 3 months with good behavior. He is being watched in protective custody in a single cell because he did not seem dangerous as general populated inmates. A questionable but simply ridiculous and clearly a form of privilege towards a white male and athlete influencing society and allowing a slap on the wrist as his sexual violence deeded a “minor mishap”. The lenient jail sentence is also a form of ridiculousness to the severity of sexual assaults in general. Trying to Justify for allowing a short sentence as the judge feared a longer sentence would have a severe

There can be many barriers that effect the law enforcement community into not being able to perform their duties. First, victims of certain crimes can be difficult to deal with when attempting to apprehend the suspect and bring that individual or persons to justice. When assisting the District Attorney’s office and arresting criminals, the victim may choose to not participate, which interrupts the process and hinders the prosecution of the criminal activity that occurred. For example, cases such as these can be seen with domestic violence cases, who do not want to cooperate with what their spouse, significant other, family, or other arrangement is being charged with. In addition, to failing to cooperate, the victim will also claim that the
