I’m going to talk to you about the death penalty and how it associates with the three branches of government. I will also talk to you about how the death penalty affected people’s lives from the past to present day. The death penalty is the process by which you are sentenced to death for a foul crime the person has committed, whether that crime is murder, espionage, treason, or military justice. Other crimes, like sexual crimes have death penalties for rape, adultery, incest, and sodomy while militaries death penalty crimes are cowardice, desertion, insubordination, and mutiny. In some parts around the world, death penalty is called capital punishment because of the many controversy in many parts of the world. For the executive branch, Barack Obama, in 1996 opposed the death penalty, so he wrote the memoir called The Audacity of Hope in an attempt to cease the death penalty. Unfortunaly in 2004 when Obama ran for US senate, he saw the death penalty as a way of giving those justice for the foul crimes that those have been committed of. Each year there are about 250 people added to death row and 35 executed. From 1976 to 1995 there were a total of 314 people put to death in the US 179 of them were put to death using lethal injection, 123 were put to death using electrocution, 9 were put to death in a gas chamber, 2 were hanged, and 1 was put to death using the firing squad. The death penalty is the harshest form of punishment enforced in the United Sates today. Once a jury has convicted a criminal, they go to the second part of the trial, the punishment phase. If the jury recommends the death penalty and the judge agrees then the criminal will face some form of execution, lethal injection is the most common form used today. There was a period from 1972 to 1976 that capital punishment was ruled unconstitutional by the Supreme Court. Their reason for this decision was that the death penalty was "cruel and unusual punishment" under the Eighth Amendment. The decision was reversed when new methods of execution were introduced. Capital punishment is a difficult issue and there are as many different opinions as there are people. In our project, both sides have been presented and argued fully.

Americans have argued over the death penalty since the early days of our country. In the United States only 38 states have capital punishment statutes. As of year ended in 1999, in Texas, the state had executed 496 prisoners since 1930. The laws in the United States have change drastically in regards to capital punishment. An example of this would be the years from 1968 to 1977 due to the nearly 10 year moratorium. During those years, the Supreme Court ruled that capital punishment violated the Eight Amendment’s ban on cruel and unusual punishment. However, this ended in 1976, when the Supreme Court reversed the ruling. They stated that the punishment of sentencing one to death does not perpetually infringe the Constitution. Richard Nixon said, “Contrary to the views of some social theorists, I am convinced that the death penalty can be an effective deterrent against specific crimes.”1 Whether the case be morally, monetarily, or just pure disagreement, citizens have argued the benefits of capital punishment. While we may all want murders off the street, the problem we come to face is that is capital punishment being used for vengeance or as a deterrent.
