Critical Incident Scenario The critical incident that I will be explaining about is regarding an eight-year-old girl currently a student at Victory Independent School District (VISD). This student wrote on her class journal that her uncle was touching her in her private parts when no one was watching. The teacher was so confused to what to do when he read Bianca’s journal, especially because he was wondering if it was appropriate for him to ask her questions about it. The teacher was concern that due to being a male that the student was going to feel uncomfortable if he were to ask her about what she had wrote in her journal. The teacher did know what to do and he was so confused because he was reading and grading the journals at home during the weekend. He continued reading Bianca’s journal and feeling more worried about his student's well being at home. The next day he got to school extra early to talk to the school counselor to know what exactly he could do or the school counselor could do for Bianca. He was so nervous because it was his first week of teaching at a school since he graduated from the University and he never expected to experience this situation at such an early point in his career. He spoke to the school counselor and explained her the situation. The teacher show the school counselor Bianca’s journal and the school counselor mentioned that they needed more information regarding the situation due to the journal being to short regarding the situation. The teacher mentioned that if she could speak to Bianca in private when she arrived at school and for her to ask her about the situation. A teacher’s most important duty is to protect the students they are in charge of. This duty includes both reasonably protecting students from harm and, when a student is harmed, reporting it to the proper authorities (Gooden, Eckes, Mead, McNeal, & Torres, 2013, pp. 103-109). There have been many court cases that reiterate this duty of school staff. One such case is Frugis v. Bracigliano (2003) where many staff at a school failed in their duty to protect students and allowed abuse to continue for years.
This case involves a sophomore at a high school named Christine Franklin, who alleged that she was sexually harassed and abused by a teacher and sports coach by the name of Andrew Hill. These allegations were occurring from 1986-1988, a total of two years. These allegations included Hill having explicit conversations with Franklin, forcing her to kiss him, and forceful intercourse on school grounds. Franklin claimed that she let teachers and administrators know about the harassment and that other students were going through the same harassment. The topic of this paper focuses on the battles school counselors face as the law and ethical standards collide. School counselors face a number of legal and ethical issues and recognizing a clear decision isn’t always easy. School counselors have to work with a large number of students, parents, and administrators while conforming to ethical codes, state laws, and school board guidelines. This topic is of great relevance to me as I will be going into the school counseling profession. It is also a meaningful topic to me because life-changing decisions are made every day in reference to legal and ethical issues. Researching this topic has shed some light on the difficulty for school counselors to fulfill both legal and ethical requirements. The main reason for this is that laws and ethical codes may sometimes provide differing and contradictory messages regarding the same subject. This can lead to legal ramifications, even while following ethical norms as we will look at in the example case of Woodlock v. Orange Ulster B.O.C.E.S. (2006/2008).
While working with Ana, she disclosed that her father had gotten extremely mad at her for getting a bad grade on her last math test; he hit her across the face, grabbed her arm, and yanked Ana to her room. Ana felt that she deserved it because it was her fault that she did not ask her teacher for extra time on her test. The Davis case will enable me to understand my rights as a student and the effects of sexual harassment in schools, as every individual should act professional and ethical in whatever they do. School counseling has evolved over the years into a significant component of the educational system. School counselors are taking on new roles in schools as leaders, working with “school administration and staff in developing student attitudes and behavior which are necessary to maintain proper control, acceptable standards of self-discipline and a suitable learning environment within the school” (Secondary School Counselor 2012). I am writing in response to the incident that occurred last Friday evening. Charles Henderson Middle School hosted a back to school dance on Friday, September 9, 2016, from 5:30 to 8:30. The DJ played WOP by J Dash as the last song of the night. During the song, some students began to dance on each other improperly. I, Ms. Williams, proceeded to separate the boys and girls from dancing inappropriately. As I started to separate the students I saw a male student reach over another student and touch a young lady’s bottom. Upon seeing the young man do this, I motioned for him to come to me. The Ethical Decision Making Model is an ethical guideline that is useful in ethical dilemmas and what course of action to take. It’s a framework that allows professionals to analyze and make ethical decisions to the best of their ability. It gives counselors a protocol to determine the appropriate course of action when faced difficult challenge. These decisions are taking into account; reflect a concern for the interests and the well-being of all clients concerns. Counselors should keep in mind the Golden Rule: “Do onto others as you would want onto you”.
At a young age, children are taught never to be disrespectful or disobey parents or elders. When they don’t show obedience to some authoritative figure, sometimes severe consequences can occur. Sexual harassment may be carried out by teachers, administrators, school staff and students. It is very important to know and understand the risks of sexual harassment in order to help prevent it and be there for those who have been personally affected. An example of sexual harassment could begin in elementary schools. As children develop sexually, they may become curious about their bodies, gender and sex. This could lead to many issues if not taught correctly. Many boys and girls may begin to talk about each other in unpleasant ways that are not always appropriate.
