Figuring out why people commit crimes is one of the central concerns of criminology. Do most criminals act rationally after weighing the costs of crime? Is society ever to blame for an individual to commit a crime? Do mental diseases or even genetics factor into whether a person will live a life of crime. Over the years, many people have developed theories to try to answer these questions. In fact, the number of theories of why people commit crimes sometimes seems to equal the number of criminologists. I explore these questions and much more in the paper that follow.
The foundation of classical criminology is its central belief that individual criminals engage in a process of rational decision making in choosing how to commit crime (Williams & McShane, 2010). This view is based on two further assumptions: that individuals have free will; and that individuals are guided by hedonism, the maximization of pleasure and the minimization of pain. These ideas were important in that they shifted attention towards punishing people’s offending behavior rather than punishing the individual’s social or physical characteristics in and of themselves. This shift consequently had an enormous influence on changing attitudes towards punishment and towards the purpose of the law and the legal system.
Classical ideas about crime and punishment can be found in the works of a number of different writers. The writings of Cesare Beccaria (1738–94) and Jeremy Bentham (1748–1832), however, were especially influential. It is hard for anyone to grasp the concept or be able to understand why people commit heinous crimes or engage in criminal activities. We as human beings are all capable of committing or engaging in delinquent behavior. What stands in the way of a person that makes them decided to engage in deviant behavior or to choose not to commit crimes at all? We may never truly know or understand the real reasons behind why certain people make decisions like these every day. Early philosophers and scientists looked carefully and dug deep into the criminal justice system and the behavior of criminals using theories to explain criminal behavior. With these views they were able to come up with multiple distinctive theories that explained different views on why people decided to commit crimes.
The central element of calculation involves a cost benefit analysis: Pleasure versus Pain, (5) Choice, with all other conditions equal, will be directed towards the maximization of individual pleasure, (6) Choice can be controlled through the perception and understanding of the potential pain or punishment that will follow an act judged to be in violation of the social good, the social contract, (7) The state is responsible for maintaining order and preserving the common good through a system of laws (this system is the embodiment of the social contract), (8) The Swiftness, Severity, and Certainty of punishment are the key elements in understanding a law's ability to control human behavior. They are punishable by the law and may be prosecuted by the state (Helfgott, 2008). There are different theories existing that try to explain the actions of criminals. They deeply explain what causes an individual to commit a criminal activity. This paper discusses some examples of the biological theories, social theories and psychological theories of crime.
Examining why people commit crimes can be quite difficult because there can be a million reasons as to why a individual would want to commit an illegal act. Some people are forced to commit a crime with justified reasons, some people commit petty crime as a way of survival and some people commit crime for self-assurance purposes.
Public criminology takes information, research and education to the next level, as discovered through this essay. It doesn’t just include lab work, research and discoveries, it involves community based teaching in a way that the public can be informed and educated through upfront communication. Crime exists everywhere. It is exists in our country, in the big cities, the small towns, schools, and even in homes. Crime is defined as “any action that is a violation of law”. These violations may be pending, but in order to at least lower the crime rate, an understanding of why the crimes are committed must first be sought. In conclusion it is shown through examinations of a average criminals biological makeup is often antagonized by a unsuitable environment can lead a person to crime. Often a criminal posses biological traits that are fertile soil for criminal behavior. Some peoples bodies react irrationally to a abnormal diet, and some people are born with criminal traits. But this alone does not explain their motivation for criminal behavior. It is the environment in which these people live in that release the potential form criminal behavior and make it a reality. There are many environmental factors that lead to a person committing a crime ranging from haw they were raised, what kind of role models they followed, to having a suitable victims almost asking to be victimized. The best way to solve criminal behavior is to find the source of the problem but this is a very complex issue and the cause of a act of crime cannot be put on one source.
The Law today is a summary of various principles from around the world from the past and the present. Early practises of law were the foundation of the law that we know and abide by today. These practises were referred to as the Classical school. Over time however, different criminologist have altered and greatly improved the early, incomplete ideas and made them more complete and practical to more modern times. This newer version is referred to as the Positivist school. This rapid change from the classical to the positivist perspective was due to the change and growth of civilization. Even though one perspective came from another, they are still different in many ways and it is evident when relating them to section 462.37, Forfeiture of Proceeds of Crime, and section 810, Sureties to keep the Peace. The Classical School of criminology’s time of dominance was between 1700 and 1800. Its conception of deviance was that deviance was a violation of the social contract. Classical theorists believed that all individuals were rational actors and they were able to act upon their own free will. A person chose to commit crimes because of greed and because they were evil. The primary instrument that could be used in regards to the classical school to control crime was to create “criminal sanctions that instil fear of punishment in those contemplating criminal acts” (Gabor 154). Punishing the unlawful, undesirable and deviant members of society is an aspect of criminal justice that has experienced a variety of transformations throughout history. Although the concept of retribution has remained a constant (the idea that the law breaker must somehow pay his/her debt to society), the methods used to enforce and achieve that retribution has changed a great deal. The growth and development of society, along with an underlying, perpetual fear of crime, are heavily linked to the use of vastly different forms of punishment that have ranged from public executions, forced labor, penal welfare and popular punitivism over the course of only a few hundred years. Crime constructs us as a society whilst society, simultaneously determines what is criminal. Since society is always changing, how we see crime and criminal behavior is changing, thus the way in which we punish those criminal behaviors changes.
Criminal justice is composed of many lateral departments that help us as a society to better understand the process that is started when criminal activity is suspected. We will examine how individuals learn how to commit crime and what motivates them to do so. This paper will discuss the steps that are taken once a crime is determine and how the Criminal Justice System is put into place to help solve and come to some type of resolution for the crime. The Classical School of Criminology generally refers to the work of social contract and utilitarian philosophers Cesare Beccaria and Jeremy Bentham during the enlightenment in the 18th century. The contributions of these philosophers regarding punishment still influence modern corrections today. Different schools of thought propose varying theoretical models of criminality. It is agreeable that criminal behaviour is deep rooted in societies and screams for attention. Biological, Social ecological and psychological model theories are key to helping researchers gain deeper comprehension of criminal behaviour and ways to avert them before they become a menace to society. All these theories put forward a multitude of factors on the outlooks on crime. All these theories have valid relevancy to continuous research on criminal behaviour.
