The premise of this research paper is to compare the similarities and differences in the criminal justice systems of the two nations Saudi Arabia and Japan. How they deal with the criminal offenses of murder, the distribution of illegal drugs and family violence. The next area Of concern will be the similarities of their criminal-justice systems, and their methods of enforcement, besides incarceration. The first country to be examined will be Saudi Arabia. The new Saudi Arabia dates back to 1926. However, the country is still governed by Shari’s law (the Islamic legal system). There is no formal constitution. The head of the family, husband/father has the obligation to discipline his family in whatever manner they choose. A female in Saudi is relegated to a less prominent position in their society. Men in Saudi while growing up is taught that abusing any woman is protected by law. Therefore, hitting an unruly woman was a solution to her disobedience. She cannot do anything but tolerate the abuse until she escapes this situation or be killed. This is an old tribal attitude that is ingrained in the man from birth. This draconian attitude still exists today, in the twenty-first century. The place of women in Saudi society is determined by a deeply conservative culture, vindicated by a narrow interpretation of religion, and enforced by law. That place it would appear is at home, subservient to and legally dependant on their male guardian. Saudi society suffers from pervasive segregation along gender lines and women's freedom of movement is impeded, forcing them to rely on male chaperons.
Domestic violence is a problem which affects women of all ages, and there is a high prevalence of young adult college women who are experiencing Intimate Partner Violence. Many of the domestic violence cases are reported, but many incidents are not known to anyone but the victim. It is a silent problem, but there are many women who seek help to overcome the indignities of being abused. Domestic violence can be examined on different levels of the Ecological Model (Bronfenbrenner 1979). The ecological theory involves four levels: (1) the societal level (macro system); (2) the community level (meso-system); (3) the relational level (micro system) (4) the individual level. The society level involves culture and social structure, and some examples would be the patriarch culture, social norms regarding acceptability of domestic violence and legal remedies. The community level involves the interrelationship between community and the social roles undertaken by individuals such as home, school, and work. The relational level includes interfamily interactions between spouse/partners and children that can include conflict, infidelity, and social isolation. The individual levels involves personal characteristics such as gender, (males are more associated with perpetration, female with victimization), gender role beliefs (traditional or non-traditional), alcohol use, employment or unemployment status of spouse/partners, and socio-economic status at the community, relational, and individual level (Klevins, 2007). Crimes punishable by the death sentence in Saudi Arabia include murder, serious attacks on the Islam religion, adultery, dress codes, and since 1987, drug smuggling. Under Saudi Arabian law, serious crimes merit serious consequences. Repeated theft is punishable by amputation of the right hand, administered under anesthetic. Because most meals in Saudi Arabia are eaten by hand from a communal bowl and only the right hand may touch the food, this punishment effectively bans the convicted thief from society. The severity of this punishment has led to a slight softening of the law in recent years; now if the thief repents and makes restitution before the case is brought before a judge, the punishment can be reduced... furthermore, the victim of the crime may demand payment rather than amputation of the thief’s right hand, and in some cases the victim is even permitted to parden the criminal. In a typical year at least ten hands amputations are carried out for repeated thievery in Saudi Arabia. (Goodwin, 1943) Today in the United States, crimes such as theft are punishable by jail sentence if they have more than one thievery act.
