Ever since human civilization came into existence, people have been putting rules in place to determine who is behaving according to social norms and moral values and who is not. Because the majority of Western societies have historically been democratic, it makes sense that the public have a say in the enforcement of said rules. It is for this reason that the trial became a popular means of deciding upon punishment for those perceived to have broken the law, while also allowing them an opportunity to testify against their charges. Socrates underwent this process in 399 BC on charges of impiety and corruption of the youth of Athens , as did Louis Riel in 1885 on charges of treason for leading a Métis rebellion . In spite of this, however, Socrates also uses two very obvious fallacies. Firstly, when addressing Meletus – who was among the individuals who accused him of impiety and corruption of the youth – Socrates misrepresents his argument to support his own position. He asks if Meletus is “not ashamed of [his] eagerness to possess as much wealth, reputation, and honours as possible, while [he does] not care for nor give thought to wisdom or truth, or the best possible state of [his] soul.” However, the two are not mutually exclusive. Caring about wealth, reputation, and honours do not necessarily entail not caring about wisdom and truth. This is quite a clear example of a straw man fallacy. In addition, Socrates uses appeal to emotion to attempt to manipulate the audience into thinking they are the ones doing wrong. He states that the people of Athens “will acquire the reputation and the guilt, in the eyes of those who want to denigrate the city, of having killed Socrates, a wise man. ” It is clear that by saying this, Socrates’ intention was merely to guilt-trip the audience. In Walter Mosley’s Always Outnumbered, Always Outgunned, the reader is introduced to Socrates Fortlow, an ex-convict who served twenty-seven years for murder and rape. Fortlow is plagued by guilt and, seeing the chaos in his town, feels a need to improve not only his own standards of living, but also those of others in Watts. He attempts this by teaching the people in Watts the lessons he feels will resolve the many challenges the neighbourhood faces. The lessons Fortlow teaches and the methods by which he teaches them are very similar to those of the ancient Greek philosopher for whom Fortlow was named: “‘We was poor and country. My mother couldn’t afford school so she figured that if she named me after somebody smart then maybe I’d get smart’” (Mosley, 44). Though the ancient Greek was born to be a philosopher and Fortlow assumed the philosopher role as a response to the poor state of his life and Watts, both resulted in the same required instruction to their populations. The two Socrates’ both utilize a form of teaching that requires their pupil to become engaged in the lesson. They emphasize ethics, logic, and knowledge in their instruction, and place importance on epistemology and definitions because they feel a problem cannot be solved if one does not first know what it is. Socrates was essential in first introducing these concepts to the world and seemed to be born with them inherent to his being, Fortlow has learned the ideals through life experience and is a real-world application in an area that needs the teachings to get on track. Socrates then questions him again about whether or not he alleges that he corrupts the youth intentionally or unintentionally. Meletus’ reply was that he does intentionally. Living in a democracy, everyone is exposed through television and other various forms of media everyday to numerous trials by jury. Usually they are rarely given a second thought, but every once in a while along comes a specific trial which captures the attention of the entire country. This goes the same for trials throughout centuries in our past. Although they did not have the same forms of media as in this, modern era, there were still specific trials in which everyone knew about. One trial that stands out is the one against the great philosopher Socrates. Accused of corrupting the youth, being an atheist, and believing in other gods, Socrates faced trial by jury. The early forms of democracy were not as sophisticated and complex as they are now. The outcome of the trial was that Socrates was found guilty and sentenced to be put to death by hemlock poisoning. The question is whether Socrates was truly guilty or just another person fallen to the early form of democracy of a people who were possibly jealous and afraid of Socrates. However, by understanding Socrates intentions, it is clear that he was in fact innocent of the above charges, and was wrongly accused and executed.
In Plato’s Apology, when Socrates is pleading his defence, he makes a good argument against the charges of corrupting the youth of Athens. This is evident when he states that, firstly, Meletus, the man who is trying to get Socrates executed, has never cared about the youth of Athens and has no real knowledge on the subject. Secondly, Socrates states that if he was in some way corrupting the youth, then he was doing it unintentionally or unwillingly, in which case he was brought to court for no reason. Finally, Socrates brings to light the fact that Meletus doesn’t have a single witness to attest to Socrates’ corruption. This is how Socrates proves his argument that he isn’t responsible for corrupting the youth of Athens.

The Apology is Socrates' defense at his trial. As the dialogue begins, Socrates notes that his accusers have cautioned the jury against Socrates' eloquence, according to Socrates, the difference between him and his accusers is that Socrates speaks the truth. Socrates distinguished two groups of accusers: the earlier and the later accusers. The earlier group is the hardest to defend against, since they do not appear in court. He is all so accused of being a Sophist: that he is a teacher and takes money for his teaching. He attempts to explain why he has attracted such a reputation. The oracle was asked if anyone was wiser than Socrates was. The answer was no, there was no man wiser. Socrates cannot believe this oracle, so he sets out to disprove it by finding someone who is wiser. He goes to a politician, who is thought wise by him self and others. Socrates does not think this man to be wise and tells him so. As a consequence, the politician hated Socrates, as did others who heard the questioning. "I am better off, because while he knows nothing but thinks that he knows, I neither know nor think that I know" (Socrates). He questioned politicians, poets, and artisans. He finds that the poets do not write from wisdom, but by genius and inspiration. Meletus charges Socrates with being "a doer of evil, and corrupter of the youth, and he does not believe in the gods of the State, and has other new divinities of his own."

A. Under trial for corrupting youth and not worshiping the Gods in Athens, Socrates takes an attitude that many might interpret as pompous during his trial. Rather than apologise, as Plato’s dialogue title Apology suggests, Socrates explains why he is right and those who accused him are mistaken. He speaks in a plain manner, as if the jury is just another of his followers. Socrates first cites the profit at Delphi for why he behaves in ways that lead to him being under scrutiny of the law. He explains that his friend, Chaerephon, went to ask the oracle if anyone is wiser than Socrates and the oracle responded no (21a). Socrates starts his defense by addressing the jury and telling them that his accusers had a prepared speech, while Socrates' speech will be completely improvised. Socrates continued to further disassociate himself from the opponents by telling the jury to forgive him for his conversational tone in his speech, for that's how he best speaks. He also asks the jury to keep an open mind and not concentrate on how his defense is delivered, but the substance of his defense. Socrates tells the jury that he is not a sophist. Sophists were known for charging fees for their work, and Socrates does not charge a fee for his words. His next decides to cross-examine Meletus. Basically Socrates turns the tables on his accuser and accuses Meletus of "dealing frivolously with serious matters." Socrates says that the youth he supposedly corrupts follows him around on their own free will, because the young men enjoy hearing people and things being questioned. In the Apology, Socrates examines the charges brought against him by Meletus and tries to prove that they are false. The first charge brought against him is that he was corrupting the youth. Socrates responds to this by asking Meletus in his opinion, how Socrates was corrupting the youth. Meletus says that Socrates was teaching the youth to go against the government. Socrates asks if there was anyone who was beneficial for the youth. Meletus says that the council, jury, assembly, even the general public was beneficial to the youth and that Socrates was the only person corrupting them. Socrates claims that it was impossible for the one person to be capable of corrupting the youth when they had so many to show them in the right direction.
Even though Socrates was tried for invalid reasons before a jury likely ready to convict him already, it is argued he could have persuaded the jury to realize his innocents, yet he did not. One of the last lessons Socrates left upon the world was proof that even if the masses all agree to something, it does not make it true. While the majority of the jury found him guilty, it is clear he was not and the majority of people believing something to be true, does not make it true.
Socrates was a philosopher who set out to prove, to the gods, that he wasn't the wisest man. Since he could not afford a "good" Sophist teacher, surely a student of one had to be smarter than he. Likewise, Plato’s philosopher king also uses the same concept but calls it “Justice” or “Good.” Similarly, to Machiavelli, who needs his Prince to have virtù to lead the people, Plato necessitates that his king use philosophical knowledge and emphasize justice to guide the unenlightened masses towards a just and stable society as well. When Socrates discusses the allegory of the cave, he remarks how when rulers must descend “to the general underground abode” where the masses “reside,” the ruler “will see a thousand times better than [the inhabitants of the cave]…because [the ruler has] seen the truth about things admirable and just and good” (Plato 520c). Plato believes that by seeing beyond the cave, and understanding the situation he exists in, the leader will have the appropriate ability to bring foresight and intelligence when making difficult decisions. While Plato’s and Machiavelli’s means of educating, changing and legitimizing political communities differ, the two philosophers share the same goal of using the benevolent dictators’ attained knowledge to lead the masses and their governments to prosperity and good fortune.
Socrates thought is that a rhapsode speaks not from knowledge but from inspiration, his thoughts being ‘breathed into’ him without the use of his own understanding at all. Using the analogy of a magnet, with the power to draw one rhapsode ring to itself, and through that another, and another, Socrates says that Homer himself had no knowledge of his own writing his poetry, but was divinely possessed. Every rhapsodes are also divinely possessed both when they recite poetry and when they speak. Their work, is the product of the gods working throught them, not of any human intelligence and skill.
