When discussing who the English justice system favoured in the early modern period it is important to remember that first and foremost, the justice system was there to keep social order. As a result, we can suggest that the justice system was weighted in favour of keeping this order and aspects of the system were in favour of the criminal or victim is merely circumstantial. As the Early Modern period was one of such fast-paced change it is hardly surprising that the justice system would come down so hard on criminality that would threaten the increasingly dwindling peace. A defining feature of the early modern justice system was that its punishments were reactionary and served to form as deterrence for the crime. Punishments were reactionary to a crime meaning that while there was a victim to the crime, the system was supposed to ensure that there would be no more victims of the crime not to aid the existing victim. With this concept in mind, we can argue that the early modern justice system gave favour to the pursuit of social control rather than the placating of the victim. Walker notes that “The concept of lawfulness and order to which the people adhered to was the result of (what Sharpe calls) ‘the permeation of the law into the wider culture ’” . During the previous lesson, students were introduced to individuals such as Charlemagne, and were able to create a presentation, ad or speech either for or against that person. As a result of the previous lesson, students will be able to understand the significance war had on the memory of historical figures. Between the years of 1714 and 1799 the rate of theft in London increased for many reasons. The method of research use to prove this hypothesis was Old Bailey online. Old Bailey is a court in the city of London in the county of Middlesex. The court is held eight times a year for the trial of prisoners; the crimes tried in this court are high and petty treason, petty larceny, murder, felony, burglary, etc. The goal of this paper is to prove that not only did theft increase, but also why it increased. My preliminary findings suggest that overall theft did increase, and that the main causes for this were: political, economical, and social problems.
In the United States, jury trials are an important part of our court system. We rely heavily on the jury to decide the fate of the accused. We don’t give a second thought to having a jury trial now, but they were not always the ‘norm’.
The criminal justice system has been evolving since the first colonists came to America. At first, the colonists used a criminal justice system that mirrored those in England, France, and Holland. Slowly the French and Dutch influences faded away leaving what was considered the English common law system. The common law system was nothing more than a set of rules used to solve problems within the communities. This system was not based on laws or codes, but simply that of previous decisions handed down by judges. Although rudimentary, this common law system did make the distinction between misdemeanors and the more serious crimes known as felonies.
The individuals within our society have allowed the people to assess and measure the level of focus and implementation of our justice system to remedy the modern day crime which conflicts with the very existence of our social order. Enlightening us to the devices that will further, establish the order of our society, reside in our ability to observe the Individual’s rights for public order. The governance of our present day public and social order co-exist within the present day individual. Attempts to recognize the essentiality of equality in hopes of achieving an imaginable notion of structure and order, has led evidence-based practitioners such as Herbert Packer to approach crime and the criminal justice system through due process and crime control. A system where packers believed in which ones rights are not to be infringed, defrauded or abused was to be considered to be the ideal for procedural fairness.

Capital punishment is a declining institution as the twentieth century nears its end. At one time capital punishment was a common worldwide practice, but now it is only used for serious violation of laws in 100 of the world's 180 nations (Haines 3 ). It can be traced back to the earliest forms of civilization. The origins of the movement away from capital punishment are difficult to date precisely. The abolition movement can be heard as early as the religious sermons of the Quakers in the 1640's (Masur 4). In the seventeenth century, the Anglo-American world began to rely less on public executions and more in favor of private punishments. The possible decline in popularity of the capital punsihment system is directly related to the many controversial issues it entails such as: the questions of deterrence, morals and ethics, constitutionality, and economics.
"Today's system, where imprisonment is a common penalty for most crimes, is a historical newcomer." Many crimes during 1718 and 1776 were punishable by death. This was usually done by hanging, sometimes by stoning, breaking on the rack and burning at the stake. Towards the end of the 1700's people realized that cruel punishment did little to reduce crime and their society was changing the population grew and people started to move around more frequently. There had to be a search for new punishments. "New punishments were to rely heavily on new ideas imported from Europe in the writing of such social thinkers of the Enlightenment as the baron de Montesquieu, Voltaire, Thomas Pain and Cesare Beccaria". These thinkers came to believe that criminals could be rehabilitated."

Punishing the unlawful, undesirable and deviant members of society is an aspect of criminal justice that has experienced a variety of transformations throughout history. Although the concept of retribution has remained a constant (the idea that the law breaker must somehow pay his/her debt to society), the methods used to enforce and achieve that retribution has changed a great deal. The growth and development of society along with an underlying, perpetual fear of crime are heavily linked to the use of vastly different forms of punishment that have ranged from public executions, forced labor, penal welfarism and popular punitivism over the course of only a few hundred years.
The Classical School of Criminology generally refers to the work of social contract and utilitarian philosophers Cesare Beccaria and Jeremy Bentham during the enlightenment in the 18th century. Philosophers believe that punishment is a necessity in today’s modern society as it is a worldwide response to crime and violence. Friedrich Nietzche’s book “Punishment and Rehabilitation” reiterates that “punishment makes us into who we are; it creates in us a sense of responsibility and the ability to take and release our social obligations” (Blue, Naden, 2001). Immanuel Kant believes that if an individual commits a crime then punishment should be inflicted upon that individual for the crime committed.
