On June 26, 2009, the Supreme Court of British Columbia held that the Chilliwack School District was responsible for the injuries sustained by Devon Hussack, a 7TH grade student playing field hockey in his Physical Education class. The court found that the physical education teacher didn’t meet the standard of care as the student didn’t have any experience in the sport and was not taught at all how to play this particular sport. The student sued the school district for carelessly failing to teach and coach him the necessary skills to play field hockey. Because of this, the student argued that the school didn’t protect him from being struck in the face by another student’s stick during the course of a game. A few weeks after the injury, Devon
complained of weakness, tiredness, altered concentration, sleep disruption and mild photophobia. The school district argued that it had met the standard of care in instructing and directing the student in PE class. In addition, the school district argued that even if the teacher did fall below the standard of care, the student’s level of dysfunction and somatoform illness were not caused by the accident and occurred because of his preexisting conditions. The court found that the dysfunctional family dynamic made Devon more vulnerable to mental damage resulting from the physical injury sustained in the field hockey game. However, this did not argue or overlook the school’s accountability. As a result, Devon was awarded $1,365,000 in damages. I agree with the outcome of this court case. The school should have been aware that Devon had conditions that required either more instructions or absence from playing field hockey. If the school was aware of this, Devon most likely would not have sustained an injury. In the future, school needs to be more cognizant of students who have special conditions and require more attention.

St. Louis Hockey Club, L.P. was a personal injury case filed on March 17, 1998, in which the plaintiff claimed that the defendant club was vicariously liable for their employee’s actions that caused the plaintiff’s injury. The injury in question occurred in Peoria, Illinois during an IHL game on December 15, 1990 between the Peoria Rivermen and the Milwaukee Admirals. While the St. Louis Hockey Club technically wasn’t playing in the game, they can be held liable for the injury, as the Peoria Rivermen are a subsidiary of the club. During the third period of said game, the defendant, Stephen McKichan, a goalie for the Admirals, was both injured and rend unconscious by a body-check from a Peoria player. This body-check occurred after play was stopped due to the hockey puck floating out-of-bounds. Also, the defendant player ‘s body-check had occurred after the referee had blown his whistle twice to signal the play stoppage. Fraser's father brought action against the school board in the United States District Court for the Western District of Washington. He alleged the suspension and punishment were a violation of his son's First Amendment right to freedom of speech. The father sought injunctive and monetary damages under 42 U.S.C. of 1983. The district court awarded the student $278 in damages, $12,750 in litigation costs and attorney's fees, and ordered the school district not to prevent the student from speaking at the commencement ceremonies.

It was a 1986 case involving a seniors, Matthew Fraser, campaign speech at school that used “sexually suggestive comments and gestures” which created an uproar in the audience (Lusted, Marcia Amidon, and Gerald T. Thain 126). Fraser was suspended for several days and was not allowed to speak at commencement therefore he made the decision to sue the school district since he felt his First Amendment was violated (Lusted, Marcia Amidon, and Gerald T. Thain 126). He was voted against seven to two because he used vulgar language which is not allowed in schools (Lusted, Marcia Amidon, and Gerald T. Thain 126). It has been said for years that any case of educational malpractice was doomed from the start. Because of this, it was a huge surprise when the Iowa Supreme Court denied the defendant, Cedar Rapids Community School District’s motion for summary judgement. This was a case where a student sued for negligent misrepresentation by a school guidance counselor. One reason why the court may have denied the motion was because it was trying to protect a category of people who were considered especially vulnerable, the student-athlete.

People earn these things by their performance.”.” In the same fashion that not all actors can be the star role in a play or movie or gets to be the lead singer in a band, not everyone gets to be the starting forward or pitcher. Some players are not fit to play some positions just based on natural abilities, and if the coach gives the same amount of time on the field or court for these positions, the game’s competitiveness, moral, and enjoyment is destroyed. Finally, Dr. Alan Goldberg, who travels across the nation to help coaches learn and teach young athletes, describes, “The really maddening, discouraging and frustrating thing for kids and their parents is watching the coach's favorites put in minimal or inconsistent effort into practice, perform poorly in games and still get more playing time from the coach”..”
Parents in the U.S. today are becoming too involved in youth sports and are getting out of control. In the July 24, 2000 issue of Sports Illustrated, there is an article by William Nack and Lester Munson about a father in Massachusetts who killed another father over a little dispute about youth hockey. On July 5, 2000 Thomas Junta, a father of two, got into what seemed to be a minor shoving match with Michael Costin, a father of four, over a play in a hockey practice. After a while the fight was broken up and Junta left the ice arena. A little while later Junta returned with "clenched fists" and pinned Costin to the ground. With Costin's children standing just a few feet away and pleading with Junta to stop, Junta pummeled Costin with punches to the face and slammed Costin's head into the hard rubber mats that covered the floor. By the time someone was able to pull Junta off of him, Costin's face was so badly beaten that even his own children could barely recognized him. Costin was left in a coma and died two days later. Detroit is a story of a once flourishing city that has been on a long downslide for decades. There are miles of unoccupied homes and buildings, and crimes and unemployment are at an all-time high. Many aspects of the city are breaking down, including the school system. The Detroit Public School System has lost over eighty thousand students due to high enrollment in charter schools, the large economic decline, and the departure of residents. For many years no one has taken responsibility for the public school system. However, for Detroit to rise again, it is necessary for someone to take responsibility, make a plan, and make sure that children are safe, well cared for, and are receiving a high quality education when going to school each day. In 2016, schools are low-performing with poor test scores, are falling apart, and teachers and parents have decided to take a stand.

Texas is best known for its individualistic subculture, but that individualism has led to a downfall in the educational system affecting all students in Texas. There are many reasons as to why this problem is still being currently seen, and one of the biggest reasons is inadequate funding. Although, inadequate funding is one of the biggest problems, gaps in the educational system will not be solved simply by providing more funding, instead a new system must be created. This new system should be one that speaks to more students, provides quality education by having better teachers and most importantly, students should have a closer one on one with teachers instead of being overcrowded in classrooms.

Opposition of mandatory Physical Education in high schools believe that if a student has not developed a desire for voluntary physical exercise by the time he or she reaches high school , he or she may not ever (Eberhardt). It is true that individuals should not be forced into something they don’t want to participate in, but if these students don’t get any exercise outside of school, where will they receive an appropriate amount of fitness? Paul Eberhardt, athletic director, intramural director and head coach of the McNair Marlins basketball team in Richmond, B.C., believes “that students don’t care about participating in P.E. anymore and we have to educate students on the benefits of Physical Education”. In the 1994-1995 school year there were 1,133 students enrolled at McNair High School but there were only four P.E. classes available, which meant approximately 120 students attended in these classes. The remaining 1013 grade eleven and twelve students had no Physical Education at all.
