(Cheeseman2013) In the National Labor Relation Board v Shop Rite Foods case some employees of Shop Rite Foods of Texas elected a worker union as a Bargaining agent for a collective bargaining agreement for over 3 months the agreement was still not settled. Then ShopRite began to notice a lot of it merchandise being damaged in the warehouse. They determined that the damage was being intentionally being caused by dissident employees as a pressure tactic to secure concessions from the company in the collective bargaining negotiations. Then one day a Shop Rite Manager observed an employee in the flour section of the warehouse. This employee had no business being there, making quick gestures with his hands. The manager found several bags of flour
had been cut. The Shop Rite Manager on the spot fired the employee. Then another employee would rally roughly about 30 others in an immediate walk out the company fire all the employees who walked out and it refused to rehire them back. Although the fire employees file a grievance with the National Labor Relation Board (Cheeseman2013) The strike was illegal because under illegal strikes. The employees actions of damaging property of the employer are consider a violent strike. Those strikes are illegal, and employees who engage in such strikes lose the protection of the National Labor Relation Act. The employees did not act ethical in this case. ShopRite did act approperly taking actions against the employees for their actions participating in a strike and acting on their own without the union’s authorization and against the union bargaining position.
In Deenu Parmar's "Labouring the Wal Mart Way," the author discusses the business practices of Wal Mart, their impact on systemic poverty, and on existing work unions. Their business model forces competition to align with them, or close up shop. Wal Mart hires workers that would usually have a difficult time finding employment. According to the court case on Pam Huber v. Wal-Mart Stores, Inc., I am in agreement with the fact that the “district court granted summary judgment in favor of Huber” (Morgan, p.413) and that Wal-Mart gave Pam Huber, a maintenance associated job due to her disability. In doing so, I am also in agreement with the fact that Wal-Mart did not breach the American with Disability Act of 1990 due to the fact that Wal-Mart specifically stated what was required of Pam Huber to do on the job. Due to that, I am in agreement with Wal-Mart’s decision to hire a capable candidate in replace of Pam Huber due to their policy.
One of the issues in the case EEOC v. Target Corp. is that the EEOC alleged that Target violated the Title VII of the Civil Rights Act of 1964 by engaging in race discrimination against African-American applicants who were interested in management positions. It is argued that Target did not give the opportunity to schedule an interview to plaintiffs, Kalisha White, Ralpheal Edgeston and Cherise Brown-Easley, because of racial discrimination. On the other hand, it argues that Target is in violation of the Act because the company failed to retain and present records that would determine if there was reason to believe that an unlawful practice had been committed.

Today Walmart has gotten a different, darker reputation. On the surface, Walmart may seem like the solution to everyday issues. Low-income families are attracted to the low prices, and people who work odd hours benefit greatly from the 24 hours a day that many Walmarts are open. In 1897 Sebastian Spering Kresge opened five-dime stores in Memphis and Detroit with John McCrorey as his partner. Two years later the partnership broke up and each person kept one city. Mr. Kresge kept the Detroit store and began expanding from there onward. In 1912 the company became incorporated as S.S. Kresge and was the 2nd largest dime store chain with 85 stores and annual sales of more than $10 million. In 1918 S.S Kresge was listed on the New York Stock Exchange. Throughout the decades, Kresge rapidly expanded eventually opening the first Kmart store in 1962 in Garden City, Michigan. By 1966 there were more 160 Kmart stores in the US and Canada. In 1968 Kmart began airing TV commercials. In the 1970s, Kmart continued to expand opening 270 stores in 1976 alone. In 1977, S.S. Kresge changed its name to Kmart because 95% of its sales were coming from that branch. In the 1980s and early 90s, Kmart diversified by adding other retailers such as Walden Book Company which was the number one bookstore chain in the US. The Sports Authority in 1990, 90% stake in OfficeMax and the Borders bookstore in 1992. Also in 1990 Kmart opened its first Kmart Super Center in Medina, Ohio. Whatever was left of the Kresge locations in the US was sold to S.S. Kresge's former partner's store chain McCrory's. Between 1994 and 1995 earnings began to fall for Kmart causing them to sell off their other operations, OfficeMax, The Sports Authority, PACE, Borders and its US automotive service Centers. Sam Walton, who first purchased a branch of the Ben Franklin Stores from the Butler Brothers, founded Wal-Mart. When he took over this franchise, his marketing strategy was the same and remains the same: selling products at low prices. By selling products at low prices, he is able to get higher-volume sales at a lower-profit margin. To make the lowest prices possible, he found suppliers that charged a lower price than the other stores nearby. This continues to be a primary strategy that induced Wal-Mart to currently being the largest retailer in the world. If one asks each of these store’s customers why they shop there, somewhere in their answer one will find them saying that they can find everything. The difference between these two corporations is their mission, marketing, and quality. Each of these stores are looking to offer a different experience despite selling similar goods. So, when profits are not changing in the United States, they’ve opted for an expansion into other countries. They have opened stores and provided services outside of the United States.

When Sam Walton founded Walmart in 1962 I’m sure he didn’t expect it to become as big of a retail store as it is now. 42 years after being founded, Walmart now has 4,253 stores across the world, and brings in $405 billion dollars a year.
