2.Facts: This case was originally presented before the district court of Colorado in 1993 on behalf of the parents of Gregory Urban, a seventeen-year-old teen with severe mental disabilities. Gregory and his parents moved to Evergreen, Colorado in 1991. The parents wanted Gregory to go to Evergreen High School but the school district placed him at Golden High School where he participated in support services for children with severe disabilities. The support services at Golden High School were not available at Evergreen High. After the development of Gregory’s IEP his parents voiced objections to what they believed constituted violations of Gregory’s right to a free and appropriate public education. These violations included placement of Gregory outside his neighborhood school and failure to stipulate transition services in his IEP. After initially participating in the IDEA administrative process the parents filed a case with the district court claiming the school district violated Gregory’s rights under IDEA and ADA. Marvin Pickering was a science high school teacher in Will County, Illinois. Pickering was dismissed from his job after he wrote a letter to the editor of the local paper, Lockport Harold. The letter was sarcastically criticizing the way his superintendent and school board raised and spent funds. Antwone serves as a Petty Officer in the United States Navy. He is single and heterosexual, with no children. Antwone was referred to the U.S. Navy Pacific Fleet Medical Center for psychiatric evaluation, after pleading guilty to assault on a superior, non-commissioned officer. As a result of his physical aggression, he was demoted from ships serviceman Petty Officer, third class, to ships serviceman Seaman. Antwone has a history of physical aggression and poor impulse control. Antwone was referred for three sessions of psychiatry service for assessment of physical aggression, anger management, and supportive treatment. At the end of treatment, a recommendation by Dr. Davenport will be submitted to Antwone’s commanding officer, for the purpose of determining reinstatement to active duty. Antwone sees no need for evaluation and states that the cause of physical assault was a result of racial remarks by the victim. Antwone’s attitude towards fighting is stated in his words, “It’s the only way some people learn.”
General education high school teacher, Michael Withers, failed to comply with his student’s Individual Education Plan (IEP). D.D. Doe’s IEP required tests to be read orally. Despite knowledge of this IEP and being instructed to follow the IEP by the superintendent, school principal, special education director, and special education teacher, Withers still refused to make the accommodations for D.D.’s handicapping condition. As a result, D.D. failed the history class. His parents filed charges against Withers, arguing that D.D was not afforded the right to a Free and Appropriate Public Education (FAPE) promised to all students by the Individuals with Disabilities Education Act (IDEA). They also filed a claim for injuctive relief against the Taylor County Board of Education to enforce the laws that protect handicapped students.
The issues involved in Kevin’s case starts with his family values. Kevin seems to thrive on the attention he’s getting from his peers during school. The problem is its negative attention because it’s encouraging him to engage in negative behaviors during class. Kevin is narcissistic he feels as if he’s above the rules at school and in a way, he is because his parents have been preventing him from receiving consequences for his behaviors. Kevin’s parents are enabling these negative behaviors by defending him.
The primary diagnosis for Amanda Anderson is separation anxiety disorder (SAD) with a co-morbidity of school phobia. Separation anxiety disorder is commonly the precursor to school phobia, which is “one of the two most common anxiety disorders to occur during childhood, and is found in about 4% to 10% of all children” (Mash & Wolfe, 2010, p. 198). Amanda is a seven-year-old girl and her anxiety significantly affects her social life. Based on the case study, Amanda’s father informs the therapist that Amanda is extremely dependent on her mother and she is unenthusiastic when separated from her mother. Amanda was sitting on her mother’s lap when the therapist walked in the room to take Amanda in her office for an interview (Morgan, 1999, p. 1).
The case study of Angela and Adam describes a situation in which a Caucasian teenage mother, Angela, does not appear to have a bond with her 11 month old son, Adam. According to Broderick and Blewitt (2015) Angela and Adam live in the home with Angela’s mother, Sarah. Angela’s relationship with her own mother is described as a bit dysfunctional as Sarah is reported to continue to be angry with Angela for becoming pregnant in the first place. Sarah’s anger has caused her to deny Adam’s father the ability to come to the home and play an active role in Adam’s life, therefore putting more of a strain on Angela who has already had to drop out of high school in attempt to take care of Adam on her own. Jimmy’s school is a special kind of school where it is not a typical K-12 school setting, the school runs its course for the student until the student becomes 21 years of age. Schools, nor any other institution that will be providing education cannot refuse to give your/any child the service needed because it costs too much. The Federal Law, IDEA requires school to provide the services a child needs to gain a Free Appropriate Public Education (FAPE). Free Appropriate Public Education (FAPE) means at no cost to the parents. According to Altshuler and Kopels (2003), Advocating in Schools for Children with Disabilities: What’s New with IDEA?” States that it is mandated a variety of legal rights to have a free and appropriate public education provided in the least restrictive area/environment. For this reason parents are their children’s best advocates. Parents know their children better than anyone else. No matter the circumstances a parent sees all the flaw and potential at home that a teacher or administrator will never see.
There are several policies that may affect Jacob’s case. Jacob’s experience in school is influenced by the Individuals with Disabilities Education Improvement Act (PL 94-142 Reauthorized), which started as Education of All Handicapped Children Act PL 94-142 in 1975 and was revised in 1990, 1997 and mostly recently in 2004 (Frey, Mandleawitz, Perry, and Walker, 2016).
