Background: On April 9, 2018 at approximately 16:55 AM I, Investigator James Poffel was listening to my police radio and heard Officer Donnie Cox request to speak with an investigator in reference to the call he was out on. I advised I would call him. As I made contact with Officer Cox, he informed me he was dispatched to 1650 Baltimore St. Muskogee, OK in reference to assisting Muskogee County EMS with an unresponsive infant. Officer Cox informed me, upon his arrival there was a two-month-old child, Jack Newbury, had become unresponsive and was being further transported by EMS to the hospital in Muskogee. Officer Taylor Mills followed EMS to the hospital. The residence where this incident occurred is a home daycare, approved and certified by the Department of Human Services. …show more content…
Officer Cox stated he spoke with Christine and James Roberts, who run the daycare and that he had them started on writing statements.
He also spoke with EMT, Jordan Steven’s, and was getting a statement from him as well. Officer Cox asked what else he needed to do at this point. I told him I would be en route to his location. However, since this was a child death, he needs to contact DHS for a joint response. DHS would need to send out someone from daycare licensing and a child protective services worker. Officer Cox left the scene before my arrival to go to the hospital to stand by with the baby. Officer Jody Standridge remained at the scene while Cox went to the hospital. Police: Christine Roberts stated the following in her written statement: • Christine placed Jack in his pack-n-play to take his afternoon nap around 1:00 PM. • Christine placed him in the pack-n-play on his back and everything was fine. • Christine checked on Jack every 15 minutes, “he looked fine”. • Christine’s husband James checked on Jack around 2:35 PM and again stated “he didn’t observe any problems”. • At around 3:00 PM, Christine checked on him and noticed he was on a “little on his side”. She went to adjust him back to the center of the pack-n-play. • Jack’s face and chest was red and he was unresponsive. • Christine yelled for James. • James took Jack out of the pack-n-play and began CPR. • Christine called 911. James Roberts Statement to Police: James Robert stated the following in his written statement to police: • James came home around 2:10 PM from a track meet at Hilldale High School. • James ate when he got home. • The other children present were being loud, so he went to check on Jack who was sleeping in a pack-n-play in the front bedroom. It was around 2:30 PM. • James stated Jack was asleep on his back and everything appeared fine. • James stated Christine went to check on Jack around 3:00 PM and found him discolored and unresponsive. • Christine called to James and he immediately grabbed Jack and began CPR, until EMS arrived. Jordan Steven’s Statement: Jordan told Officer Cox that when he arrived and first made contact with the child that the infant was already deceased. He stated that Lividity and rigor was already present. Jordan was the one who rushed the child to the ambulance. However, he knew from his training and experience that Jack could not be revived at that point. Jack’s Parents, Heather and Devon Newbury: Both, Heather and Devon were at work and contacted separately. They were advised that something had happened with Jack at daycare and they were needed at St. Francis Hospital in Muskogee. Neither parent was informed at this point of what occurred because we wanted to ensure they arrived to the hospital safely. Once both parents had arrived at the hospital, Dr. Russell Anderson notified the family that Jack had been pronounced dead. Photographs of the Daycare: I spoke with Christine and explained to her that I would need to look around her house and photograph her house for the purpose of the investigation. I informed her there are two ways in which we can do that, first being consent, second being a search warrant. I told her I know this is a lot to process right now. I asked her if she would be willing to allow me to search her house, take photographs and collect anything necessary. She said she would be willing to sign a consent form. She then signed the form. I photographs the house and the location of the pack-n-play. The only thing that was in the pack-n-play was a brown fitted pack-n-play sheet. I collected the fitted sheet, as well as Jack’s diaper bag. Photographs of Jack at the Hospital: I then left 1650 Baltimore and drove to the hospital to photograph the deceased infant. I made contact at St. Francis Hospital and they took me to the room where he was located. I spoke briefly with Dr. Anderson. Dr. Anderson informed me that the medical examiner was coming out and would be here within the hour. I took photographs of Jack and what I could see without disturbing the body. Once the medical examiner arrived, I took more thorough photographs of Jack and his body. Lividity was present, as well as rigormortis. I did not observe any bruising or petechial hemorrhaging that would have been consistent with foul play. Medical Examiner’s Autopsy and Information: I contacted the Medical Examiner’s Office and spoke with Dr. Lester about the autopsy. Dr. Lester stated his official report would not be concluded until the toxicology screening comes back in 4-6 weeks. However, he stated he did not observe any injuries that would have been consistent with foul play. On 01/30/16 I arrived at 3810 Driskill Drive in reference to a disturbance involving a North Little Rock police officer. Upon arrival I made contact with the complainant, Aimee Stepp. Mrs. Stepp said that her daughter, Katherine Kuykendall, and her ex-husband, Terry Kuykendall, had been in a physical altercation and that she, Mrs. Stepp, had an audio recording of the event on her cellular telephone. Mrs. Stepp also stated that her daughter had just sent her a text message stating that she was ok.

On Friday, 09/23/2016, at approximately 0830 hours, I, Deputy Stacy Stark #1815 met with the reporting party, James R. Boucher (M/W, DOB: 07/25/1959) at the Jackson County Sheriff’s Office. I requested James R. Boucher to come to the Jackson County Sheriff’s Office to review the Wal-Mart video footage I collected and identify the suspect, James Roy Boucher (M/W, DOB: 03/16/1978) on the video footage.
The reporting party (RP) called to state that referral #0029-4712-0498-0086169 dated 7/14/16 contained information regarding foster child Veronica Victoria Gonzalez DOB: 12/03/02. The initial information received stated foster child Veronica Gonzalez did not need to be interviewed due to not being in the home during the incident on 6/2/16, however the foster child had been placed in the home since 3/2016. Therefore the child was living in the foster home at the time of the foster father Lafayette Lundy's arrest on 6/2/16. Deputy Valez, 516593, Century SS, 11703 S. I arrived on scene and was hailed down by Ryan Lammers (a witness and the RP) who was in the front yard with the victim Shawn Lammers (his brother). They were both dressed in night/sweat clothes and were cold from being in the cold air. Ryan was in sleeveless sweat shirt and wearing an arm immobilizer talking on the phone to JeffCom. He hung up and told me what had happened while he was there.
On Saturday 12/10/2016 at about 2210 hours, I, Officer Steven Evans responded to a dispatched call (51D) Disorderly Patient in E.D. for room #40 and this was Security third call tonight for this room. The patient, Debra Lynn Bolger (DOB: 06/28/58–Fin #86564069), once again had gotten out of her room and walked over to the nurses’ station in violent and threatening manner. Patient Bolger knocked down a Laptop that was on the desk next to the Nurse. Upon arrival, at 2211 hours I observed the patient agitated in her room and Nurse Jacquelyn Vaninguen overwhelmed by the incident. Reporting party (RP) stated that her son has been at this daycare for 6 weeks and on 10/10/16, her 2 year old son Connell McFadden-Yagazie (DOB: 4/28/14) disclosed that teacher Denise (2 year old classroom) hit him across the face and that it hurt him really bad. RP stated that she did notice some swelling but attributed the swelling to teething. RP stated that the child is, "Super super smart and super verbal" and does not believe he would make this up. On 10/11/16, RP did not send the child to the daycare and went to the school to speak with the teacher about the incident. After meeting with staff regarding the incident, Denise denied the allegations and was very upset. It was reported that the child did fall on top of a toy and hit his face.
On 3/18/17 at approximately 2034 hours, my partner, Officer Thebeau #8402, and I, Officer Harrell #3441 were working patrol assigned as unit 3A22. We were in full police uniform and operating a black and white marked police vehicle. We received a radio call of numerous subjects fighting near the intersection of Villa Ave and Lake St. The comments of the call stated one of the subjects involved possibly had a knife. We responded code-3 from Marengo Ave and Orange Grove Blvd.
Angela Griffin contacted Mobile Crisis Management (MCM) in regards to her son's recent uncontrollable behavior. She reported to MCM dispatcher her son is yelling, destroying stuff, breaking other children's belongings, and threatening to run away. Ms. Griffin's son name is William. He is a 11 year old white male. Dispatcher contacted MCM Qualified Professional (QP) to respond to crisis. Before arrival to residence, 164 Belle Ln. Siler City, NC 27344, QP contacted Cardinal Innovations (CI) to check for any current enhance services. At 4:22pm QP spoke with Lisa from CI who informed QP, William does not have any current enhance services. At 4:33pm QP spoke with Ms. Griffin and informed her of estimated arrival time, which was 5:29pm.
Payton Sawyers, 15-months old, suffered life-threatening injuries after she was attacked by a pitbull-mix while under the care of her babysitters on January 6, . Grayson County Sheriff’s Deputies and Rescue Personnel responded to a 911 call about 9:30 pm. The child was airlifted to Brenner Children’s Hospital in Winston-Salem, North Carolina in critical condition. Sheriff Richard Vaughan said the child was attacked by the couple’s pit bull-mix, and the dog had the child’s head in its mouth.
