The Articles of Confederation was the first form of government that was created after the United States received their independence from Great Britain. It was a decentralized government where the national government got their power from the states. The state government power was much more supreme than the federal government’s. There are many events that proved that this type of government was really weak and that there needed to be a change. There was absence in the balance of power between the states, national government and the people. One of the problems that was visible is that the weak federal government. This was the turning point in which it made many realize that there needed to be presence of strong central government. This is what led to the convention and the creation of the US constitution. There were many problems seen in the articles that convinced them to create the constitution. One of the problems seen was the national government had no power to control interstate trade or even foreign trading.
State had the power to control trade with states and foreign nations which caused a lot of issues and disputes amongst each other. A solution that the constitution provided to address this problem is that it gave congress to control interstate trade and also foreign trade with other nations. It also created a national currency to make trade easier amongst states. Due to a lot of states having their own currency it caused a lot of problems between states during trade. Another issue that existed under the articles of confederation is that the congress had no right to tax states or even to pass any laws without the consent of the states. Due to this the congress was unable to pay the nation’s debt or take any actions or build any infrastructure that was required. The constitution provided the congress with the power that enabled them to tax without the consent of the states. Lastly, another issue that existed under the articles is that there was no executive power in fear of a tyranny or even judicial powers to interpret the laws. The national government had a lot of issues in trying to pass laws because it needed to be ratified by 9 out of 13 states. There was no way in which the laws were carried out due to the absence of
the executive branch. A solution that the constitution provided for this problem was that it created the judicial branch, legislative branch, and the executive branch. These branches were created to divide and balance out the powers so no one branch was more superior to the other. For example, the congress duty is to create the laws, the executive enforced the laws, and lastly the judicial branch interpreted if the laws are constitutional or not.

American colonists had severed their umbilical cord to the Mother Country and declared themselves “Free and Independent States”.1 The chains of monarchy had been thrown off and a new government was formed. Shying away from a totalitarian government, the Second Continental Congress drafted a document called the Articles of Confederation which established a loose union of the states. It was an attempt at self-government that ended in failure. The Articles of Confederation had many defects which included a weak central government that lacked the power to tax, regulate trade, required equal representation and a unanimous vote to amend the Articles, and had only a legislative branch. As a result the United States lacked respect from foreign countries. These flaws were so severe that a new government had to be drafted and as a result the Constitution was born. This document remedied the weak points of the federal government and created one that was strong and fair, yet still governed by the people.
Under the Articles of Confederation each state had its own sovereignty. And the central government was to provide thing such as national security, treaties, courts, and currency. However the government could not tax. If the states didn't pay their bills to the government there was nothing the government could do about it. This is just one of many reasons why the Articles didn't work. In 1786 Virginia tried to get the Articles modified by holding a meeting known as the Annapolis Conference. One of the key differences between the Constitution and the Articles of Confederation is in the way that they set up the Legislature. In the Articles, it is established as a unicameral legislature which it refers to as a Congress. The Constitution on the other hand establishes a bicameral legislature with an upper house, the Senate, and a lower house, the House of Representatives. The reason for this change was because different states wanted the number of representatives to be selected in different ways. Under the Articles of Confederation all States were represented equally and the bigger states felt that they should be getting more say in the decisions that the Country would be making. Needless to say the smaller states did not readily agree to this.

In comparing the Articles of Confederation with the U.S constitution that was produced by the federal convention in 1787, it is important to note that the U.S operated under both documents. During March 1, 1781, the Articles of Confederation went into effect when it was ratified by Maryland. However, the U.S constitution replaced the Articles of Confederation as soon as it was ratified on June 21, 1788 by New Hampshire. The Articles of Confederation were incapable of providing the United States with an effective form of government. The Articles of Confederation presided weakly over the government as it allowed little or no power to tax, control trade, and branches of government were missing. In addition to this, the thirteen states acted as separate nations and the national government had little control over them.
To say that the Articles of Confederation provided the United States of America with an effective government would be quite an over exaggeration. For most people in modern day, an effective government would be one that can govern mass numbers of people and still be politically correct in overruling decisions on matters while keeping the law in mind, yet keeping the benefit of common good front and center. But, the Articles of Confederation were not written in the present day, so these ideals of a competent government were not quite applicable. For most people, an effective government was one that could govern mass numbers of people, still giving the states and the people many rights, while still being able to keep all under control. This would have eliminated any possibility that a federal government could become too strong or resemble a monarchy.
The Articles of Confederation was the first government of the United States. The Articles had created a very weak national government. At the time the Articles were approved, they had served the will of the people. Americans had just fought a war to get freedom from a great national authority--King George III (Patterson 34). But after this government was put to use, it was evident that it was not going to keep peace between the states. The conflicts got so frequent and malicious that George Washington wondered if the “United” States should be called a Union (Patterson 35). Shays’ Rebellion finally made it evident to the public that the government needed a change.
