Transgender matters have recently become a more prominent and controversial topic; they have led to discrimination of many transgender students across the nation. Many argue that the law should not protect transgender students from discrimination, whereas others state that transgender students should indeed be protected. Title IX of the Education Amendments Act of 1972 addresses the topic of gender discrimination. It specifically states that “"no person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.” Each person has a different opinion on this topic, however according …show more content…

It is for this reason the law not only should, but has a responsibility to protect transgender students from discrimination on the basis of their gender identities. A study showed that 53 percent of transgender students have experienced verbal assault in public facilities while 8 percent have experienced physical assault. Many transgender students now avoid public bathrooms because of the fear of being harassed or assaulted. As supported by the evidence, transgender students are experiencing a violation on their right to the pursuit of happiness. In order to uphold the students’ rights, the government must, and is obligated, to protect transgender students from discrimination. Additionally, according to the U.S. Secretary of Education, “no student should ever have to go through the experience of feeling unwelcome at school or on a college campus.” This brings the right to education into the discussion of the discrimination of transgender students. All students, regardless of race or gender have the right to education. This is one of the rights that makes America unique to other places in the world. Students attend school in order to receive an education. It is a place where students have the “opportunity to participate equally in school programs and activities without sex discrimination.” It is for these reasons that the law must protect transgender students from
