In summary, on 09/02/16 at 1829 hours, I assisted Ofc. G. Lara at 2126 S Cicero Ave. in regards to traffic stop. Upon arrival, I spoke with Ofc. E. Lara #205, who related the driver (Gomez, Benigno DOB 02/13/71) on his traffic stop had signs of impairment (glassy bloodshot eyes and a strong odor of an alcoholic beverage emanating from his breath/person). I made contact with Benigno, I observed him to have red, glassy, and bloodshot eyes. Benigno related that he understands English and I did not have any issues communicating with him. While speaking with Benigno, I detected a strong odor of an alcoholic beverage from his breath/person. Benigno agreed to perform several field sobriety tests. Benigno was staggering and swaying as he walked to perform the tests. The tests were conducted on a dry, hard, level, non-slippery surface off the roadway. I read the instructions from a pre-printed form. Benigno related he did not have any medical conditions that would not preclude him from performing the tests. …show more content…
Horizontal Gaze Nystagmus (HGN) test - Benigno related that he does not wear contacts or have any problems with his eyes. I observed him to have equal pupil size and tracking in each eye, so I continued with the HGN tests. I gave the instructions and Benigno stated he understood them. Benigno was unable to follow the instructions after being told them five (5) times. Benigno would not keep his head straight, he continued to move it side to side after being told not to move his head. Walk and Turn - During the instructional phase Benigno was unable to maintain his balance while listening to the instructions. After the instruction were given Benigno decline to take the test and stated “Fuck it take me to
For example, in Albaugh’s, Deputy Sheriff Dale Maxie arrested William E. Albaugh (“Albaugh”) for driving while intoxicated. Albaugh left his home in his pickup truck and within a quarter mile from his home had it break down. He then turned on his hazard lights and left it on the edge of the road. After walking home, Albaugh decided to drink alcohol with his girlfriend, while the weather was rapidly deteriorating due to snowfall. Shortly afterwards, Deputy Sheriff Dale Maxie (“Deputy Maxie”) and Jailer Barry Bischoff arrived at his home after finding his vehicle on the side of the road and subsequently running the license plate. Deputy Maxie wanted Albaugh to immediately remove his vehicle, claiming it was a road hazard. Mr. Albaugh attempted to persuade the officer that due to inclement weather moving his
Reyes v. Missouri Pac. R. Co., 589 F.2d 791, 794 (5th Cir. 1979) The appellant court held that it was not. According to rule 404 under the Federal Rules of Evidence, “evidence of a person 's character or character trait is not admissible to prove that on a particular occasion the person acted in accordance with the character or trait”. Fed. R. Evid. 404 Under this rule the evidence of Reyes prior convictions admitted by the trial court, “purpose of showing that he was intoxicated on the night that he was run over by defendant-appellee 's train” proves to be inadmissible under Rule 404(a) of the Federal Rules of Evidence. Reyes v. Missouri Pac. R. Co., 589 F.2d 791, 792 (5th Cir. 1979) The courts due mention the exceptions on the admission of character evidence. However the court did not use the evidence of Reyes past drunkenness to prove some other criminal purpose. Since the trial court failed to do the latter, and instead entered evidence on the basis of character to prove that the plaintiff acted in accordance with his character trait during the night in question, it went against the modern rules set out in FRE 404 and is therefore
On 01-01-17 at 0023 hours I was monitoring the radio and heard that Officer Harrell #3441 and Officer Thebeau #8402 were involved in a vehicle pursuit in the area of Fair Oaks Avenue and Corson Street. I responded to the above location to assist. They advised responding units that the suspect was involved in a traffic collision on the eastbound 210 Freeway Fair Oaks Avenue off-ramp.
Jody was born biologically with male genitals and he was brought up as a boy. Unlike his more gender-typical older brother, Jody’s childhood behavior was considered “sissy”. Jody genetically preferred the company of girls compared to boys during childhood. Jody considered herself a bisexual male until the age of 19. At 19 years of age, she became involved with a man, and her identity would be transgender, meaning that Jody was unhappy with her gender of birth and seeks a change from male to female. It would seem that there was some late-onset dissatisfaction, and late-onset is linked to attraction to women; in comparison to early childhood-onset, which are attracted to men. Jody identified herself as bisexual. The relationship with the man ended; nevertheless, Jody’s desire to become a woman consumed her, and Jody feels that’s he was born in the
Imagine, a little boy sitting at home alone, hungry and scared because he doesn’t know where his parents are. Millions of children live this scenario every day because they have parents who abuse alcohol. Alcohol abuse is an addiction that affects everyone in the drinker’s life. Many examples of this are shown in The Glass Castle, Jeanette Walls and her siblings are heavily impacted by their father’s drinking habit and are constantly forced to take care of themselves. Having a parent with a harmful history of alcohol abuse increases the risk of child maltreatment greatly, alcohol use disorder creates many problems especially when children are involved so government should step in and remove children from that environment.
Coupled with the lack of supervision and the temptation of dealing with drugs and money the CRASH unit get into a lot of trouble when the thin blue line was broken by Officer Rafael Perez. Perez was brought in after being caug...
At that call the one officer spoke in Spanish to the people in question so I did not understand a thing that was said. We did pull over a vehicle that was swerving. Officer Todd was nice enough to let me go up to the vehicle with him because of my background of being an officer many moons ago and knowing about officer safety. There were to subjects in the car, a female driving and a male passenger. He asked for driver’s license and registration we took that back to the vehicle and the female was driving on expired driver’s license. Officer Todd also could smell the odor of alcohol in the vehicle. At this time a fellow officer Banks came over to myside and opened the car door and talked with the male passenger. He found open containers of beer and made the male pour everything out. Also Officer Todd asked the female how much she had been drinking and she stated “Two Beers” (the standard answer) we left the suspects in the vehicle and walked back to our
My assignment was to attend an Alcoholics Anonymous (AA) meeting and write my observations and thoughts on the meeting, its structure and philosophical beliefs. I was extremely uncomfortable about attending such a personal meeting. Would individuals welcome me or feel as if I would judge? Even though I was uncomfortable, I am glad I attended the meeting as it was a very enlightening experience for me.

As we cruised around the community, he pointed out countless minor traffic violations, both moving and non-moving, but opted not to make any stops. At this point he stated his main concern was to spot any impaired drivers and get them off the road. Eventually, as we came up behind an older civic (the Civic had a broken brake light) on Centreville Road, the officer stated that he detected the scent of marijuana coming from the Civic. The driver of the Civic noticed Crutchman’s police cruiser behind him and dropped his speed to 5 mph under the posted limit. Officer Crutchman began tailing the vehicle which immediately turned off on the next available road. We proceeded to follow the Civic for a couple of miles. I could tell that Officer Crutchman wanted to make the stop, and I inquired why he hadn’t done so already on account of the Civic’s faulty brake light. He responded that he is cautious about making such stops because he does not want a “new law named after him” on account of the controversy surrounding pretextual stops. It is possible that this careful attitude has developed as a result of the rising public outcry against police and

The ingestion of alcoholic beverages for their enjoyable effects is a custom which has been around for thousands of years, and alcohol continues to be a popular drug because of its short-term effects (Coleman, Butcher & Carson, 1984). An enormous amount of damage can be attributed directly to alcohol abuse as a result of lost jobs, accidents caused by drunk drivers, and so forth (Maltzman, 2000). Alcohol also compounds other problems--an estimated 25% to 40% of hospital patients have problems caused by, or recovery delayed by alcohol abuse (Maltzman, 2000). Clinical psychologists spend about one-fourth of their time dealing with people who are suffering in part from alcohol or other substance problems (Vaillant, 1995). Although alcohol problems have been around for so long, it is only recently that these problems have begun to be associated with medical or psychological difficulties.
Although, Huntsville Police annually brings in the most drug arrests for the state, it’s not the city’s main priority to meet an arrest quota. Instead, the police force usually catch these offenders after stoping them for traffic violations. When an officer stops an individual for reckless driving and suspicion of driving under the influence, he or she will often smell a mixture of alcohol and marijuana. With probable cause, the officer will then search the vehicle and often times finds the individual in possession:
The Alcohol Use Inventory (AUI) is comprised of twenty-four sets of scales and two-hundred and twenty-eight questions to calculate involvement and use of alcohol. The AUI was founded on the premise of how each individual views alcohol and their beliefs about the benefits versus the negative consequences of drinking and was developed for use with individuals admitted into a treatment program (Horn, Wanberg, & Foster, 2016). It is believed that alcoholism is a created from many different factors. The goal of the AUI is to provide counselors with a pattern pf drinking or an answer to whether the client is an alcoholic or has a problem with alcohol to accurately create a treatment plan (OJJDP, 2016) According to the Office of Juvenile Justice
Most people do not realize that alcohol is a drug that claims the lives of youth in college campuses across the world. In my case, it took the encounter with the ORL staff at UCLA for me to come to understanding that I am putting myself and those around me in danger through my risky drinking habits. With hours of self-reflection and the help of a cosmopolitan article called The Deadly Drinking Mistakes Smart Girls Make, I have found that there are several risks associated with alcohol that can put me at a quarrel with death. Even so, drinking does not always need to be deadly, and by keeping in mind the well-being of my fellow bruins and the skills mentioned in the article, I can find a balance between drinking for fun and drinking till death.
