Abraham Lincoln's Abuse of Power Lincoln's use of executive authority during the civil war is many times illegal and unjust; although his issuance of the Emancipation Proclamation may seem justified, Lincoln blatantly abused his power regarding civil rights. He did things like institute an unfair draft, suspend Constitutional rights, allocate military spending without Congress, and institute emancipation. Although some may justify these actions, they stomped on the Constitution. Lincoln found powers in the constitutional clause making him "Commander in Chief of the Army and Navy of the United States, and of the militia of the several states." He said that because of this clause, he had the right to use any means necessary to defeat the enemy. With this justification, he issued many executive orders before Congress even convened. Lincoln summoned the militia, ordered a blockade of the Confederacy ports, expanded the regular army beyond its legal limit, and directed government funds before congressional allocation. of these powers were granted to him in the Constitution. Lincoln also abused his power with the draft. Prior to the draft, the Union depended on the states to fill assigned quotas with volunteers. But then Lincoln instituted a new draft. By its terms, all men between the ages of 20 and 45 were liable to military service. However, any man who was called for the draft could avoid it by hiring a substitute or paying $300 dollars to the government. Many groups rightfully denounced these acts, called the conscription acts, as a rich man's law. Indeed, many wealthy men were able to bribe poorer men into taking their place in The most blatant abuse of Lincoln's power was his suspension of habeas corpus. The suspension of this constitutional guarantee, by which a person could not be imprisoned indefinitely without being charges with some specific crime, around much opposition throughout the country. Although Lincoln himself made no concentrated efforts to suppress political oppositions, the repeal of habeas corpus enabled overzealous civil and military authorities to imprison thousands of people who were vocal in their opposition to the war against the South. During the war, in the case Ex parte Merryman, Chief Justice Taney ordered Lincoln to grant a writ of habeas corpus to a Southern agitator who had been arbitrarily jailed by military authorities in Maryland. Lincoln ignored the order. After the war, in the case Ex parte Milligan, the Supreme Court ruled that president could not suspend habeas corpus without the consent of Congress.
The assassination of Lincoln was planned and carried out by the well known stage actor John Wilkes Booth, as part of a larger conspiracy to revive the Confederate cause. Booth's co-conspirators were Lewis Powell and David Herold. They were assigned to kill William H. Seward. George Atzerodt was supposed to kill Vice President Andrew Johnson.
Lincoln declared that “all persons held as slaves” in areas in rebellion “shall be then, thenceforward, and forever free.” Not only liberate slaves in the border slave states, but the President has purposely made the proclamation in all places in the South where the slaves were existed. While the Emancipation Proclamation was an important turning point in the war. It transformed the fight to preserve the nation into a battle for human freedom. During the Abraham Lincoln’s short time as president, he managed not only to save a nation deeply divided and at war with itself, but to solidify the United States of America as a nation dedicated to the progress of civil rights. Years after his death, he was awarded the title of ‘The Great Emancipator.’ In this paper, I will examine many different aspects of Lincoln’s presidency in order to come to a conclusion: whether this title bestowed unto Lincoln was deserved, or not. In order to fully understand Lincoln, it is necessary to understand the motives that drove this man to action. While some of his intentions may not have been for the welfare of slaves, but for the preservation of the Union, the actions still stand. Over forty years has passed since the United States inducted the last draftee through the Selective Service System. The Selective Service System is an independent agency of the United States, which gives the President the right or power to conscript men for military service. There have been different Acts passed by congress since 1917 that require men of various ages to register for service. Although, the name of each Act and the age requirements of the registries changed, the Acts were all similar in nature. They all gave the President the right to call men to war when he deemed necessary. In January 1973, Secretary of Defense Melvin Laird announced the creation of the all-volunteer service, retracting the need for the draft (GAO.gov). Under current law, all men between the ages of 18-25 must register within 30 days of their 18th birthday, however this information is used mostly for recruitment purposes and in case of any future crisis. There has been much controversy over this matter since the Vietnam War, when people started to realize the draft was unfair due to loopholes and draft exemptions making the draft unfair for working men. At one point in time the military draft may have been necessary, but today’s all-volunteer military has eliminated the need for a draft.

The government was forcing them to fight a war they didn’t support and the only way they could avoid it was to pay 300 dollars (a years wages for most), yet they would pay African Americans 1,000 dollars for volunteering. Historically, women have been excluded from combat roles. On the surface, it is because men, who have always thought of themselves better and stronger than women, believed that females could not handle the responsibility of holding a combat position and women are rupturing the socially constructed gender norms that were set in place. According to Nicole Dombrowski, “no other topic concerning women’s role in war creates as great a debate as the question of women’s active participation in combat units.” The benefits for the expansion of women’s roles in the military advantage not only the women but the military as well. In comparison, the drawbacks of expansion of women’s roles are usually disadvantages to the men within the military.
During WWII, the initial acceptance of woman in the military was controversial because they were deciding whether just needed more people, whether they should be an official part of the services, and whether they could perform the jobs. Most people were concerned that women would obstruct the view of American culture because they would be considered “masculine”. By 1944, women proved to be effective in helping during the war. Some were even trained to shoot guns next to the men. In 1994 the DOD (Department of Defense) created a policy that prevented women from combat with their male colleagues. They also could not be assigned to units below the brigade level, whose number one objective is combat on ground. Over the years women have showed that they are physically, mentally, and emotionally able to keep up with men in the military.
The gender integration in the military has always faced questions of social acceptance, weather society can accept how women will be qualified and respected in the military as today. As of today, the decision has been made and allowed women to fill about 220,000 jobs that are now limited to men which includes infantry, armor, reconnaissance and some special operations units. The recruitment numbers of women have been increasing since than which reflects the importance of severing as role model for future women to join infantry and other ground combat jobs which they have been prohibited from. Women have extensively served in combat in Iraq and Afghanistan, but discrimination still continues till today. The military requirements are physical tests and standards such as long deployments aboard ships, exceptions for infantry which male units perform better than women.
