The death penalty raises important questions about the right to life, who has a right to life, and under what circumstances a right to life can be taken away. I believe there are no circumstances under which capital punishment is justified. I will proceed to defend my claim that capital punishment is unjustified by arguing a position that killing is wrong because it deprives individuals of valuable futures.
To support my thesis that capital punishment is not justified, I will expand upon an argument made my Don Marquis in his essay “Why Abortion is Immoral” in which he argues that killing is immoral on the grounds that it deprives human beings of a valuable future. My argument is as follows:
1. Killing is wrong because it deprives the victim of his or her future.
2. Death row criminals are in the same moral category as other human beings with respect to the moral value of their lives.
3. The future of a criminal on death row is just as valuable as the future of a human being not on death row.
4. Any form of capital punishment is a form of killing.
5. Therefore, because killing is wrong, killing by capital punishment is also wrong under every circumstance.
My first premise states that killing is wrong because it deprives the victim of his or her future. Just as Marquis argues that abortion is wrong because it is killing an individual and depriving him or her of a valuable future, I argue that capital punishment is wrong because it too involves killing and depriving an individual of a valuable future. Marquis states, “When I am killed, I am deprived both of what I now value which would have been part of my future personal life, but also what I would come to value” (322). Thus, we do not have a successful method to determine if harm will be caused to society and, in accordance with Mill’s Harm Principle, we cannot administer the death penalty because there is no harm done to society. Consequently, these objections do not hold up under scrutiny, and my conclusion is reinforced. In Martin Perlmutter's essay "Desert and Capital Punishment," he attempts to illustrate that social utility is a poor method of evaluating the legitimacy of it. Perlmutter claims that a punishment must be "backward looking," meaning that it is based on a past wrongdoing. A utilitarian justification of capital punishment strays from the definition of the term "punishment" because it is "forward looking." An argument for social utility maintains that the death penalty should result in a greater good and the consequences must outweigh the harm, thereby increasing overall happiness in the world. Perlmutter recognizes the three potential benefits of a punishment as the rehabilitation of an offender, protection for other possible victims, and deterring other people from committing the same crime. In order to defend my standing in this argument I will reason that the use of capital punishment has many benefits that trump any possible objections. Special attention will be given to the topics of deterrence, the families of the victims, and the increased population that has been occurring within our prisons. Any possible objections will also be assessed including criticism regarding the monetary value of the use of the death penalty and opposition to this practice due to its characteristics, which some identify as hypocritical and inhumane. My goal in arguing for the moral justifiability of capital punishment is not to use this practice extensively but rather to reduce the use to a minimum and use it only when necessary.

There are over sixty offenses in the United States of America that can be punishable by receiving the death penalty (What is..., 1). However, many individuals believe that the death penalty is an inadequate source of punishment for any crime no matter how severe it is. The fact remains, however, that the death penalty is one of the most ideal forms of punishment. Don Marquis is a philosopher arguing that any form of abortion is immoral. His original thesis states: In the overwhelming majority of cases, deliberate abortions are seriously immoral. He begins by stating why killing is wrong in three statements. In this paper I will argue for the moral permissibility of the death penalty and I am fairly confident that when the case for capital punishment is made properly, its appeal to logic and morality is compelling. The practice of the death penalty is no longer as wide-spread as it used to be throughout the world; in fact, though the death penalty was nearly universal in past societies, only 71 countries world-wide still officially permit the death penalty (www.infoplease.com); the U.S. being among them. Marquis believes abortion to be extremely immoral. However he mentions that there are exceptions in rare but certain circumstances where abortion is acceptable. We can infer that these instances would include situations that would put the mother or child at serious risk by keeping the fetus. He is frustrated that this idea has received minimal support recently. As a result he wants to influence change in society in hopes of receiving the support and publicity this topic deserves. Marquis’ primary argument stems from the idea of killing in general. He explains it is immoral to kill an adult because it prematurely deprives the human of something they may have valued at the time they were killed, as well as something they may had valued in the future. We are the only ones who can decide what is valuable to them; in this case we value some things more than others, and this concept differs from person to person. Capital punishment is a difficult subject for a lot of people because many question whether or not it is ethical to kill a convicted criminal. In order to critically analyze whether or not it is ethical, I will look at the issue using a utilitarianism approach because in order to get a good grasp of this topic we need to look at how the decision will impact us in the future. The utilitarianism approach will help us to examine this issue and see what some of the consequences are with this topic of capital punishment. Americans have argued over the death penalty since the early days of our country. In the United States only 38 states have capital punishment statutes. As of year ended in 1999, in Texas, the state had executed 496 prisoners since 1930. The laws in the United States have change drastically in regards to capital punishment. An example of this would be the years from 1968 to 1977 due to the nearly 10 year moratorium. During those years, the Supreme Court ruled that capital punishment violated the Eight Amendment’s ban on cruel and unusual punishment. Richard Nixon said, “Contrary to the views of some social theorists, I am convinced that the death penalty can be an effective deterrent against specific crimes.”1 Whether the case be morally, monetarily, or just pure disagreement, citizens have argued the benefits of capital punishment. While we may all want murders off the street, the problem we come to face is that is capital punishment being used for vengeance or as a deterrent.
