When thinking of The United States only two thoughts come to mind; freedom and citizenship. The right to vote, the right to freedom of speech, and the right to a fair, speedy trial are all rights the citizens of America possess. All the same people have responsibilities. People residing in the United States are expected to know their responsibilities such as Supporting and defending the Constitution, or Respecting the rights, beliefs, and opinions of others. In 1791, the Constitution of the United States was amended and the people were given the ten amendments, which is also known as the Bill of Rights, to protect freedom. The First Amendment of the United States Constitution protects the right to freedom of religion and freedom of expression from government and or social intrusion. Freedom of expression contains of the rights to freedom of speech, press, assembly and to petition the government for a remedy of injustice, and the suggested rights of affiliation and belief. The Supreme Court elucidates the extent of the security afforded to these rights. The First Amendment has been interpreted by the Court as applying to the entire federal government even though it is only expressly applicable to Congress. Furthermore, the Court has interpreted, the due process clause of the Fourteenth Amendment as protecting the rights in the First Amendment from interference by state governments. In America the Amendment 1 of the U.S. Constitution gives the American people the right to peaceably assemble and to petition the Government for a redress of grievances. Most notably Amendment 1 is known for and most often cited as giving the Freedom of Speech. Even before this amendment was ratified people in the U.S. were protesting, as in the Boston Tea Party. Protesting has been a way to effect change in America. A question to ask is this: is there a right way or wrong way to protest.

“They who can give up essential liberty to obtain a little temporary safety, deserve neither liberty nor safety.” This quote from Benjamin Franklin illustrates how an emphasis on safety can drastically reduce the freedoms enjoyed by citizens of the United States, especially the Second Amendment of the U.S. Constitution which states that “...the right of the people to keep and bear arms shall not be infringed.” However, with active shooter situations such as Columbine; the Tucson, Arizona shootings, which nearly killed former Representative Gabrielle Giffords; and recent situations at Newtown, Connecticut; Los Angeles International Airport; and Westfield Garden State Plaza mall in New Jersey, the federal government has questioned this right guaranteed to us as U.S. Citizens. In Congress, it is a back-and-forth battle between the Republicans, who favor less gun control legislation and a literal translation of the Second Amendment, and the Democrats who would like to see more gun control legislation to protect the safety of citizens. However, more gun control legislation would punish law-abiding citizens, be a direct violation of the Second Amendment, and expand the power of the federal government into areas where the Founding Fathers never wanted it.

The majority of the Founding Fathers were enlightenment thinkers who were in love with liberty, and thought that basic political rights were inevitable for man’s nature. After having experienced the tyranny from their mother countries, the Founding Fathers carefully constructed the Constitution of the United States in a way where tyranny was avoided and a government for the people, by the people and of the people was developed, which is clearly reflected in the Constitution. At the time of inception of the United States, the Founding Fathers created the First Amendment in order to ensure that the government would not interfere with Americans’ basic civil rights. The rights outlined on the First Amendment were considered so important by these leaders that many states refused to ratify the Constitution of the United Sates until there was a conjecture of amendments that would protect individual rights in the future.

One of the main focuses drawn by the people is the ability to practice the religion that they so desire. The first amendment allows religion to exist due to the establishment clause and the free exercise clause. Both clauses are important and necessary for continous survival of religion. However, not all clauses are created equal. While many would argue that the free exercise clause holds a greater importance in the constitution, evidence suggests that the establishment clause is far more superior because it hinders a religion from dominating the country, it prevents the government from being biased, and it helps individuals who are not religious avoid being involved in the funding of religion as a whole.

Growing up as an American citizen, one is normally taught their rights in each and every history or government class. However, knowing the name and brief purpose of an American right is completely different than knowing its history, background, and how it affects the country today. In America, our rights are listed in the Bill of Rights, which is the first ten Amendments to the United States Constitution. The second Amendment to the Constitution of the United States involves the right to bear arms. This Amendment is the subject of many present day controversies and cases.
The 1st Amendment forbids Congress from enacting laws that would regulate speech or press before publication or punish after publication. At various times many states passed laws in contradiction to the freedoms guaranteed in the 1st Amendment. However broadcast has always been considered a special exemption to free speech laws for two reasons. 1) the most important reasons is the scarcity of spectrum and the 2) is the persuasiveness of the medium. Because radio and TV come into the house, and may be heard or seen by unsupervised children, the government feels a special responsibility to protect the American people.
