Today, there are so many legal dilemmas dominating trial for the courts to make a sound legal decision on whose right in a complicated situation. Despite the outcome of the case, the disagreement usually has a profound effect on the healthcare organization, and the industry as a whole. Learning from what Dr. Anna Pou had to face with the lawsuits she was dealing with makes me cringe. As Healthcare professionals, having to worry of possibly being sued for believing what is right for the patient or as a whole for the hospitals health is ridiculous. Healthcare professionals like Dr. Pou, have taken the Hippocratic oath, and one of the promises made within that oath is “first, do no harm”. I was unable to experience an ethical dilemma at my clinical site; however, I have come across a few dilemmas in recent news. The ethical dilemma I have chosen to discuss took place in California. A two-year-old boy had a severe asthma attack that resulted in him becoming brain dead after having a heart attack. Although three doctors from two different hospitals declared the boy brain dead, the family asked the court to have their son remain on a ventilator, and then took off to Guatemala to receive treatment they felt their son was not receiving in California. There, a neurologist declared that the boy was not brain dead, so the family returned to California to a new hospital. After days there the court order they asked for was denied. The boy was taken off the ventilator and passed away (Miller, 2016).

Healthcare ethics is defined as a system of moral principles that guide healthcare workers in making choices regarding medical care. At its core lies our attitudes regarding our personal rights and obligations we have to others. When an unprecedented situation comes into play, we rely on medical ethics to help determine an outcome that would be the best case scenario for all involved. In order to appropriately review this case study, we must first identify the key stakeholders, the ethical principles, policy implications at the federal, state, and local levels, financial implications, and a viable resolution for the situation.
“Public health is controversial because, depending upon how it is defined, it may challenge people’s values and demand sacrifices” (Schnieder 2017: 23). Although the overall goal is to create a policy that is inclusive of every group, this is almost impossible. It is impossible because there are too many conflicting views between each group. Public policy may also have a positive or a negative impact on the economy. One of the major conflict with public health policy is that it may be guided by religious beliefs. For example, issues such as AIDS, other sexual transmitted disease, teenage pregnancy, and low birth rates (20) are some of the major issues that end up being controversial when it comes to religion.
On September 2, 2015, current United States Ambassador to the United Nations and former South Carolina governor Nikki Haley gave a speech titled, “Haley: GOP Approach to Minorities is ‘Cold.’” In this conference hosted by The National Press Club, Mrs. Haley addressed the conflicts within the Republican Party involving minorities. The word ethics is derived from the Greek word ‘ethos’ meaning character or conduct. It is typically used interchangeably with word moral which is derived from the Latin word ‘moves’ which means customs or habits. Ethics refers to conduct, character and motivations involved in moral acts. Ethics are not imposed by a profession, by law but by moral obligation. It is unwritten code of conduct that encompasses both professional conduct and judgement. Ethics helps support autonomy and self-determination, protect the vulnerable and promotes the welfare and equality of human beings. An ethical dentist- patient relationship is based on trust, honesty, confidentiality, privacy and the quality of care.1

Every patient has the right to refuse treatment if they are competent. In the case study the 35-year old woman’s religion and chronic disease was the determining factor of her not wanting to receive a blood transfusion. If the treating physician would try to influence her decision away from her family and offer a secret transfusion that would be unethical. The delivery of healthcare mandates a lot of difficult decision making for healthcare providers as well as patients. For patients, much of the responsibility is left to them especially when serious health problems occur. This responsibility deals with what treatments could be accepted, what treatments could be continued, and what treatments could be stopped. Overall, it considers what route should be taken in regards to the health interests of the patient. However, there are circumstances in which patients cannot decide for themselves or communicate what they want in terms of their healthcare. This is where the ethical issue concerning who should be responsible for making these important healthcare decisions occur if a patient was to be in this sort of situation. Healthcare providers can play a role in the healthcare decision making as their duty is to act in the best interest of the patient.
Case #2 is a perfect example of a case that causes one to question which ethical principles are most important and to whom those principles should be applied. Case #2 involves Jane Trause who has had a history of drug use and is currently pregnant. Upon being admitted into labor and delivery, it quickly becomes evident to medical staff that the fetus is medically unstable and needs to be delivered immediately. However, it is determined by the medical staff that the baby will not survive a natural delivery and that the only way the baby will be born alive is by a C-section. Jane and her husband Doug adamantly refuse to allow a C-section and remind the staff that they have a right to refuse treatment. The residents of the hospital must decide if they can morally respect Jane’s autonomy and allow her to deliver naturally, while putting the fetus’ life in jeopardy or if they will override Jane’s wishes and perform the C-section without her permission to ensure a safe delivery.
