Learning the Hard Way
“Hi Zac, we are all going out to Hacienda and then we’re all gonna have some fun. I have a surprise for you all. Just be here at six and it’ll be all set.” Kyle hung up the phone and resumed his calling. I threw on a clean shirt and shorts and arrived at his house with two minutes to spare. My blank stare at the empty drive way prompted Kyle to tell me that the six others already went to Hacienda and were getting a table. After dinner we walked to Linway and watched Office Space, a prelude for the weeks to come.
Kyle led us into his barn and showed us a big red octagon with the letters S,T,C, and P on it. “There was a construction zone at the four-way stop,” he said. I presumed this was at county road 13 and county road 34 where the road was being widened. “There was a temporary stop sign up because the one his wall was being replaced. I merely stopped this sign from going to the recycling plant,” Kyle argued. Convincingly enough for a sixteen year old who didn’t have a girlfriend and found himself at Kyle’s every week. The wounds of peer pressure were starting to bend my ethics and moral standards. "Are you suggesting you want us to help you do this again?" I asked. The grin on his face was a definite yes. I let my teenage curiosity make the decision for me, “Sure, it sounds like a good time.” The inner snapping sound echoed the breakage; my values which I corrupted, were temporarily on hold.
Kevin made his opinion known and left after condemning Kyle for his actions. Josh avoided the conversation and told us he was meeting his brother soon for a late night Steak N Shake run. Greg and Troy had their suspicions and didn’t know if it was the right thing to do. Greg didn’t think it would be fun and Troy thought if his parents ever found out, it would be no more Friday and Saturday nights.
Morally, we all knew it was wrong, but Kevin was the only one who blatantly voiced his opinion on it.
Said by Justice David Souter “ In the majority opinion, compared the reasonableness of such a search to a more casual interaction.” He believes that the co-occupants consent is not valid because their was the refusal of an other occupant. Beside on the Fourth Amendment it states that “ a valid warrantless entry and search of a premises when the police obtain the voluntary consent of an occupant who shares, or is reasonably believed to share, common authority over the property, and no present co-tenant objects.”
A warranted search is per say reasonable. Officers may then employ various reasonable means of obtaining the information, e.g. search the content of U.S. mail, one’s house or office, or deploy an undercover agent as in Lewis v. United States (1966). They may, without need for physical intrusion as under the archaic trespass doctrine, utilize modern surveillance methods, such as electronic eavesdropping as in Lopez v. United States (1963) or heat signatures. (Solove and Schwartz 83) Under the third party doctrine, officers may obtain information that you voluntarily provide to your bank, accountant, ISP or e-mail provider as per United States v. Forrester (2008). (Ibid 197; 199) Conversely, “a warrantless search is generally considered to be per se unreasonable.” (Ibid 99) As noted in Katz v. United States (1967), “‘the mandate of the [Fourth] Amendment requires adherence to judicial processes,’ and that searches conducted outside the judicial process, without prior approval by judge or magistrate, are per se unreasonable…” (Ibid 99) Fail to meet any of the four elements and the warrant does not meet constitutional muster (see Berger v. New York (1967) wherein officers failed to stop surveillance at
The 4th amendment provides citizens protections from unreasonable searches and seizures from law enforcement. Search and seizure cases are governed by the 4th amendment and case law. The United States Supreme Court has crafted exceptions to the 4th amendment where law enforcement would ordinarily need to get a warrant to conduct a search. One of the exceptions to the warrant requirement falls under vehicle stops. Law enforcement can search a vehicle incident to an individual’s arrest if the individual unsecured by the police and is in reaching distance of the passenger compartment. Disjunctive to the first exception a warrantless search can be conducted if there is reasonable belief
It was irrational for these students to be suspended from the school. The high school students named John F. Tinker, who was fifteen-years-old, John’s younger sister Mary Beth Tinker, who was thirteen-years-old, and their friend Christopher Eckhardt, who was sixteen years old, should not have been suspended. They were under the protection of the First Amendment. The parents of those students sued the school district for violating the students’ right of expressions and sought an injunction to prevent the school from decupling the students. The Supreme Court of the United Sates stepped in and the question of law was if. They ruled in the favor of the Tinker’s because it was in a seven to two decision "Tinker V. Des Moines Independent Community School District."
“With a sudden slash of his hand, he knocked both the sharpener and the cup of pencils from his desk”(Butler, 194). Kevin has recently returned to his home, nevertheless he seems to have acquired a temper, one similar Tom Weylin or Rufus. The one person he can talk about his experience is with Dana, which is a bit restrictive, but who’s to say that he will talk to her or instead he may treat her as a slave. In addition, after Kevin’s experience Dana is soon being sent back to save Rufus, yet Kevin makes no move to follow her. “He said something, but suddenly, there was too much noise for me to hear him-even if he had still been there”(Butler, 197). Dana wants Kevin to stay in California, instead of going to Maryland and possibly getting trapped. He has been through an experience no one should go through, but that is his wife’s life possibly on the line. Maybe Kevin does not love her anymore, as a result of being around people who hate black people. Kevin was surrounded by people for five years who treated other human beings so poorly, as a result, he possibly does not like Dana as a person. In
While olive was just trying to catch up with her old student, she brought him discomfort. It seemed she did not do this on purpose as she meant well and just wanted to talk to Kevin. From the start Kevin did not want to talk to Olive so he short answered her a lot. This caused olive to try to bring up conversation with Kevin and unintentionally brought up Kevin’s bad past and memories, causing Kevin to feel discomfort and bring a negative effect on
Learn it the hard way. That is the way I learned the old adage “no pain, no gain”. It was my first dirt bike race. My heart had been pounding like a drum in a high school band for three days before the race. The race was in the middle of nowhere in Tucson, Az. I arrived on a Friday, my race was on Saturday.
There they are, cooling at the courts. The whole ‘clique’ is there, they ain’t repping/banging yet, they are here still just good friends and mind their own thing. “Eyo, Trev'. Why did you move to Los Santos?”, asks one of the group – Luke. Trevor’s facial expression slowly changes, he is pushing his eyebrows together as he lets out a silent sigh, and speaks. Trevor tells everything...
A lesson that I learned for good. When I was five years old and the year it was 2005. Me and my mother were home like any other day. It was a Monday morning and everyone left the house except for me and my mother. The reason why we were the only ones left is, because my sister was at the age where she could go to school. As for my father well he’s the man of the house so he has to go to work.
I can still remember that small enclosed, claustrophobic room containing two armed chairs and an old, brown, paisley print couch my dad and I were sitting on when he told me. “The doctors said there was little to no chance that your mother is going to make it through this surgery.” Distressed, I didn’t know what to think; I could hardly comprehend those words. And now I was supposed to just say goodbye? As I exited that small room, my father directed me down the hospital hallway where I saw my mother in the hospital bed. She was unconscious with tubes entering her throat and nose keeping her alive. I embraced her immobile body for what felt like forever and told her “I love you” for what I believed was the last time. I thought of how horrific it was seeing my mother that way, how close we were, how my life was going to be without her, and how my little sisters were clueless about what was going on. After saying my farewells, I was brought downstairs to the hospital’s coffee shop where a million things were running
Those blocks (block, block, block) in just plain gray (gray, gray, gray): the perfect surroundings to leave one's mind blank... or insane.
When we were out of my neighborhood I asked where we were going and Kolin said we were going to Dre's apartment first; afterwards we would take the Metro down to Northwest because he had to meet up with some people for a drug deal. Mark began to roll a joint and he said, "Look, I scored some KB off this idiot high-school kid who thought it was swag. It's my treat ladies." We rolled up to Dre's apartment, drank a little and hot-boxed the van. As we sat there smoking, Kolin, Mark, and Dre began to talk about the recent events. "That party last Friday was fucking stupid. I can't believe they gave you shit at the door," said Kolin.
become an amazing support system for Kevin. Kevin will always be a story of when things look
There is a point in everyone’s life when they step back and realize “I can’t do this anymore, it’s ruining my life”. Many of my friends have started smoking cigarettes while drinking at a very young age, and continue to use this drug currently and don’t realize the affect it has on their future. While I have been smart enough to avoid smoking, I haven’t been as wise at making decisions when it comes to drinking. The amount of partying I’ve done in college has taken over my life, and has had a huge impact on my grades. Changing my drinking habits and continuing to avoid cigarettes will enable me to be the best I can be for the rest of my college experience.
Early childhood education plays a key role in a child’s academic development because he or she learns soft skills, job skills, and develop positive traits. Preschool is not like kindergarten, but instead a stepping-stone that prepares young students for the years of schooling they will have later in life. As more schools began to open families wanted to be able to verify that programs would benefit and protect their children. In response, the National Association for the Education of Young Children was made to help families find the best care for their children, by providing the early childhood educators with training and ensuring the quality of children’s daily experiences.
