The primary purpose of the United States Constitution and its relevance as a source of law related to the management and operation of public schools is twofold. The United Constitution primary purpose is to offer a meaning of management to the institute of the three branches of the federal government. The outline summarizes the individual and joint authorities of each branch, at the same time as setting apart the privileges of each individual state. It labels the meaning of jury trials, civil liberties, the responsibilities, and the answerability of the government. The Preamble verifies the magnitude of the Union and the necessity for a common line of defense to guarantee common interests for the American society. The United States Constitution, as well, very obviously characterizes that the federal government does not take pleasure in power beyond of the recognized articles in the Preamble (Borade, n.d., para. 4). The management and operation of public schools fall under state according to the United States Constitution, article of the Tenth Amendment, which it affirms “the powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people” (U.S. Const. amend. The Constitution of the United States is one of the most iconic and important documents of all time. However, when it was first generated, its writing and ratification caused some major concerns. The purpose of the Constitution was to address the great number of issues of a new nation. To be more specific, the Constitution was meant to resolve the political, economic, and social problems of the country. In the Abbeville et al. versus the state of South Carolina case, Abbeville demanded more funding from the state for the school districts that were not being provided with extra money through their property taxes. The Constitution, the document that protects all our rights, is a very important piece of American government history. Many people know it was created a long time ago by the Founding Father, but do not know the effort taken to create it and the smaller important aspects. The article “A More Perfect Union: The Creation of the U.S. Constitution” written by the National Archive gives and overview of the creation of the constitution. Three main points of this history is the Article of Confederation, the Delegates, and the Ratifications. These three points have a huge effect on the end product of Constitution.
The funding of public education has long been an issue for the state government of Texas. Starting before Texas was even a state, public education funding was at the forefront of politicians’ minds. In 1836, one of the reasons Anglo-Texans wanted to become independent from Mexico was Mexico’s lack of a public school system (An Overview of the History of Public Education in Texas, 2016). This drove the desire of President Mirabeau B. Lamar of the Republic of Texas to create legislation that would grant public schools land (A Brief History of Public Education, n.d.). This act set aside four leagues of land per county for the use of free education centers and thus began the funding of public education by the state government (An Overview of the History of Public Education in Texas, 2016). In the last 177 years, the Texas Legislature and the Texas Education Agency have created numerous acts and laws regarding the funding of education, but it has been in the last 50 years that this topic has become highly contested, resulting in several lawsuits and endless efforts (by the school districts) to equalize the distribution of funds to Texas school districts (Texas School Finance History, n.d.). In sum, the complex issues and policies that surround the funding of public education are derived from a combination of the legislature, bureaucratic agencies, and local governments in the form of school districts.
The United States Constitution is arguably considered one of the nation’s most influential documents in America’s history. This centuries old document has not only guided the United States to becoming a successful society, but has also helped other nations in the forming of their own governments. Although, there has recently been a great deal of controversy as to whether the Constitution is still valued today. Three years after the No Child Left Behind Act (NCLB) moved into our schools there is a great deal of controversy that questions whether the act implemented by President George W. Bush is helping or hurting an already suffering school system. There are many dimensions of the NCLB act that have been questioned over the past three years; the fair assessment of students with disabilities is one of them. As the National Center for Fair & Open Testing (NCFOT) reported, the public relations aspect of this act is strong.

Constitution. In Michigan, there is a lawsuit between school children who struggle in Detroit’s low performing schools. In the instance of the Detroit case the school children feel that the state has not adequately provided them with basic literacy skills a foundation of all education and a precursor to active citizenship. This case supports constitutional law because it is rooted in the U.S. Constitution not the state constitution. This case is currently in the federal court and if it reaches the Supreme Court there could be changes to education nationwide.
