British historian Timothy Garton Ash once said, “That said, the question remains: how to strike a balance between free speech and mutual respect in this mixed-up world, both blessed and cursed with instant communication? We should not fight fire with fire, threats with threats.” Our basic rights, guaranteed under the constitution, are increasingly under threat not only in our government, but particularly in the education system. Once a bastion of free thought and speech, universities are becoming progressively intolerant of anything that might violate perceived notions held by their leadership and sponsors.
The principle of free speech at the university level has been one of long standing. In 1188, Emperor Frederick I Barbarossa wrote the Authentica habita which set up the rules and rights for universities. Amongst the scholarly protections listed was the immunity from the right of reprisal for early scholars. So important was this document that Pope Alexander III confirmed it and it was written into Justinian’s Codex, the extant body of Roman law, by the Emperor.1 While curriculum has changed over the ensuing centuries, the fundamental principle of scholarly freedom endured. With the addition of humanistic studies in the middle ages, more progressive and creative university climates emerged. A new focus on knowledge coming from self and how the individual impacts society had great implications on generations of university students.
Many of our Founding Fathers had the benefit of attending a colonial college or studied abroad. Former Secretary of Health and Human Services Donna Shalala once said, “You can't have a university without having free speech, even though at times it makes us terribly uncomfortable. If students are not going to hear controversial ideas on college campuses, they're not going to hear them in America. I believe it's part of their education.”5 Truer words have rarely been spoken.

Throughout America, people place a high value in their freedom of speech. This right is protected by the first Amendment and practiced in communities throughout the country. At this point in a college freshmen’s life, they have been in school for 14 years. Throughout those 14 years, freshmen have learned the Bill of Rights like they’ve learned how to walk and the first amendment the way they’ve learned to talk. The first amendment has been engrained in a child from the first history class in 5th grade, to the fifth history class in 9th grade and the eighth class in their senior year. In those eight years, a student has the first amendment in their head to bring to college and express themselves how they see fit and how they have been socialized to do so. In 1776, the tyranny of King George III made it necessary for all thirteen colonies to unite, declare independence and to sever political ties between Great Britain. The under-represented people of America needed something strong which showed how colonists need to free of the English rule. The colonists did that by writing a “list of grievances” by stating their reasons for rebelling against Britain’s tyranny. If it wasn’t for Thomas Jefferson’s brilliant idea of creating the Declaration of Independence, who knows how America would have turned out today? Ultimately, the Declaration of Independence has become a document that has been interpreted to guarantee the basic rights of everyone in America and abroad. Who would have thought that this one document could have created this much of an impact today? The Declaration of Independence still was, and still is, the most important part of America’s history because of its historical influence. The purpose of this paper is to explore the topic of freedom of speech and free speech zones on college campuses. This paper will answer the questions: Why have so many Universities who protect academic freedom, retreat into fear of freedom? Are school officials afraid of debate and disagreement? Are they trying to keep people (outside the zone) from hearing words that may offend someone? These questions will be answered through analyses of previous court cases, journal articles and news articles.
The First Amendment, usually equated with freedom of speech, affords five protections: Establishment Clause, Free exercise of religion, Freedom of speech, Freedom of press, and Freedom to peaceable assemble. Students (and student groups) in public colleges and universities enjoy full protection under the First Amendment; however, this right depends greatly on the context in which a student might raise a free speech claim. Once an institution creates a limited public forum for a student or group, administration cannot deny recognition to particular student or groups based on viewpoints. Given the great freedom students are afforded, the freedom is not absolute. The courts have allowed administrators to place reasonable restrictions on location, time, and manner of students and groups. In Tinker v. Des Moines, the court made it clear that, students do not “… shed their constitutional rights when they enter the schoolhouse door." To strengthen the importance of free speech on campus the court said, in Shelton v. Tucker “The vigilant protection of constitutional freedoms is nowhere more vital than in the community of American Schools.” These rights allow students to be able to take courses in a wide variety of subject matter, which may include topics often considered controversial. Moreover, student must have the ability to explore and discuss those topics without fear censorship or retaliation.
How much we valuse the right of free speech is out to its severest test when the speaker is someone we disagree with most. Speech that deeply offends our morality or is hostile to our way of life promises the same constitutional protection as other speech because the right of free speech is indivisible: When one of us is denied this right, all of us are denied. Where racist, sexist and homphobic speech is concerned, I believe that more speech - not less - is the best revenge. This is particualrly true at universities, whose mission is to facilitate learning through open debate and study, and to enlighten. Speech codes are not the way to go on campuses, where all views are entitled to be heard, explored, supported or refuted. Besides, when hate is out in the open, people can see the problem. They can organize effectively to encounter bad attitudes, possibly to change them, and imitate togetherness against the forces of intolerance.
"Protecting Freedom of Expression on the Campus” by Derek Bok, published in Boston Globe in 1991, is an essay about what we should do when we are faced with expressions that are offensive to some people. The author discusses that although the First Amendment may protect our speech, but that does not mean it protects our speech if we use it immorally and inappropriately. The author claims that when people do things such as hanging the Confederate flag, “they would upset many fellow students and ignore the decent regard for the feelings of others” (70).
