There are several populations within my community, in which brings great interest to me. One in which attracts me the most is number of mentally ill patients who are being incarcerated for small crimes such as trespassing or robbing the thrift store. The South Carolina mental health state hospital had to close their doors due to the limited funding to keep the facility open. As a result, some of the patients were transferred to local short term mental health centers and they were released into the communities. The patient would go out and commit crimes such as trespassing and the judge would sentence with some years in the prison. There has always been an opinion on the correct way to deal with criminals. This will be yet another, but by me. The ways of dealing with criminals is not easy, and there is technically not a definite way to do so. But in my opinion, among the many goals of corrections, the ways I can agree on are a combination of rehabilitation and deterrence. These two things are completely opposite of one another, but used at the appropriate times, to the appropriate inmates, it could work in a positive way.
"Too many Americans go to too many prisons for far too long, and for no good law-enforcement reason … Although incarceration has a role to play in our justice system, widespread incarceration at the federal, state and local levels is both ineffective and unsustainable. . . We need to ensure that incarceration is used to punish, deter and rehabilitate – not merely to convict, warehouse and forget"(Holder). Former Attorney General Eric Holder does not dispute that prisons play an important role in the justice system. He believes that along with punishing the inmate’s prisons should provide them with rehabilitation. With the already overpopulated prison system across the US there should be alternative for lesser nonviolent offences.

Prisons and correctional facilities in the United States have changed from rehabilitating people to housing inmates and creating breeding grounds for more violence. Many local, state, and federal prisons and correctional facilities are becoming more and more overcrowded each year. If the Department of Corrections (DOC) wants to stop having repeat offenders and decrease the volume of inmates entering the criminal justice system, current regulations and programs need to undergo alteration. Actions pushed by attorneys and judges, in conjunction current prison life (including solitary confinement), have intertwined to result in mass incarceration. However, prisoner reentry programs haven’t fully impacted positively to help the inmate assimilate back into society. These alterations can help save the Department of Corrections (DOC) money, decrease the inmate population, and most of all, help rehabilitate them. After inmates are charged with a crime, they go through the judicial system (Due Process) and meet with the prosecutor to discuss sentencing.
The adversarial system is Australia’s legal system where two lawyers represent their parties' case or position before an impartial third party, usually a jury and/or judge, who attempt to determine the truth and pass judgment accordingly. Retribution is the last resort for the courts, they will try deterrence and rehabilitation first.
Wouldn’t it be completely irrational to sentence every mentally ill individual to jail purely because they suffered from a mental illness? Often, mentally ill people behave in an eccentric manner and allure the attention of police officers who do not differentiate the mentally ill from mentally stable people and immediately charge them with misdemeanors. There are approximately 300,000 inmates, with the number increasing every year, which suffer from a mental illness and do not receive proper treatment. Jails are not adequately equipped to care for mentally ill inmates, which can lead to an escalation of an inmate’s illness. Society has failed to provide enough social resources for citizens suffering from psychiatric illnesses in its community, transferring mentally unstable individuals between mental institutions and jails, when in fact adequate aid such as providing proper medication, rehabilitation opportunities, and more psychiatric hospitals in communities is a necessity to reconstitute these individuals.
Thousands of people statewide are in prisons, all for different reasons. However, the amount of mental illness within prisons seems to go unaddressed and ignored throughout the country. This is a serious problem, and the therapy/rehabilitation that prison systems have do not always help those who are mentally ill. Prison involvement itself can contribute to increased suicide (Hills, Holly). One ‘therapy’ that has increased throughout the years has been the use of solitary confinement, which has many negative effects on the inmates. When an inmate has a current mental illness, prior to entering into the prison, and it goes undiagnosed and untreated, the illness can just be worsened and aggravated.
Prior to taking this course, I generally believed that people were rightly in prison due to their actions. Now, I have become aware of the discrepancies and flaws within the Criminal Justice system. One of the biggest discrepancies aside from the imprisonment rate between black and white men, is mental illness. Something I wished we covered more in class. The conversation about mental illness is one that we are just recently beginning to have. For quite a while, mental illness was not something people talked about publicly. This conversation has a shorter history in American prisons. Throughout the semester I have read articles regarding the Criminal Justice system and mental illness in the United States. Below I will attempt to describe how the Criminal Justice system fails when they are encountered by people with mental illnesses.
The Criminal Justice system was established to achieve justice. Incarceration and rehabilitation are two operations our government practices to achieve justice over criminal behavior. Incarceration is the punishment for infraction of the law and in result being confined in prison. It is more popular than rehabilitation because it associates with a desire for retribution. However, retribution is different than punishment. Rehabilitation, on the other hand is the act of restoring the destruction caused by a crime rather than simply punishing offenders. This may be the least popular out of the two and seen as “soft on crime” however it is the only way to heal ruptured communities and obtain justice instead of punishing and dispatching criminals
The United States has the highest incarceration rate in the world and of that over sixty percent of jail inmates reported having a mental health issue and 316,000 of them are severely mentally ill (Raphael & Stoll, 2013). Correctional facilities in the United States have become the primary mental health institutions today (Adams & Ferrandino, 2008). This imprisonment of the mentally ill in the United States has increased the incarceration rate and has left those individuals medically untreated and emotionally unstable while in jail and after being released. Better housing facilities, medical treatment and psychiatric counseling can be helpful in alleviating their illness as well as upon their release. This paper will explore the increasing incarceration rate of the mentally ill in the jails and prisons of the United States, the lack of medical services available to the mentally ill, the roles of the police, the correctional officers and the community and the revolving door phenomenon (Soderstrom, 2007). It will also review some of the existing and present policies that have been ineffective and present new policies that can be effective with the proper resources and training. The main objective of this paper is to illustrate that the criminalization of the mentally ill has become a public health problem and that our policy should focus more on rehabilitation rather than punishment.
Several states authorize police officers to arrest mentally ill people who have not broken any law. It is argued that this process is a way to promote public order. Hospitals also transfer mentally ill patients to jail in order to deal with the overflow. We as a society have been forced to think that everyone in jail deserves what they get, we over look the fact that some have a mental illness that they can’t control over their actions .Taken all we have learned, this information has let me see what goes on, not only in jail, but in society. With the substantial increase in prison population and various changes that plague correctional institutions, government agencies are finding that what was once considered a difficult task to provide educational programs, inmate security and rehabilitation programs are now impossible to accomplish. From state to state each correctional organization is coupled with financial problems that have depleted the resources to assist in providing the quality of care in which the judicial system demands from these state and federal prisons. Judges, victims, and prosecuting attorneys entrust that once an offender is turned over to the correctional system, that the offender will receive the punishment in which was imposed by the court, be given services that aid in the rehabilitation to those offenders that one day will be released back into society, and to act as a deterrent to other criminals contemplating criminal acts that could result in their incarceration. Has our nations correctional system finally reached it’s critical collapse, and as a result placed or American citizens in harm’s way to what could result in a plethora of early releases of inmates to reduce the large prison populations in which independent facilities are no longer able to manage? Could these problems ultimately result in a drastic increase in person and property crimes in which even our own law enforcement be ineffective in controlling these colossal increases of crime against society?
