Throughout America there are 50,000 agencies that help keep us safe, and put those that can harm us away. Those agencies consist of the police, the courts, and corrections (Bohm & Haley, 2014, 7). Together they are commonly referred to as the criminal justice system (Bohm & Haley, 2014, 7). All three types of agencies each have a particular role that they play in order to keep us safe. Although they swing the hammer, it is also society’s job to help by letting officials know what is happening and what is wrong. In society we also need to keep as many of us out of the system by using social norms and knowing what is right and wrong. When an agency can choose between two or more alternatives that mean the agency has discretion. Arbitrariness can be cause by too much discretion; therefore it is best it is best if it is not too broad. On the other hand inflexible public administration can lead to too little discretion and this is just as bad. As it stands now the agencies are given too much discretion and are not being monitored enough. The framers protected civil rights through the federal constitution, stated constitutions and statutory law because they were concerned about the excessive and unchecked discretion which eventually led to arbitrary decision making. Americans show a cautious distrust if not anxiety of discretion. These rights act as restrictions on the discretion of lawmakers and law enforcers.
The United States has a larger percent of its population incarcerated than any other country. America is responsible for a quarter of the world’s inmates, and its incarceration rate is growing exponentially. The expense generated by these overcrowded prisons cost the country a substantial amount of money every year. While people are incarcerated for a number of reasons, the country’s prisons are focused on punishment rather than reform, and the result is a misguided system that fails to rehabilitate criminals or discourage crime. The ineffectiveness of the United States’ criminal justice system is caused by mass incarceration of non-violent offenders, racial profiling, and a high rate of recidivism.
The current criminal justice system is expensive to maintain. In North America the cost to house one prisoner is upwards of eighty to two hundred dollars a day (Morris, 2000). The bulk of this is devoted to paying guards and security (Morris, 2000). In contrast with this, community oriented programming as halfway houses cost less than the prison alternative. Community programming costs five to twenty five dollars a day, and halfway houses although more expensive than community programs still remain cheaper than prison (Morris, 2000). Tabibi (2015c) states that approximately ninety percent of those housed in prison are non-violent offenders. The treatment of offenders in the current system is understood to be unjust. By this, Morris (2000) explains that we consistently see an overrepresentation of indigenous and black people in the penal system. Corporate crimes are largely omitted, while street crimes are emphasized (Morris, 2000). This disproportionately targets marginalized populations (homeless, drug addicted and the poor) (Tabibi, 2015c). The current system is immoral in that the caging of people is highly depersonalized and troubling (Tabibi, 2015c). This is considered to be a barbaric practice of the past, however it is still frequently used in North America (Morris, 2000). Another moral consideration is with the labelling of youth as offenders in the criminal justice system (Morris, 2000). Morris (2000) argues that we should see youth crimes as a social failure, not as an individual level failure. Next, Morris (2000) classifies prisons as a failure. Recidivism rates are consistently higher for prisons than for other alternatives (Morris, 2000). The reason for this is that prisons breed crime. Mass incarceration has caused the prison’s populations to increase dramatically. The reason for this increase in population is because of the sentencing policies that put a lot of men and women in prison for an unjust amount of time. The prison population has be caused by periods of high crime rates, by the medias assembly line approach to the production of news stories that bend the truth of the crimes, and by political figures preying on citizens fear. For example, this fear can be seen in “Richard Nixon’s famous campaign call for “law and order” spoke to those fears, hostilities, and racist underpinnings” (Mauer pg. 52). This causes law enforcement to focus on crimes that involve violent crimes/offenders. Such as, gang members, drive by shootings, drug dealers, and serial killers. Instead of our law agencies focusing their attention on the fundamental causes of crime. Such as, why these crimes are committed, the family, and preventive services. These agencies choose to fight crime by establishing a “War On Drugs” and with “Get Tough” sentencing policies. These policies include “three strikes laws, mandatory minimum sentences, and juvenile waives laws which allows kids to be trialed as adults.

The police responsibilities are of that of keeping the peace, apprehension of criminals, combat and prevention of crime, and social services. There are many different agencies which are involved in the safeguarding of children and young people. It is vital that they work together in partnership to ensure the child’s safety and welfare. There may be a case where more than one agencies opinion and input is needed, so it is best to consider all agencies when discussing any issues. In Intro to Criminal Justice class, I had the opportunity to learn about the Criminal Justice System more thoroughly. I learned that there are three components that make up the Criminal Justice System such as the courts, law enforcement, and corrections. Each component has its own role in making sure the the Criminal Justice System is functioning properly. If one of these components are not efficient the Criminal Justice system will not be as strong as it could be.
