Within the United States (U.S), the constitution written plans to provide separate powers, which created the three branches of government. The three branches of government are legislative, executive and judicial. All three branches have an influence on the majority of health care decisions. Each branch has its own accountabilities on working together to allow the country to run efficiently, and to declare that the rights of citizens are not discounted or rejected. This is done through checks and balances. A branch may use its power to check the other, and mandate the other two to continue a balance of power among the three branches of government.
The Legislative Branch is headed by Congress, and consists of the House of Representatives and the Senate (USHR) (USHR 2014). Their role is to establish laws, in order to safeguard the public’s health. This branch decides which service or programs of care that the government will spend monies on and to which members of society (Jacox 1997).The Ohio Board of Nursing ( OBN) is a legislative branch that actively ensures the health of the public in the course of the effectively regulating nursing care (ONC 2013). Its authority involves evaluating laws, determining cases concerning state rights and understanding the Constitution (Jacox 1997). For example, it chooses when groups of health care facilities or health care professionals are using illegal, monopolistic practices to safeguard their distribution of services through the analysis and function of antitrust law (Jacox 1997).They work within the criminal and civil arena.
